The original permit would have no longer been applicable if you submitted a Notice of Termination for
it. We never received that, and so both permits are still active. The original one has been renewed with
payment of the fee.
If you want that previous one you renewed to remain active and also cover this amendment (I am
understanding it is the same site), you can submit a modification request for NCC191758
(https://edocs.deg.nc.gov/Forms/NCG01-Modification) and indicate that it will include everything
originally submitted for the later NCC192121. I process those Modification requests and can record the
correspondence about this. I will link the two files so the records can be viewed together.
Then be sure to submit a Notice of Termination request for this permit (NCC192121) and choose
"Other" as the reason. In the Additional explanation box, please explain that NCC191758 has been
modified to include this work for the same site. Once we approve the NOT, we can resolve the Notice of
Deficiency and waive the fee.

Thank you for the quick response Bethany. These are both for the same project (electrical
substation). The original scope was modified slightly after the permit was already in place and an
amendment was generated in an abundance of caution to replace the original. As I understood it, the
original permit was no longer applicable as the amendment replaced it in full.
I have copied Briana (Booth & Associates engineering firm representing our interest in this project) to
assist with correcting this issue, given my limited experience in this area. Just to recap for Briana, I paid
the first fee that crossed my desk (original DEQ) via credit card and ignored the other request (amended
DEQ) just thinking that there was a lapse in time in recognizing the payment. It turns out that both
requests were given independent reference numbers for the same project. I also kept the attachments
that Bethany referenced if it helps.
It may be a mute -point which permit is actually applicable at this time, as long as I have one that covers
us. The only scope of work remaining is to repair one driveway and pave the entrances to both which
may have been covered in the original scope of work.
Alternatively, I have no issue with paying a second fee if it keeps me in the good graces of NCDENR.

Tony,
That payment was for a different construction permit annual fee, and it was applied to the attached
invoice. Please see the confirmation email about that. This Notice of Deficiency is for another permit
COC.
If there were not supposed to be two different COCs for this, then this one needs to be terminated
(submit an NOT). I am not sure what is different about the "AMENDMENT" site.

The snapshot below is from an automated email that I received for a credit card payment for our DEQ
permit for the Burnsville substation. It appears as though the payment captured in the snapshot below
is for the original DEQ permit fee, which I feel was sent to us in error. Can this be rectified by applying
the payment for the original DEQ permit to the amended NCC192121 permit?
