The Merger Process Team conducted a Concurrence Meeting from 1:05 to 2:10 p.m. on Tuesday, April 12, 2011

Pumose of this Meetine
The Merger Process Team conducted an Avoidance & Minimization (CP4A) Meeting for the Maysville Bypass
(Alternate 2C) on September 17, 2009. The Team changed the LEDPA to Alternate 2A on May 25, 2010. Therefore,
the purpose of this meeting was to discuss the avoidance and minimization measures related to Alternate 2A.
Action Items from Previous Meetines
Byrd Landfill Disposal Site Violation - The case is still under investigation by USACE and USEPA. In an April
27, 2011 e-mail from Mr. Chris Militscher (USEPA) to Mr. Tom Steffens (USACE), Mr. David Wainwright .
(NCDWQ), and Mr. Mark Pierce (NCDOT), Mr. Militscher mentioned that this site is being referred to the
Department of Justice for potential prosecution. Although this violation is within the Project Study Area, the
Byrd Property is not located within the construction footprint of the Maysville Bypass.
Wildlife Underpass - The Nature Conservancy, USFWS, NCDENR, and NCWRC requested that NCDOT
construct a wildlife underpass between Maysville and the Community of Chadwick. NCDOT has agreed to
construct a wildlife underpass as part of this US 17 Improvements Project. This issue will be discussed further at
the upcoming Avoidance & Minimization Meeting for Section C (from north of Maysville to north of Chadwick)
that is tentatively scheduled for June 16, 2011.
Comments & Questions Raised Prior to this Meeting
Prior to today's meeting, Mr. Tom Steffens (USACE) contacted Mr. Mark Pierce (NCDOT) and raised questions
about Wetland 245 and the symbology for several streams on Sheet 5 of 9. Wilbur Smith Associates reviewed
their files and determined that the stream symbology on various files was not consistent and was not unified
when the files were merged. None of those streams are blue-line streams, but rather farm ditches. Wetland 245
is truly a linear jurisdictional wetland.

Mr. Steffens also noted on Sheet 8 of 9 that the impact from the service road to Stream W21 does not fully
extend to the impact footprint of the service road. Therefore; an additional 25 feet of impacts to the Stream W21
should have been included in the matrix. NCDOT will revise the impact matrix by adding 25 feet to Stream
W21.
Avoidance & Minimization Measures
NCDOT has included various measures throughout the project development process to avoid or minimize
impacts to the human and natural environment. Bridging of the White Oak River and a tributary of the White
Oak River, and elimination of the freeway interchanges and replacement with superstreet connections generated
substantial decreases in impacts to the human and natural environment. Elimination of the interchanges reduced
the residential relocations from 21 to 9 and the business relocations from 5 to zero. Elimination of the
interchanges also reduced the wetland impacts from about 40 acres to 22 acres, and the stream impacts from
about 3100 feet to 1600 feet. Increasing the length of the bridge over the White Oak River from 135 to 1,160 feet
decreased wetland impacts from 4.6 acres to less than 0.1 acre. By converting Structure S4A from a culvert to a
100-foot bridge over a tributary of the White Oak River, wetland impacts were decreased from 0.27 to 0.23 acre
and 170 linear feet of stream impacts were avoided.
The jurisdictional impacts for Section B have been avoided and minimized to the maximum extent practicable
based on preliminary design plans dated April 4, 2011 that were presented during this meeting by utilizing
horizontal alignment shifts, vertical adjustments, a 46-foot median width, perpendicular stream crossings, using
3-to-1 slopes in wetlands, locating service roads and turnarounds in non jurisdictional areas, elimination of
proposed interchanges at the northern and southern termini, and bridging the White Oak River and a tributary of
the White Oak River.
New Jurisdictional Impacts
Although there has been a 22-acre (49%) net decrease in wetland impacts during project development, due to the
addition of service roads and refinement of the project design and impact footprint, cumulative wetland impacts
at Wetlands 22, 24, 31, and 42 have increased by about 0.4 acre.

Additional Avoidance and Minimization Measures Requested during the Meeting
Mr. Tom Steffens (USACE) requested that NCDOT study realignment of the southern bypass connection to
existing US 17 to avoid or minimize impacts to Wetlands 2, 27, 30, 31, and 32. Mr. Steffens suggests that this
change might increase the impact to Wetland 27, but will probably avoid or minimize impacts to Wetlands 2, 30,
31, and 32.
Tom Steffens also requested that the turnaround bulbs be shifted to further minimize impacts to Wetlands 27 and
49.
Mr. Travis Wilson (NCWRC) questioned whether the in-stream moratoriums were included on prior CP4A
agreements. NCDOT has included the moratoriums on the green sheet project cormnitments in the document, but
probably not on the previous CP4A agreements. NCDOT will verify whether prior agreements included the
moratoriums as a mitigation measure.
Conditional Concurrence
The Team reached concurrence on the avoidance and minimization measures presented during this meeting
subject to the following conditions.
1. NCDOT will study realignment of the southern terminus of the bypass to determine whether additional
minimization can be achieved for Wetlands 2, 27, 30, 31, and 32.
2. NCDOT will study shifting the turnaround bulbs to further minimize impacts to Wetlands 27 and 49.

3. NCDOT verified that prior CNA agreements have not included in-stream work moratoriums as a
mitigation measure. However, the State Final Environmental Impact Statement includes in-stream work
moratoriums for the Trent River and the White Oak River in the Project Commitments (green sheets).

SECTION 4041 NEPA MERGER PROCESS CONCURRENCE AGREEMENT
CONCURRENCE POINT 4A: AVOIDANCE & MINIMIZATION
BELGRADE TO MAYSVILLE (SECTION B)
US 17, NCDOT Divisions 2 & 3, Onslow & Jones Counties
TIP Project No. R-2514BCD
TIP Description : The North Carolina Department of Transportation proposes a combination of
widening, bypasses of Belgrade, Maysville, and Pollocksville on new location, and other improvements to
the existing US 17 roadway from multilanes north of Jacksonville (R-2514A) to multilanes south of New
Bern (R-2301, the New Bern Bypass) to create a four-lane divided facility.
Avoidance & Minimization : The jurisdictional impacts for Section B have been avoided and
minimized to the maximum extent practicable based on preliminary design plans dated April 4, 2011 that
were presented during the April 12, 2011 CP4A Concurrence Meeting by utilizing horizontal alignment
shifts, vertical adjustments, a 46-foot median width, perpendicular stream crossings, using 3-to-1 slopes
in wetlands, locating service roads and turnarounds in non jurisdictional areas, elimination of proposed
interchanges at the northern and southern termini, and bridging the White Oak River and a tributary of the
White Oak River.
Concurrence is conditionally based; NCDOT to investigate southern radius in flattening curve to avoid
Wetlands 2, 27, 30, 31, and 32. NCDOT would commit to design change if research indicates positive
reduction in impacts. Otherwise, original design stands.
The Merger Process Team met on April 12, 2011 and concurs with the avoidance and minimization
measures for the proposed improvements to Section B of this project.
