PROJECT SUMMARY: The project proposed is to construct a 10-slip docking facility with all associated dock components. 9. Narrative Description On 7/12/10 the applicant submitted an Environmental Assessment to the State Clearing House and received a FONSI on 8/31/10. Since this time the project has been reduced significantly in scope to a 10-slip proposal. The Old Seaport Development LLC (Aqua 10) project is located on the north side of Gallants Channel at 153 Aqua 10 Road in Beaufort. The project area is found by turning off of Highway 70 East in Beaufort (Cedar Street) onto north Turner Street. Follow Turner Street to the stop sign and turn west onto West Beaufort Road. Continue on this road until it dead ends. Aqua 10 road will be on the left. The site is located along Gallants Channel and directly east of the NC Maritime Museum "Tall Ships" site. This project is not located within the Town of Beaufort's Locally Designated Historical District or The National Register Historical District. The property is 492,663 square feet in its entirety and is an average of 4' above NHW. The shoreline length for this property is 1200'. The site currently has an abandoned fish house with associated buildings and gravel and concrete parking and driveways. The high ground portion of the tract is covered with typical grasses, trees and shrubbery. A portion of the shoreline is stabilized with a concrete bulkhead. There are fringes of coastal wetlands along the shoreline which consist of Spartina patens (Salt Meadow Cordgrass) and Spartina alterniflora (Smooth Cordgrass). The proposed development is a commercial project and currently has no existing slips. There are commercial properties to the east and west which include the NC Maritime Museum and the Michael J. Smith Airport. Several new marinas have been proposed and permitted to the south of this project within Town Creek over the past few years. The Town of Beaufort's Land Use Plan classifies this property as Developed with all parts of the AEC classified Conservation. Gallants Channel is not designated as Primary Nursery Area and is closed to the taking of shellfish. Gallants Channel within this area carries a water classification of SC and has an average width of 867'. Water depths are an average of -7.8'nlw in the project area and riparian corridors have been drawn 90° from the channel and USCOE Federal setback. The project would be a distance of 130' from the channel edge and 80' from the USACOE Federal setback. No SAVs or shellfish were observed within the project area. Field Investigation Report: Old Seaport Development LLC Aqua 10 Page 03 10. Proiect Description: The current proposal is to construct a 10-slip docking facility with all associated dock components for commercial use. The applicants are proposing to construct a pier with platform, finger piers and tie pilings with 10 permanent slips. The pier would be partially fixed and partially floating. The fixed portion would be 6' wide, with a height of three feet above the marsh substrate and would begin 55' from the east side of the property and extend over high marsh for 52' then over low marsh for another 90'. It would then extend over open water for approximately 80' where it would intersect the floating portion of the pier by way of a 4' x 40' gangway. The floating portion would be 8' wide and would extend over open water for another 116' where it would intersect a floating t-head platform. The platform would vary in width depending on location. The widths would range from 8' to a maximum of 21.66'. The west side of the platform would be located a distance of 100' from the USCOE federal setback with the east side located a distance of 78'. The docking facility would be 30' from the riparian corridor on the east side. There would be 10 permanent slips located within this area. The slips would be numbered 1 to 10 with a total of 4 floating finger piers (2@ 3' x 30'and 2 @ 4' x 50') and 9 tie pilings within this area. Slips 41 to #4 would be a width of 14.50' with slip 45 a width of 21.08'. All of the eastern slips (#1-#5) would be a length of 30'. The western slips (#6-#10) would be a. width of 22' and a length of 50'. The typical boat using the marina would be 40' mixed types such as sail, charter, yachts and power boats. The docking facility would prohibit overboard discharge with no overnight or live aboard dockage. The applicants propose a "No Sewer Discharge" sign on the western side of the dock entrance. It would be located on high ground adjacent to the pier access. There would be three parking spaces located on existing impervious to the north west of the pier and 125' above normal high water. The width of Gallants Channel is an average of is 867'.The western portion of the pier would extend 219' into the water body from the edge of the coastal wetlands and the eastern portion would extend 222' into the water body from the edge of the coastal wetlands. 11. Anticipated Impacts: The proposed docks and fingers would shade 3,470 ft2 of estuarine bottom and incorporate 9,180 ft2 of Public Trust open water. The access docks would shade and incorporate 312 ft2 of high marsh and 540 ft' of low marsh. The setting of pilings has the potential to cause a temporary increase in turbidity during construction. The proposal is for the construction of a 10 slip docking facility. There would be a total of 10 permanent slips numbered 1-10, a 21.86' x 91' platform, 9 tie pilings and 4 finger piers located within the slip areas. All work would be a minimum distance of 80' from the USACOE Federal channel setback. The width of the floating section would be greater than six feet, however per 7H.0208 (6) (A) could be permitted if the greater width is necessary for safety or to improve public use access. The proposed work is consistent with 15A NCAC 7H.0208 therefore the Morehead City District Office recommends the project be authorized as proposed on plats dated received November 24, 2010, contingent upon all applicable general conditions and the following standard conditions: • The number of slips shall not exceed 10 as shown in the application and plat dated received 11/24/10. • The length of the proposed docks and fingers shall not exceed the distance as shown on the plats. • No work shall hinder navigation in any way. • The docking facility shall not exceed a'/4 of the distance of the water body as shown on plats dated 11/24/10. The project includes a 6 foot wooden walkway accessing an 8 foot wide floating dock via a gangway. The dock will include five 50 foot wetslips and five 30 foot wetslips for a total of ten. There will be two 50 foot finger piers and two 30 foot finger piers constructed. The floating platform located at the waterward end of the structure will be approximately 91 feet long by 21 feet at its widest point. The dockage is being proposed in -7.70 NLW depths at its shallowest point. No dredging will be required. Overboard sewage discharge, maintenance, and fueling will not be permitted onsite.
