Box 67 Lake Junaluska, NC 28745 Subject: Request for More Information 401 Water Quality Certification Lake Junaluska - Sediment Disposal Site DWQ Project # 10-0888 Haywood County Response deadline: January 28, 2011 Dear Mr. Young: The Division of Water Quality (DWQ) has performed a preliminary review of a 401 Water Quality Certification application submitted for the above referenced property. Additional information will be required in order to complete the review process. Please provide the following information so that we may continue to review your project (you and Ms. Susan Wilson discussed these items on December 14, 2010). Additional Information Requested: 1. Regarding the proposed mitigation plan, please indicate on the plan sheet (and in writing) what culverts are to be removed. It is unclear from the diagram in the package (the DWQ has a small scale drawing in the back of the mitigation package, but it is unclear which culverts are to be removed, where they are located, and the specific length of each culvert to be removed). Also indicate the road that is to be removed and replanted. 2. With the removal of the culverts, please outline in writing how the work will be done to prevent sediment deposition (i.e., temporary pump around or other). Depending on the length of the culverts to be removed, please detail how the stream channel will be restored (if the lengths of culvert to be removed are over 20 feet this detail may be necessary). 3. After discussion with Ms. Lori Beckwith, of the US Army Corp of Engineers (USACOE), all mitigation and enhancement work must be completed prior to, or concurrently with, any impacts (i.e., the stream restoration work must be done concurrently or prior to the impact for the disposal site). An Equal Opportunity 1 Affirmative Action Employer Mr. Young December 21, 2010 Page 2 of 2 If Lake Junaluska Assembly wishes to perform the impacts concurrently with the mitigation, the USACOE and the DWQ must receive a signed letter from Haywood Soil and Water (as they are to perform the work) stating definitive dates when the mitigation work will be performed and completed. Only upon receipt of this letter would the USACOE and DWQ consider such a request. At this time the USACOE 404 permit states that the mitigation work must be performed prior to any impact (this permit would have to be modified if the Assembly does otherwise). 4. You stated that impacts of stormwater may be alleviated in the restoration and mitigation area (especially around the maintenance building). Please state what Lake Junaluska will do with regard to point source impacts from stormwater. Please provide your response in writing to the addresses below by January 28, 2011. This letter only addresses the preliminary application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
