Public Notice Comments
Dear Monte:
This is in regard to the Public Notice for the Stinking Creek mitigation plan. Based on this review of the
mitigation plan, our comments are as follows:
Stream Preservation
As indicated in the first round of comments from DWQ dated June 18, 2010, the southern portion
of the proposed stream preservation reach appeared to only have a protected buffer on the
northwest side of the stream. DWQ believes that stream preservation should have a buffer of
equal distance on either side of the stream. The current migitation plan has been modified from the
initial plan, but still shows a portion of the stream along the southern reach that may only contain
protected buffer on one side of the stream. We would like to see clarification of stream
preservation reach lengths by locating them on a map. Otherwise, we still believe that this would
not provide proper protection of Stinking Creek to be considered for Preservation at the poroposed
5:1 mitigation credit ratio.
Wetland Preservation
• Please be aware that our rules state that for 401 wetland mitigation, 1:1 must be restoration or
creation. Therefore, wetland preservation would not qualify for these credits for offsetting
impacts on the Chatham Park site.
