Box 1133 Roxboro, NC 27573 (= Legacy Land Group, LLC - Lot 16 - Talley Pointe Hyco Lake [030205, 22-58-(0.5), WSV, B] APR 1 1 2011 REQUEST FOR MORE INFORMATION Dear Sir or Madam: UENR•MNTEROAP WEnMIN AND 901111 NV OMM On March 14, 2011, the Division of Water Quality (DWQ) received your application dated March 10, 2011, to permanently fill or otherwise impact 600 square feet of open water (lake) below normal pool lake level and 1500 square feet of open water (lake) above normal pool lake level to stop erosion of lake front at the site. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will place this project on hold as incomplete until we receive this additional information. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. It is the opinion of this Office that you have reversed your above and below normal pool lake level since the below normal pool lake level must be larger than the above normal pool lake level. Please correct this discrepancy. 2. Please discuss what type of material will be used to address the erosion at the site and state how many feet of shoreline will be impacted. Additionally, please provide a plan section detail of the erosion control device (as requested on page 3 of your application). Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ. Please call Mr. Ian McMillan or Ms. Amy Chapman at 919-807-6301 if you have any questions regarding or would like to set up a meeting to discuss this matter. oVeilar13 Buffers Stormwatei Crnirf iiarn,e and Penwutrorg Unit (WeBSCaPe) 1650 Mail Service Center.
