PROJECT SUMMARY: The applicant proposes to reconfigure an existing private docking facility to allow for the installation of new floating docks into a canal connected to Banks Channel. William C. PROJECT DESCRIPTION: The project site is located at 11 Beach Road South on Figure Eight Island, adjacent to a man-made canal that connects to Banks Channel and Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south approximately 0.1 mile and the property of interest will be located on the right. The applicant currently maintains a two-story single-family, which is bordered by other residential structures. The property borders a cove within a man-made canal on the central portion of the island that connects to Banks Channel and Middle Sound. The lot is approximately 0.45 acre in size and averages approximately 11' above normal high water (NHW). Upland vegetation consists of maintained lawn grass and ornamental landscaping. The 100' of shoreline frontage is stabilized by an existing wooden bulkhead. Located on the waterward side of the bulkhead is an area of high marsh consisting primarily of salt meadow cordgrass (Spartina patens), measuring approximately 20' wide that transitions to low marsh consisting primarily of smooth cordgrass (Spartina altemiflora) approximately 20' wide. DCM did not locate the presence of submerged aquatic vegetation (SAV) within the location of the existing docking facility. An existing access pier extends into the cove of the canal, measuring 45' in length by 6' in width. A fixed uncovered platform, measuring 13' in length by 12' in width is located on the southern side of access pier, creating an 1-head" configuration. An access ramp leads from the access pier onto a floating dock, measuring 24' in length by 6 'in width, which runs in the same alignment as the access pier. There is an existing boatlift, measuring 12' in length by 12' in width located on the northern side of the floating dock. The existing docking facility currently accommodates up to two (2) slips. The applicant received CAMA General Permit Vs 34282-D and 36906-D in 2003 for the existing private docking facility. Based on the peculiar shoreline along the applicant's shoreline, Wilmington DCM staff established a riparian area of access for the applicant prior to issuance of these CAMA General Permits. A pierhead line was established between the most waterward ends of the existing private facilities that were located at the adjacent riparian properties. The riparian lines were then established by connecting the pierhead line to the property boundaries where they met the NHW line of the applicant's property. The New Hanover County Land Use Plan classifies adjacent waters and high ground portion at the property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to reconfigure an existing private docking facility to allow for the installation of a new floating dock into a canal connected to Banks Channel. A new floating dock, measuring 12' in length by 6' in width would be constructed waterward of the existing floating dock, which would run in the same alignment. A floating dock, measuring 11' in length by 9' in width would be located on the southern side of this dock creating an "L-shaped" configuration towards the south. The existing boatlift would remain. The proposed new structures would provide docking space for up to four (4) vessels. The application states that the existing water depth in the area of the existing and proposed floating structures is approximately -3.5' to -11.0' at mean low water (MLW) (See survey dated January 27, 2011). William C. Monk Page 3 10. ANTICIPATED IMPACTS: The proposed structures would incorporate an additional 171 sq. ft. of Estuarine Waters and Pubic Trust Area. Minor increases in turbidity should be expected during construction. The proposed structures would extend approximately 60 feet into a waterbody, which measures approximately 400 feet across. This distance would conform with both the 1/4 rule and the established pier lengths. Based on the application, the proposed structures would encroach into the 15' Adjacent Riparian Property Setback requirement to the south; however, the applicant has received a waiver from this property owner.
