Army Corps of Engineers Raleigh Regulatory Field Office 6508 Falls of the Neuse Road, Suite 120 Raleigh, North Carolina 27615 Dear Mr. Alsmeyer: v~c~ ~~~~ ~~i~~ ~i' ~ ~9 C~ V ~ O ~i~ 9 2 ~~pF~~ X00 ~~~ ~ o ~~ Subject: EEP Mitigation Acceptance Letter: U-3344A, SR 3015 (Airport Boulevard) Widening, Wake County; Neuse River Basin (Cataloging Unit 03020201); Central Piedmont Eco-Region Reference: NCDOT Nationwide 14 Permit Application Dated March 3, 2006 The purpose of this letter is to notify you that the Ecosystem Enhancement Program (EEP) proposes to modify the mitigation strategy for providing compensatory riverine wetland and stream mitigation for the unavoidable impacts associated with the above referenced project. The original mitigation strategy letter issued by EEP on January 4, 2005, was during the "MOA Transition Period" which allowed the utilization of High Quality Preservation (HQP) at a 10:1 ratio to issue the permit until the end of the transition period (July 22, 2003). At that time, EEP was to provide the required 1:1 restoration mitigation component for all permitted wetland and stream impacts that utilized up front HQP at a 10:1 ratio. Since the permits required for this project were not issued during the MOA Transition Period and a portion of the mitigation required for this project utilized 10:1 HQP, EEP proposes modifying the mitigation strategy. This mitigation strategy letter replaces the mitigation strategy letter issued on January 4, 2005. As indicated in the NCDOT's mitigation request letter dated December 29, 2004 and the Nationwide Permit 14 permit application dated March 3, 2006, the project will impact 109 feet of stream and 0.07 acre riverine wetland. Mitigation for this project will be provided in accordance with Section X of the Memorandum of Agreement between the N. C. Department of Environment and Natural Resources, N. C. Department of Transportation, and the U. S. Army Corps of Engineers signed on July 22, 2003. If the impacts change from the above listed amount, then this mitigation strategy letter will no longer be valid and a new mitigation strategy letter will be required from EEP.
