The issues that generated NOVs for this project are truly just not following the erosion control plan and loss of sediment due to an extreme precipitation event. No changes or issues with the design, in fact they tell me all the structures that were in place before the storm withstood the storm fine. They will be conducting some repair work of some banks but it is all within the area that was permitted for restoration already. Part of the problems out there are related to having to dewater the site and how hard that is, how long it takes per day, etc, and so there is discussion with Land Quality of allowing them to work in the wet to get this site repaired and finished before it gets even worse. I have told EEP and the designers that we can approve an exemption to "working in the dry" but they have to request it in writing since our 401 standard condition requires work in the wet. They will submit a modified construction sequence and a justification with their request. Eric, I told them I'd handle it but they will likely send you a copy too for the file there and for your review if you have time (this is emergency so needs to be done asap when it finally gets here) and I'll forward to Tasha/Amanda. This is the Glade Creek restoration that was permitted in late 2007, not the most recent one. Eric, DWQ# is 07-2133. I still plan to conduct a site visit when they are back working up there, Harry at EEP will give me a call when the weather breaks and they are out working and I'll call you Tasha and let you know too. They've scheduled a meeting with some EEP folks and contractors etc, next week and I'll be able to attend and can report back to you if there are any 404/401 issues. It sounds like so far it's just erosion control problems.
