NCDWQ Major 401 WQC Project No. 20071470 ver. 1, issued March 17, 2008; ver. 2
issued May 5, 2010; and ver. 3 issued October 25, 2010.
The North Carolina Turnpike Authority (NCTA) is constructing a 12.6-mile long, new location
roadway (Western Wake Freeway) in Wake County, North Carolina. The NCTA submitted an
Individual Section 404 (of the Clean Water Act) Permit Application to the U.S. Army Corps of
Engineers (USACE) for the subject project on August 27, 2007. On April 22, 2008, the Section
404 Permit was issued by the USACE (Action ID No. SAW-2007-02903-292), and subsequent
modifications were issued on May 26, 2010 and November 17, 2010. The Section 401 Water
Quality Certification (WQC) was issued by the North Carolina Division of Water Quality
(NCDWQ) on March 17, 2008 (NCDWQ Project No. 20071470, ver. 1), and subsequent
modifications were issued on May 5, 2010 (NCDWQ Project No. 20071470, ver. 2) and on
October 25, 2010 (NCDWQ Project No. 20071470, ver. 3).
Since issuance of the Section 404/401 Modification on November 17, 2010, the NCTA has
identified an additional area that requires additional impact to accommodate the installation of
a sewer casing at Permit Site 19 in Section B. The sewer casing will be installed now to allow for
future construction of a gravity sewer line by the Town of Apex. Installing the casing now will
provide a cost savings to the Town by preventing the need for a jack and bored sewer line in the
future.

The proposed wetland impact to install the sewer casing will involve Permit Site 19 in Section B.
To install the sewer casing, excavation of wetlands will increase from 0.01 to 0.04 acre.

However, the construction sequencing to install the box culvert at Permit Site 19 has changed
since the original permit application. Raleigh-Durham Roadbuilders has been able to construct
the culvert without a diversion channel. Therefore, impacts associated with mechanized
clearing in wetlands at this permit site have decreased from 0.12 acre to_0.05_acre.? This
decrease in mechanized clearing impacts is greater than the increase in excavation impacts, so
there will be an overall reduction in wetland impacts at this site.
Summary
The modification of the impacts to wetlands indicated in this letter is unavoidable. No
additional mitigation from the North Carolina Ecosystem Enhancement Program is needed to
cover this proposed construction in wetlands as there is an overall decrease of wetland impacts
at this permit site.
REGULATORY APPROVALS
We ask that you modify the existing Section 404/401 Individual Permit to reflect the change in
wetland impacts associated with the changes noted in this letter.
