Eric permitted 149’ of bank stabilization and 100’ of temporary fill for the causeway since they overlapped. His

Amy: I probably should have called you about the impact numbers before I did the verification, but I thought I could give
you what you asked for the way I did it. The impact numbers aren’t as important as the drawings, since the drawings
override, unless the impact numbers are close to thresholds.
The way I looked at this is that although the permanent and temporary impacts overlap as far as linearly along the
stream banks, the temporary have a greater footprint of impact since they cover the stream bottom past the permanent
riprap. The impact numbers I put in the verification cover all the footprint the temporary impact has, including the part
that overlaps the permanent riprap.
I know that this is different than the way we handle temporary impact from dewatering, but this make sense to me for
construction access impacts.
The bottom line for me is that I am satisfied that the verification I issued covers the impacts you requested. If you want
me to change it so it is more clear, give me a call and we’ll talk about the best way to do that.

Hi Eric. Our impact numbers don’t match up. You permitted 149’ of permanent impacts and 100’ of temporary
impacts. We requested 149’ of permanent and 10’ of temporary that was outside of the limits of the permanent.

Amy: Attached to this message is your requested Section 404 permit authorization for the following project:
DA# SAW-2020-01998 (NCDOT / Bridge No 8 Replacement on NC 704 over Dan River / Stokes County / Div 9).
NOTE: The US Fish and Wildlife (USFWS) Biological Opinion (BO) for the Dan spinymussel, dated 11/1/2019, requires
NCDOT to remove James spinymussels from the
impact site and relocate them to suitable locations upstream of the impacted areas, prior to construction. The BO also
has other terms and conditions, including that a USFWS biologist will be present at the preconstruction meeting to
explain permit conditions and discuss any questions the contractor has regarding implementation of
this project.
Also attached are the corresponding regional and general conditions, and a copy of the permit compliance
certification. The Wilmington District is committed to providing the highest level of support to the public. To help us
ensure we continue to do so, please complete the Customer Satisfaction Survey located at

Please note that the general and special conditions must be strictly adhered to in order for this permit authorization to
remain valid and that the compliance certification must be returned to this office when the work is completed.

Your 11/12/2020 PCN included the boundaries of an aquatic resource delineation. We have reviewed the
information provided by you concerning the aquatic resources, and by copy of this e-mail, are confirming that the
aquatic resources delineation has been verified by the Corps to be sufficiently accurate and reliable for permitting
actions and the determination of compensatory mitigation requirements. The boundaries of these aquatic resources are
shown in the “WETLAND AND SURFACE WATER IMPACTS PERMIT DRAWINGS”, SHEETS 1-6, submitted on 11/12/2020.
At this time we are only verifying the delineation. This delineation may be relied upon for use in the permit evaluation
process, including determining compensatory mitigation. This delineation verification is not an Approved Jurisdictional
Determination (AJD) and is not an appealable action under the Regulatory Program Administrative Appeal Process (33
CFR Part 331). However, you may request an AJD, which is an appealable action.
If you wish to receive a Preliminary Jurisdictional Determination (PJD), or an Approved Jurisdictional Determination
(AJD)please respond accordingly, otherwise nothing further is required and we will not provide any additional
documentation.
