Dear Mr. Williams:
The NC Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification and
Tar-Pamlico Buffer Authorization for the aforementioned project. Review of your application revealed it
lacking necessary information required for making an informed permit decision. The permit application
was deficient in the following areas:
1. PCN Corrections.
Please indicate in Section A, (1c.) of the PCN whether the Nationwide Permit 3 has been
verified by the Corps of Engineers.
Section E (Stormwater Management and Diffuse Flow Plan). Please make the necessary
corrections and provide the additional information that was discussed in a phone conversation
between Garcy Ward (DWQ) and David Webb (Rivers and Associates) on September 17,
2010.
2. ]Plan Sheets.
Plan sheets were not included in the application that was submitted to DWQ. Please provide
the required information.
Avoidance and Minimization
In the application, it is proposed to route stormwater through existing drainage pipes that
discharge directly to Jack's Creek. While this activity is permissible under the Tar-Pamlico
Buffer Rules (15A NCAC 213 .0259) provided there is not an increase in impervious area,
greater treatment could be achieved if the stormwater was discharged outside of the buffer and
allowed to sheet flow back to the stream. Please explain whether or not this is not a viable
option.
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold
until we are supplied the necessary information. You have 21 days to respond in writing with the
requested information or notification to this office that the information is forthcoming. If, at the end of

NARRATIVE for DIFFUSE FLOW
E.1b.
NCDOT TIP Project B-5174 consists of an "in-kind" replacement of a structurally obsolete
bridge crossing over Jack's Creek in Washington, NC. The existing bridge is located on
Brown Street which conveys stormwater runoff from the impervious roadway, grassed
shoulders, and imperious sidewalk on the east side of the bridge through as series of two
catch basins and pipe networks on the north and south approach of the bridge. The existing
bridge deck utilizes deck drains which discharge directly into Jack's Creek. The proposed
roadway, sidewalk, and bridge will not add imperious area or increased flows to the existing
outfalls and deck drainage will be eliminated over open waters. Existing pipe outfalls which
directly discharge into Jack's Creek will be removed and replaced with equal or smaller pipe
sizes. The proposed pipe outfall to the west will outlet into a preformed scour hole to
provided diffuse flow through riparian buffer Zone 1. The proposed pipe outfall to the east
will outlet into a preformed scour hole to provided diffuse flow just upstream of the top of
bank within riparian buffer Zone 1. The preformed scour holes were located as far away
from the open waters of Jack's Creek to the maximum extent practicable due to pipe grade
constraints, and downstream slope constraints to avoid re-concentration of flow. In addition
to these avoidance and minimization measures, the proposed sidewalk along the east side of
Brown Street will slope away from the roadway, allowing for maximum diffuse flow along
the grassed shoulder and down the roadway embankment prior to entering Jack's Creek.
