Send all suspicious email as an attachment to Report Spam. <mailto:report.spam@nc.gov> Greetings, The Wilmington District, U.S. Army Corps of Engineers has received an application from Lennar Carolinas to place fill material in 236 linear feet of intermittent stream (requesting a waiver) and 290 linear feet of perennial stream and 0.018 acre of wetlands to facilitate the construction of a residential development in Denver, Catawba County, North Carolina. I have attached the preconstruction notification and project plans for your consideration. The applicant has proposed mitigation at a ratio of 0.5 : 1 for intermittent stream loss and 2:1 for perennial stream loss. However, the Corps typically requires compensatory mitigation for low quality intermittent stream loss in this region at a ratio of 1.5 : 1. You are receiving this notice in accordance with 2017 Nationwide Permit(NWP) General Condition 31(d)(2) because the proposed project would result in the loss of greater than 300 linear feet of intermittent stream bed. You have 10 calendar days from the date of this e-mail to give our office notice that your agency intends to provide substantive, site-specific comments. The comments must explain why your agency believes the adverse effects will be more than minimal. If you contact our office within 10-days, we will wait an additional 15 calendar days before making a decision on the pre-construction notification. We will fully consider agency comments received within the specified time frame concerning the proposed activity's compliance with the terms and conditions of the NWPs, including the need for mitigation to ensure the net adverse environmental effects to the aquatic environment of the proposed activity are minimal. You will not receive a response from our office regarding your comments. However, we will document and address your comments in the administrative record. As shown on the attached exhibits, the proposed project will include permanent impacts to two wetlands and three streams for fill associated with three road crossings in addition to minor temporary impacts for the installation of a sanitary sewer where directional boring was not feasible. Rindner, PLLC. limited through site selection location, design, location/orientation of the proposed lots and access routes and a large portion of the site will remain undisturbed tree save with wide buffers along streams and significant wetland features. Due to the location of the features in relation to existing roads and municipal infrastructure, opportunities to completely avoid these features were limited. The total permanent wetland impacts proposed include 0.018 ac of wetland (Wetlands XX & PP). The total permanent stream impacts proposed include 5261f of stream channel (Streams A, M & J). Efforts of impact minimization were implemented during the design to preserve the existing channel hydrology and limit adverse effects to existing, onsite natural habitat. Impacts associated with the proposed development were limited through site selection, design, and location/orientation of the proposed lots and access routes. The overall site plan has undergone several significant revisions through negotiations with the County that have resulted in the reduction of an additional crossing that would have otherwise been required. All of the proposed stream impacts are for required crossings only and the site layout was carefully considered and designed to avoid a large, high quality wetland complex in the center of the site. The proposed roadways will be maintained by NCDOT and the crossings have been designed to meet NCDOT requirements, which do not allow bottomless crossings in this case due to a lack of the required bedrock. Each of the crossings has been designed to minimize impacts to the extent possible while meeting the engineering requirements, as detailed in the attached memorandum from the project engineer. One temporary open cut for a sewerline installation will be restored to pre- existing conditions per the attached stream stabilization detail. The applicant has demonstrated substantial avoidance and minimization efforts in which 97% of the 15,548 linear feet of stream channels and 99 % of the 1.29 ac of wetlands onsite will be avoided on the project. The applicant requests a waiver for 236 linear feet of impacts to Intermittent stream A. This feature forms at the base of a deeply incised erosional gulley below a maintained utility corridor and as such has a highly eroded, altered pattern and profile, a discontinuous bed and bank, and lacks any consistent ordinary high water mark through the reach proposed for a waiver. Impacts to this feature are unavoidable due to the constraints imposed by site conditions, steep terrain, and design requirements. Attempts to obtain an easement along the privately owned access road to the north of the proposed crossing area were unsuccessful. The crossing could not be shifted south due to sight distance, radius of curvature, and safety requirements as detailed in the letter of memorandum provided by the project engineer in the Waiver Study section. The attached NCSAM indicates that the study reach is of relatively low functional quality with limited aquatic habitat opportunity. Please see the enclosed assessment form for matrix scores and overall functional ratings derived from the NCSAM. Additional forms and photographs of these features are provided in the Waiver Request Study section of the permit application. To compensate for the anticipated permanent impacts, the applicant is proposing payment to the NCDMS at a 0.5: 1 ratio for 2361f of low -quality intermittent stream impacts and a 2:1 ratio for 290 linear feet of perennial warm water stream impacts. The overall site plan as underwent several significant revisions and negotiations with the County that have resulted in the reduction of an additional crossing. Roadways need to be built to DOT standards and are subsequently subject to design requirements that limit further minimization of stream impacts per the attached memorandum from the project engineer. 1 b. Construction techniques will implement approved erosion control methods to avoid/minimize impacts to onsite/adjacent offsite receiving conveyances. WK Dickson has reviewed the Site Plan & Stream Disturbance and provides the following details. It is important to note that all of the roadway crossings associated with this project will be maintained by NCDOT upon completion of construction and are subsequently required to be designed to NCDOT roadway design standards. In general, NCDOT roadway design standards are more strictive than most Municipal standards. Below are a few NCDOT standards which are impacting this project: NCDOT does not allow structural retaining walls to be utilized for fill slope support adjacent to roadways. This makes grading out fill slopes adjacent to roadways difficult in areas that have steep existing topography. NCDOT has stringent foundations requirements for Bottomless Culverts which requires high quality bedrock to be present as foundation bedding material. Bottomless Culverts cannot be installed on streams which lack this type of bedrock. Maiden Creek Way which bisects the upper end of Stream 'A' has been classified by NCDOT as a Collector Street to provide the Shannon Woods Subdivision and future surrounding developments with adequate street infrastructure to handle ultimate traffic demands. Roadways that are classified as collector streets by NCDOT require larger street cross -sections, larger road radii and a more 1213 W. The current design for Maiden Creek Way in the area of Stream 'A' has a relatively steep longitudinal slope for a collector street. To mitigate this road slope, the roadway was designed with a larger horizontal radius which provides better sight distance, safety parameters and driving conditions. To avoid the Stream 'A' disturbance, Maiden Creek Way would have to be designed with multiple reverse curves that have small radii which would result in a roadway that is does not have collector street characteristics and has subpar sight distance. This condition would create an unsafe environment for the adjacent homeowners, pedestrians and motorists within the Shannon Woods Subdivision and would reduce the benefits & quality of life that the collector street provides the surrounding area. The natural conditions of the property and Stream 'A' is creating a scenario that makes the design & construction of Maiden Creek Way difficult without disturbing a portion of the stream. The County is requiring a 50' property buffer to provide the surrounding rural area with screening from the subdivision to help maintain the adjacent property owner's current quality of life. This property buffer is within close proximity of Stream 'A' and limits the potential design alternatives for the collector street. The portion of Stream'A' that we are proposing to disturb is within a 25' deep ravine with approximate 1:1 side slope and 7% longitudinal slope. These conditions are creating more stream disturbance than a normal stream crossing because the amount of tie-in slope needed to transition from the roadway elevation to the existing stream elevation. Lastly, NCDOT does not allow retaining walls adjacent to their roadways due to maintenance concerns. Since Maiden Creek Way is required to be designed to NCDOT standards, this is limiting the engineer's ability to reduce the stream disturbance by installing a retaining wall along the roadway. This design criteria is resulting in the current design conditions which shows a 30' high fill slope with a 2:1 side slope that is causing an additional +/-1151f of stream disturbance. In conclusion, it has been one of our core focuses to be very conscious of the existing environmental and cultural conditions at this site as we have proceeded through the initial planning, rezoning, and design phases. The overall site plan that you see today has underwent several layout revisions as we've fought to protect the integrity of the land while making sure we provide a safe, livable community of which future residents can be proud, while also allowing them to include the natural environment into their everyday lives. For example, during the rezoning process, the County initially asked that we make a fourth (4f) stream crossing in the northern part of the site to maximize road connectivity. It can be found on the Denver USGS Topographic Quadrangle Map at a latitude of 35.5714 N and longitude of 81.0545 W (Figure 2). The site consists of broad ridges with mixed hardwood — pine forest types and forested slopes leading to alluvial forest along Reed Creek and its tributaries. Upland areas along the broad ridges and upper slopes are disturbed with a dense understory. A portion of the site along Highway 150 consists of commercial businesses, a sports field, and agricultural fields with horse barns and homes. Shannon Woods Threatened / Endangered / Protected Species Evaluation Three animal species with federal protection are listed as potentially occurring in Catawba County: • Northern long-eared bats (Myotis septentrionalis), listed as Federally Threatened, roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees during summer months. Males and non -reproductive females may also roost in cooler places, like caves and mines. It has also been found, rarely, roosting in structures like barns and sheds. Northern long-eared bats spend winter hibernating in caves and mines, called hibernacula. • Bald eagles (Haliaeetus leucocephalus), protected by the Bald and Golden Eagle Protection Act, typically inhabit forested areas near large bodies of open water such as lakes, marshes, seacoasts and rivers where there are suitable fish populations and tall trees for nesting and roosting. • Bog Turtles (Glyptemys muhlenbergii), listed as Threatened due to similarity of appearance, live in the mud, grass and sphagnum moss of bogs, swamps, and marshy meadows. These wetlands are usually fed by cool springs flowing slowly over the land, creating the wet, muddy soil needed by the turtles. RESULTS: The site is primarily mixed pine -hardwood forest along ridges and upper slopes with open canopy communities along Highway 150, Wobegone Trail, and agriculture roads and field edges, including small powerline right-of-ways. Alluvial forest with streams and wetlands exist within the valleys below broad ridges. Species lists reflect the seasonality of the survey. The mixed pine - hardwood forest has a canopy which includes Virginia pine (Pinus virginiana), short -leaf pine (P. echinata), loblolly pine (P. taeda), yellow poplar (Liriodendron tulipifera), white oak (Quercus alba), chestnut oak (Q. montana), red oak (Q. rubra), hickory (Carya spp.), red maple (Acer rubrum), sweetgum (Liquidambar styraciflua), and American beech (Fagus grandifolia) in less pine dominated areas along slopes. The subcanopy supports water oak (Q. nigra), black cherry (Prunus serotina), American holly (Ilex opaca), sourwood (Oxydendrum arboretum), transgressives, and eastern red cedar (Juniperus virginiana). Shrubs Chinese privet (Ligustrum sinense) and vaccinium (Vaccinium sp.). The sparse herb layer consists of Christmas fern (Polystichum acrostichoides), running cedar (Diphasiastrum digitatum), cranefly orchid (Tipularia discolor), variable leaf heartleaf (Hexastylis heterophylla), sphagnum 0 Wetlands and Environmental Planning Group Leonard S. The subcanopy includes black willow (Salix nigra), American holly, eastern red cedar, paw paw (Asimina triloba) and transgressives. Shrubs include Chinese privet, multiflora rose (Rosa multiflora), and strawberry bush (Euonymus sp.). The sparse herb layer includes wild onion, Nepalese browntop (Microstegium Vimineum), chickweed (Stellaria sp.), and Christmas fern. Vines include poison ivy (Toxicodendron radicans), Japanese honeysuckle, and greenbrier. The roadside edges, field edges, and the small powerline right-of-ways do not have a traditional canopy as it is managed by mowing and clearing of woody species. The subcanopy from the adjacent woodlands include Virginia pine, loblolly pine, sweetgum, oak (Quercus sp.), American holly, black cherry, red maple, paw paGIS, and eastern red cedar. Shrubs include Chinese privet, sumac (Rhus sp.), groundsel tree (Baccharis halimifolia), and blackberry (Rubus sp.). Threatened & Endangered/Protected Species Results • All potential habitat for dwarf -flowered heartleaf along wooded ridges and slopes was closely examined. A population of heartleaf exists along the upper slopes of the larger streams on -site. Flowering individuals were observed and a positive identification as Hexastylls heterophylla was made using morphological characteristics unique to this species. No individuals of H. naniflora were observed. • All potential habitats for Schweinitiz's sunflower along the power line right- of-ways, roadside and field edges were closely examined. Shannon Woods — Threatened /Endangered /Protected Species Evaluation • Comparing our site location to the USFWS Asheville office's website (http://www.fws.gov/asheville/htmis/project review/NLEB in WNC.html) it appears that the site meets the "exempt" criteria which requires no further action under section 7 or section 9 of the Endangered Species Act for the northern long eared bat. • There is no preferred habitat for bald eagles on the site. No bald eagles were sighted during the survey nor were any nests or nesting activity observed. • The wetland/stream complexes and other wetland areas were examined for the presence of bog turtles. No individuals were observed during the survey nor would any be expected on -site. RECOMMENDATIONS: Based on the results of the field evaluation the review of available data, we see no potential for a `Take' to occur to any of the protected species discussed within this report. WEPG did not identify any protected species occurring on the subject property. No further investigation of the presence of protected species on this site is recommended at this time. A historic mill site was recorded straddling the north fork of Reed Creek in the west central part of the development tract and it is RSWA's opinion that this archeological resource is eligible for the National Register of Historic Places under Criterion D (archeology) ("Flagged Limits of Mill Site" on attached development plan). Based on RSWA's flagging of the Site 2 boundaries, Lennar Carolinas established limits of disturbance such that Site 2 will not be impacted by proposed project -related disturbances, and with the intention of long-term preservation of this site. Based on the attached development plan, it is RSWA's opinion that Site 2 will not be adversely impacted by project related activities. To reduce the likelihood of inadvertent damage to Site 2 during construction, it is recommended that brightly colored barrier fencing (e.g., "tree save") be established 10 feet outside RSWA's Site 2 boundaries. (2) the applicant has the option to request an AJD before accepting the terms and conditions of the permit authorization, and that basing a permit authorization on an AJD could possibly result in less compensatory mitigation being required or different special conditions; (3) the applicant has the right to request an individual permit rather than accepting the terms and conditions of the NWP or other general permit authorization; (4) the applicant can accept a permit authorization and thereby agree to comply with all the terms and conditions of that permit, including whatever mitigation requirements the Corps has determined to be necessary; (5) undertaking any activity in reliance upon the subject permit authorization without requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps permit authorization based on a PJD constitutes agreement that all aquatic resources in the review area affected in any way by that activity will be treated as jurisdictional, and waives any challenge to such jurisdiction in any administrative or judicial compliance or enforcement action, or in any administrative appeal or in any Federal court; and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered individual permit (and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is practicable.
