BACKGROUND INFORMATION
The general project area consists of the immediate vicinity of Enclave Pond, which is
maintained by the City of Charlotte (the City). The project area is centered on
Mecklenburg County Tax Parcel No. 21912599, located at the southwest corner of
Brotherly Lane and Arrival Drive in Charlotte, North Carolina (35.0925°N, -80.9948°W).
The location of the subject property is depicted by the Site Vicinity Map (Figure 1), the
appropriate portion of the 1996 Lake Wylie, N.C. and Fort Mill, S.C. USGS Topographic
Map (Figure 2), 2005, 2007, and 2010 Aerial Photographs (Figures 3A, 313, and 3C), an
Approximate Waters of the U.S. Map (Figure 4), and a Project Impacts Map (Figure 5).
Enclave Pond was historically a rural farm pond that was breached in December 2008 in
order to allow development of adjacent lots (Enclave subdivision) and the installation of
an adjacent sanitary sewer line. The City proposes to reestablish the recently breached
pond by reconstructing the breached dam and selectively grading within the old pond
footprint. In addition, the City plans to upgrade an undersized driveway culvert located
downstream of the pond.
The pre-breach Enclave Pond occupied approximately 1.77 acres (estimated based on
2005 aerial photographs and existing contours), with a normal water surface elevation of
approximately 628 feet.
EXISTING SITE CONDITIONS
The watershed draining to the project area is in a "built-out", urban condition with an
estimated impervious coverage of 38 percent. This has contributed to excessive channel
erosion and incision. The on-site tributaries drain to Walker Branch, which is located in
the Steel Creek Watershed. Steel Creek is on the 303d list for Biological Impairment at
CW-681, which is the monitoring location where Steel Creek crosses under U.S.
Highway 21 Bypass in York County, South Carolina (downstream of the project area).
Furthermore, a single driveway culvert immediately downstream of the pond floods
frequently and provides the only access for several households.
S&ME visited the site on June 9, 2010, and delineated the jurisdictional boundaries
within the project area. Wetland boundaries within the breached pond and vicinity were
located with a Trimbleo GeoXH GPS unit capable of sub-meter accuracy, and mapped on
the Approximate Waters of the U.S. Map (Figure 4). The USACE visited the site on
September 13, 2010 to approve the delineation, and subsequently issued a Notice of
Jurisdictional Determination on September 13, 2010 (Action ID 2010-01358, Appendix
III).
Streams and wetlands identified in the project area are described below:
Tributary A (Photos 2 and 3): This stream enters the Enclave Pond area from the west.
Tributary A scored 30.0 on the DWQ Stream Classification Form, indicating perennial
flow. The stream channel has been heavily impacted by recent sedimentation, which has
filled the lower portion of the channel and converted it into a linear wetland feature.
Additionally, the channel appears to have been straightened in the past.
Tributary B (Photo 4): This stream enters the Enclave Pond area from the south.
Tributary B scored 40.5 on the DWQ Stream Classification Form, indicating perennial
flow. The stream channel has also been heavily impacted by recent sediment deposition

associated with adjacent residential development. During the field visit, a riprap
equipment crossing associated with recent sewer line installation was observed along the
channel (Photo 5).
Tributary C (Photo 6): This tributary is the outlet stream from Enclave pond. Tributary
C scored 41.5 on the DWQ Stream Classification Form, indicating perennial flow.
Immediately upstream and downstream of Brotherly Lane, the channel has been rip-
rapped. Downstream of the gravel drive, the channel is deeply incised and actively
undercutting the banks, resulting in the culvert being perched over the channel bed by
approximately 3 feet.
Wetland 1 (Photo 1): Enclave Pond was breached in December 2008 and has since
developed scrub/shrub and herbaceous wetland characteristics. The scrub/shrub area is
predominantly black willow (Salix nigra) and sapling bald cypress (Taxodium distichum),
and the herbaceous area contains common rush (Juncus effusus), shallow sedge (Carex
lurida), softstem bulrush (Scirpus validus), and cattails (Typha latifolia). Soils within the
pond demonstrate hydric indicators (sulfidic odor and low-chroma colors). However, the
soil has been disturbed by the recent deposition of sediments, apparently a consequence
of adjacent construction.
PROJECT PURPOSE AND NEED
Establishment of the proposed pond has multiple purposes and benefit, including:
Flood control for downstream residential access road.
- Neighborhood amenity.
I -year flow volume mitigation.
Total suspended solids (TSS) removal.
Nutrient removal.
A key aspect of this project is to reduce downstream flooding. A single driveway culvert
immediately downstream of the pond floods frequently. The City of Charlotte considers
the flood mitigation a high priority because the driveway serves multiple households and
provides the only access in the event of an emergency. Second, the neighborhood wishes
to restore the pond as an aesthetic and recreational amenity. Finally, this project will
provide water quality improvements for the downstream watershed. In particular, the
pond is expected to provide 66 percent total suspended solids (TSS) removal and a
proportionate removal of nutrients. Furthermore, the pond will control the volume of the
one-year rainfall event to mimic pre-development hydrology, which is expected to
provide water quality enhancements by restoring the downstream flow regime to reduce
channel erosion and improve in-stream habitat.
DESCRIPTION OF PROPOSED WORK
In order to allow for passage of the 100-year storm event (to allow for emergency vehicle
access to multiple houses) and limit downstream erosion of Tributary C, the current 42
linear feet (If) of 42-inch diameter culvert under the gravel drive will be replaced with 52
If of 9-foot x 6-foot box culvert buried to one foot depth. In addition to the 10 If of new
culverted impacts, 85 if of Tributary C (combined total upstream and downstream of the
culvert) will be re-graded and the banks will be stabilized.

In order to re-establish Enclave Pond in a manner that provides similar capacity to the
pre-breach conditions and limits flooding concerns, the pond banks will be re-graded and
excavated to a bottom depth of 618 feet. A stamped concrete headwall / weir will be
installed in the location of the original pond breach in order to establish the proposed
pond elevation at project completion of 623 feet. In accordance with current pond safety
and design standards, a proposed 15 foot wide safety bench starting approximately 10
feet inland of the permanent pool elevation will be established to protect adjacent
properties. Disturbance associated with grading of the new pond banks and installation of
the pond control structures will result in 0.98 acres of permanent impact to the existing
wetlands that have established under the footprint of the original pond (Wetland 1).
Work associated with Tributaries A and B will involve natural channel rock cross vane
tributary tie-ins. The proposed grade control structures are necessary to match the
channel elevations to the new pond bottom elevation. As these tie-ins will be installed
using natural channel design techniques, no permanent impacts to existing streams will
occur due to their tie-ins with the new pond.
Impacts resulting from the proposed project are detailed in Table 1.

As identified above, work associated with the pond will result in impacts to 0.98 acre
of Wetland 1, along with 95 if of Tributary C. A copy of CSWS' Preliminary
Construction Plans is included in Appendix IV.
ALTERNATIVES ANALYSIS
This alternatives analysis and the proposed selection of the wet pond alternative were
developed with consideration of the Environmental Protection Agency's (EPA) "Region
4 Guidelines for Reconciling Storm Water Management and Water Quality and Resource
Protection Issues." The City of Charlotte has a robust Post Construction Controls
Ordinance and should help mitigate future adverse water quality impacts due to new
impervious area in the watershed. However, in conformity with EPA regulations, the
City is also attempting to improve stream quality in existing impaired watersheds. Re-
construction of the pond will provide the most expeditious and cost-effective method of
achieving this goal. Accordingly, the City has selected Alternative "C" (see below).
Alternative A: No-build
Alternative `A' can be characterized as the "do nothing" approach. In this approach, no
action would be taken and the existing wetland would be left in place. This alternative

was not selected as it does not meet the project's goals. The existing wetlands do not
provide the flood detention benefits that the proposed pond will, and therefore do not
address the downstream flood safety and stream impairment issues. Furthermore, the
neighborhood would not receive the pond that they desire as an aesthetic and recreational
amenity. Finally, there are a few environmental benefits associated with this option. The
lack of pollutant removal and stormwater detention associated with this option (when
compared to the preferred alternative) will not result in significant environmental
improvements for the impaired watershed. Therefore, the heavily urbanized watershed
will continue to contribute erosive flows and pollutants to Steele Creek and ultimately the
Catawba River.
Alternative B: Off-line Measures
Alternative `B' would involve retrofitting the remaining watershed with alternative
structural Best Management Practices (BMPs) in order to achieve water quality benefits
similar to those recognized in the proposed preferred alternative (Alternative `C'). Like
Alternative `A', this approach would not provide the neighborhood with the pond that
they desire as an amenity. However, since this alternative has the potential to meet the
other project goals, it was evaluated more extensively than Alternative `A'.
While many different structural BMPs are available, for the purpose of this alternatives
analysis, bioretention cells were assumed to be the primary structure that would be
utilized. The use of bioretention cells is a valid comparison because the City of Charlotte
has a solid database of information for comparative purposes. Bioretention cells would
have the potential to provide water quality treatment equivalent to that of the proposed
pond. However, experience within in the Charlotte geographic region has shown that the
drainage area of bioretention cells should be limited to impervious surfaces due to a
tendency for the soils to clog from clay particles in the runoff. Construction of
bioretention cells that are limited to impervious surfaces in the watershed would not be
feasible. The fact that the watershed consists of existing built-out area that was not
originally designed and built to direct runoff to potential bioretention locations makes it
impractical to retrofit the existing developed areas.
In addition to construction infeasibility, cost is also a considerable hurdle with
Alternative `B". The estimated construction cost of Alternative `B' is substantial. Per
the City of Charlotte and North Carolina Division of Water Quality Best Management
Practices Manuals, bioretention cells may drain no more than five acres but are optimal
when designed to drain no more than one acre. In order to be conservative in favor of
bioretention cells, the City's analysis assumed that each cell treats the maximum area of
five acres. Given that the watershed area is 138 acres, 28 bioretention cells would be
needed. The City has constructed several bioretention cells as part of its Pilot BMP
Program and has determined that the average construction cost is $35,000 per treated
acre. Assuming the entire watershed would be treated, the total construction cost to
retrofit the watershed with bioretention would be approximately $4,830,000.
Additionally, based on recent consultant design fees, each bioretention cell would be
expected to cost $36,000 to design, for a total design cost of $1,008,000. Given these
estimates, the total cost to design and build 28 bioretention cells to treat 138 acres would
be $5,838,000.
Property acquisition for the hypothetical bioretention cells presents considerable cost
challenges as well. The high-density nature of the adjacent subdivision, along with

existing watershed topography, would necessitate acquisition of properties that might
already have occupied single-family residential structures. In the event that the City was
able to obtain property with existing, occupied single-family homes, the City would be
required to pay market value for the homes, and internal real estate costs would further
inflate the cost to construct the bioretention cells. Homes in the watershed are estimated
to have a value between $150,000 and $200,000. In order to duplicate the treatment
provided by the pond, it's estimated that a minimum of 10 occupied, single-family
properties would need to be acquired at a minimum cost of $1,500,000. This increases
the total estimated minimum cost to perform water quality retrofits outside of the stream
to $7,338,000.
In addition to the extensive cost, the political feasibility of Alternative `B' is extremely
unlikely. Acquiring land from homeowners for the purpose of water quality retrofits
simply would not be allowed by the Charlotte City Council or local residents. At least '/4
of the bioretention cells could not be constructed due to the presence of existing single-
family development. As a result, regardless of the formidable economic constraints,
Alternative `B' could only treat a portion of the watershed.
Alternative C: Wet Pond
Alternative `C', in which the pond will be reestablished and incorporate flood control,
water quality, and current safety features, is the preferred alternative. Under the proposed
plan, the former farm pond would be impounded with a retaining wall that will set the
permanent water surface elevation at 623 feet. A six-inch diameter orifice will control
the flow discharging from the pond at this elevation, while flows resulting from the
runoff of larger magnitude rainfall events will overtop the 20-foot wide weir wall at
elevation 625 feet. This outlet configuration will allow the pond to store the entire
volume of runoff resulting from the one-inch rainfall event and 96 percent of the volume
of runoff resulting from the one-year rainfall event, with a detention time of
approximately 52 hours. Discharge from the pond will be managed such that the bankfull
flow will discharge from the pond in a pulse over a two-to-three hour period. This pulse
flow will vary between approximately 7.0 to 18.2 cubic feet per second (cfs) and then
abruptly be reduced to a magnitude of approximately 1.5 to 3.0 cfs, which the City
believes is more representative of base flow in the stream. This base flow will then
extend for the duration of the 52-hour detention time. This should encourage restoration
of a pre-development post-storm flow regime within the receiving stream, thereby
providing downstream flood mitigation and in-stream ecological improvements.
Furthermore, the pond is expected to provide 66 percent TSS removal and a proportionate
removal of nutrients.
The preferred alternative does not present the monetary and timeframe hurdles inherent to
Alternative `B'. First, property acquisition for Alternative `C' has already been
accomplished. An easement was donated by the residents of Enclave Subdivision for the
purpose of re-constructing the pond. Accordingly, this project can be built within a year
of its agency approval, and provide immediate benefits. This is in contrast to the
approximate 20-year timeframe for Alternative `B'. Furthermore, the estimated
respective design and construction costs are $136,000 and $401,000, for a total estimated
project cost of $537,000. This is less than 8% of the estimated $7,338,000 cost for
Alternative `B'.

Alternative `C' was selected as the preferred alternative as it achieves the flood control,
neighborhood pond amenity, and water quality goals of the project. This alternative is
also the most feasible, cost-effective, and timely plan for achieving the individual project
goals and the City's overall water quality goals.
AVOIDANCE AND MINIMIZATION
As stated in the alternatives analysis above, permanent impacts to Wetland 1 (0.98 acre)
are required in order to effectively meet downstream flood control requirements. With
respect to stream impacts, project-wide impacts are limited to 95 If which is considerably
less than the 1501f that is typically the threshold for requiring mitigation. Impacts are
associated with bank stabilization, structure emplacement and adjustment of the channel
invert in the vicinity of the culvert to accommodate the newly buried culvert condition.
Additionally, impacts to Tributaries A and B were minimized by redesigning the tie-ins
to the pond from the originally proposed gabion structures to rock cross vanes, which are
in compliance with natural channel design principles. Work areas have been minimized
to the extent practicable and have been limited to what is necessary to facilitate the
proposed work. Following construction, disturbed areas within the work site will be
restored to original grade and elevation, and excess material will be removed to a high
ground disposal area.
Appropriate temporary erosion and sediment control practices will be implemented to
meet water quality turbidity standards. Best Management Practices (BMPs) employed
for the project will be in compliance with the most recent version of the "North Carolina
Sediment and Erosion Control Planning and Design Manual," and the local governing
authority. Impacts have been avoided and minimized, and appropriate measures will be
taken during construction to allow flow and circulation patterns of waters of the U.S. to
remain unaffected. The proposed project will not result in additional impervious surface.
PROTECTED SPECIES
To comply with applicable sections of the Endangered Species Act (ESA) of 1973 (16
USC 1531-1543), S&ME conducted a review of the U.S. Fish & Wildlife Service
(USFWS) list of federally protected species (updated June 23, 2010) documented within
Mecklenburg County, North Carolina. This review identified four protected species:
three plants and one animal. Listed flora and fauna and their federal status are identified
in Table 2.

In addition to the USFWS database review, S&ME also consulted the North Carolina
Natural Heritage Program (NCNHP) Geographic Information Systems (GIS) database
Virtual Workroom and Element Occurrence (EO) Database for a listing of EOs of
endangered or threatened species within or near the project area. The EO Database
identified two federally protected plant species within a two-mile radius of the project
area, viz. the Smooth coneflower and Schweinitz's sunflower. However, the project area
does not contain suitable habitat for these species.
The Carolina heelsplitter is identified due to its extinct range. The proposed project will
not impact streams that drain to known populations of Carolina heelsplitter or its
designated Critical Habitat. No documented occurrences of Carolina heelsplitter are
known for Walker Branch or its tributaries in which the project area is located.
The Michaux's sumac is identified due to its historical range. Similarly, the project area
does not contain suitable habitat for Michaux's sumac. Accordingly, the proposed
project is not anticipated to impact these protected species or their designated Critical
Habitat.
S&ME also provided scoping letters to the USFWS and NCNHP on October 14, 2010.
To date; a response from either agency has not been received.
CULTURAL RESOURCES
S&ME reviewed listings on the Charlotte Historic Commission GIS layer. This effort
revealed that there are no historic properties within 0.5-mile of the project area.
Accordingly, it is not anticipated that the proposed project will adversely affect historic
properties or cultural resources.
A scoping letter was also provided to the North Carolina State Historic Preservation
Office (SHPO) on October 14, 2010, requesting their review of additional records
regarding cultural, archaeological, or historical resources in or near the project area. An
October 25, 2010 response to this request was received which stated that SHPO did not
know of any historic resources that would be affected by this project and thus they have
no further comment regarding this project.
PROPOSED COMPENSATORY MITIGATION
To mitigate for the proposed 0.98 acre of wetland impact, the City proposes to purchase I
acre of riparian wetland credit for the North Carolina Ecosystem Enhancement Program
(EEP) In-Lieu Fee (ILF) program. Use of the EEP ILF is necessary because the City's
Umbrella Mitigation Bank does not currently have the necessary wetland credit available
for purchase. The EEP accepted the in-lieu payment request from CSWS on October 26,
2010. A copy of the payment acceptance letter is attached in Appendix 5.

our published regulations, this determination may be relied upon for a period not to exceed five years from the date of this

Section 404 of the Clean Water Act (CWA)(33 USC § 1344). Unless there is a change in the law or our published

This delineation/determination has been conducted to identify limits of COE's Clean Water Act jurisdiction for the particular
site identified in this request. The delineation/determination may not be valid for the wetland conservation provisions of the
Food Security Act of 1985. If you or your tenant are USDA Program participants, or anticipate participation in USDA
programs, you should request a certified wetland determination from the local office of the Natural Resources Conservation
Service, prior to starting work.

The site contains wetlands as determined by the USACE 1987 Wetland Delineation Manual and is adiacent to stream
channels located on the property that exhibit indicators of ordinary high water marks The stream channel on the
property is an unnamed tributary to Walker Branch which flows intoWalker Branch which flows into Steele Creek
which flows into Sugar Creek which flows into the Catawba River which is a Section 10 navigable-in-fact waterway that
ulitmately flows into the Atlantic Ocean.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state, federal or local
government permits, regulations or authorizations associated with the proposed activity including SL 2009-337: An Act to Promote
Compensatory Mitigation by Private Mitigation Banks.
This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following
table.

Upon receipt of payment, EEP will take responsibility for providing the compensatory mitigation. If the regulatory agencies require
mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the
applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed
in accordance with the N.C. Department of Environment and Natural Resources' Ecosystem Enhancement Program In-Lieu Fee
Instrument dated July 28, 2010.
