Based on SUBCHAPTER 01C, 15A NCAC 01C (Conformity with NC Environmental Policy Act), it appears as though this project falls below the impact thresholds that would require an EA. However, if you are aware of an aspect of this project that may require an EA/SEPA document, please let me know. There had been no mention of an EA being required by any regulatory agencies up to this point in the IP process. This would be a significant setback for this project, but we'll do whatever we need to do to be compliant with the appropriate environmental regulations. While the work is done on the dam, is all the water going to flow through the "side" channel? Will the work on that channel be done first, or after the dam is repaired? Also, did you determine that this project does not need a SEPA document? I've had a few other dam repair projects that came under question about SEPA requirements. Thanks.
