Williams Rivers and Associates, Inc 107 E. 2°d Street Greenville, NC 27834 Subject: City of Washington Brown Street Bridge Replacement, B-5174 Dear Mr. Williams: The NC Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification and Tar-Pamlico Buffer Authorization for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: 1. PCN Corrections. Please indicate in Section A, (1 c.) of the PCN whether the Nationwide Permit 3 has been verified by the Corps of Engineers. Section E (Stormwater Management and Diffuse Flow Plan). Please make the necessary corrections and provide the additional information that was discussed in a phone conversation between Garcy Ward (DWQ) and David Webb (Rivers and Associates) on September 17,. 2010. 2. Plan Sheets. Plan sheets were not included in the application that was submitted to DWQ. Please provide the required information. 3. Avoidance and Minimization. In the application, it is proposed to route stormwater through existing drainage pipes that discharge directly to Jack's Creek. While this activity is permissible under the Tar-Pamlico Buffer Rules (15A NCAC 2B .0259) provided there is not an increase in impervious area, greater treatment could be achieved if the stormwater was discharged outside of the buffer and allowed to sheet flow back to the stream. Please explain whether or not this is not a viable option. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
