Mr. Smith:
As you are aware, the Department has monitored the Myrick Pond Mitigation Site since its
construction in September of 2005. The site is located in Richmond County, adjacent to the U.S.
220 Ellerbe Bypass approximately 2.4 miles south of Norman, N.C. This 13.6 acre site provides
the following types of mitigation: 9.40 acres of open water, 2.45 acres of emergent and riparian
wetlands, 1.90 acres of upland pine plantation and 817 linear feet of stream restoration. The
riparian wetland area was planted in the winter of 2004 and replanted in December of 2006.
Hydrologic monitoring gauges were set in January of 2007. NCDOT proposed to monitor the
Myrick Pond mitigation site for five years or until success criteria were met; with hydrological,
vegetation and stream stability monitoring conducted each year. After each growing season,
annual monitoring reports were submitted to the appropriate regulatory agencies via the Natural
Environment Unit's (NEU) website:

Hydrologic success criteria established for Myrick Pond states the site must demonstrate
saturation or inundation within 12-inches of the soil surface for at least a consecutive 12.5% of
the growing season during years of normal rainfall. Therefore for the 225-day growing season in
Richmond County, the criterion is a consecutive 28 days. Table 1 provides a summary of the
hydrologic data (the percentage of the growing season that saturation was indicated) at each
groundwater gauge location for the past five years of monitoring.

After four years of vegetation monitoring, data for 2010 shows that the site has met vegetative
success criteria by yielding an average density of 435 trees per acre surviving, well above the
minimum requirement of 290 trees per acre. Individual annual monitoring data is provided
within the monitoring reports available on NEU's website between 2007 and 2010.
After five years of Level II stream stability monitoring, visual inspection of Myrick Pond
indicates that the channel remains stable with little difference during the monitoring timeframe.
A site visit was conducted on August 12th, 2010 with the regulatory agencies and NCDOT
personnel present. It was determined at that meeting that the site success criteria had been met
and that no further monitoring would be required. NCDOT committed. to completing a final
monitoring report detailing the fourth year monitoring data. As a result of that meeting, NCDOT
ceased hydrologic monitoring and the data presented in the fourth year monitoring report is
detailed only through August 12`h. The vegetation data was completed and presented in the final
report. The 2010 report has been submitted to the resource agencies via the NEU's website.
Based on the wetland and stream monitoring results, NCDOT requests that the appropriate
resource agencies provide documentation stating that no further monitoring is required and that
