Enclosed are five copies of our application package requesting a Water Quality Certification associated with an Individual Permit (IP) for repairs to an earthen dam within the newly renovated Mayo Mountain Access Area of Mayo River State Park (MARI) in Rockingham County, NC. This application package consists of the following documentation: one completed Application For Department Of The Army Permit form (ENG Form 4345), one IP Supplemental Document and supporting documentation, one MARI park map, three GIS-generated maps, one wetland impact map, and two full-sized sets of thirteen engineering drawings approved by the NC State Construction Office. This proposed project consists of the repair of an earthen fill dam to address ongoing structural integrity issues associated with the existing dam. Fill that will be placed in jurisdictional waters include the following structures composed of riprap: check dams, apron, spillway slope stabilization, and a plunge pool. Additionally a stone filter berm will be placed around a manhole riser, and two precast concrete manholes will form barrels within the primary spillway. The proposed full pond elevation is anticipated to be approximately 676.6 feet. The total area of substrate disturbance for this project is anticipated to be approximately 0.72 acres. DPR is concurrently submitting one copy of this permit application to the US Army Corps of Engineers to request a corresponding Individual Permit Verification per multiple consultations with Steven Kichefski/Andy Williams (USACE, Raleigh Regulatory Office) and with Sue Homewood (DWQ WSRO). Per our conversation on August 23, 2010, 1 have included funds transfer documentation indicating that payment of the $570 application fee has been transferred from the Division of Parks and Recreation (DPR) to the Division of Water Quality. SUPPLEMENT: APPLICATION FOR DEPARTMENT OF THE ARMY PERMIT (ENG FORM 4345, SEPT 2009) MAYO RIVER STATE PARK: DAM REPAIR Block 18: Nature of Activity This proposed project consists of the repair of an earthen fill dam and associated improvements to the upper pond area. Fill that will be placed in jurisdictional waters include the following structures composed of riprap: check dams, apron, spillway slope stabilization, and plunge pool. Additionally a stone filter berm will be placed around a manhole riser and two precast concrete manholes will form barrels within the primary spillway. Means and methods of compliance with the contract documents are the responsibility of the contractor who wins the bid. The proposed full pond elevation is anticipated to be approximately 676.6 feet. The total anticipated area of disturbance for this project is approximately 0.72 acres. Please see `Wetland Impact Map' and `Sheet C-103' drawings for more detailed information. Block 19: Project Purpose The purpose of this proposed project is to repair the earthen dam surrounding the lower pond area of the historic swim beach within the newly renovated Mayo Mountain Access area of Mayo River State Park (MARI). These repairs will be conducted to address structural integrity issues concerning the existing dam that have been ongoing for the past several years. The NC Division of Parks and Recreation (DPR) contracted with a reputable engineering firm in 2005 to conduct an Engineering Field Study to assess the structural integrity of the upper and lower ponds to address concerns that overtopping of upper pond may have been threatening the structural integrity of lower pond. The Engineering Report recommended that a "rehabilitation design should be prepared for the lower dam to be in compliance with State Dam Safety Regulations". Please see attached `Chronological Synopsis of Work' for more detailed information. Construction work is anticipated to begin - March 2011 and be completed by December 2011. Block 23: Description of Avoidance, Minimization, and Compensation Four Alternative options were considered for the proposed dam repairs: 1.) remove/breach both dams and restore existing stream, 2.) repair upper dam, remove lower dam and restore existing stream, 3.) remove upper dam and repair lower dam, and 4.) repair both dams (the Preferred Alternative). The Preferred Alternative was chosen primarily based on public and political momentum to restore the area to its historic condition as part of the architecturally-significant picnic shelter site. This alternative is not anticipated to pose significant direct, secondary, or cumulative impacts to water quality or associated natural or historic resources since the project areas has been impounded since the mid 1900's (see attached State Historic Preservation Office letter). Additionally, the anticipated areas of soil/substrate disturbance are situated within previously-disturbed land. Riprap structures such as check dams, apron, spillway slope stabilization, and a plunge pool will be installed for temporary and permanent sediment/erosion control and substrate stabilization purposes. A stone filter berm will be placed around a manhole riser and two precast concrete manholes at the outlet of the lower pond to reduce downstream sedimentation and provide stabilization to the outlet structure. This project is anticipated to impact approximately 1.17 acres of jurisdictional riparian wetlands due to inundation and fill within the lower pond area. DPR plans to submit payment into NCDENR's Wetlands Trust Fund through the Ecosystem Enhancement Program's In-Lieu Fee (EEP 1LF) Mitigation Program to offset impacts to 1.17 acres of riparian wetlands (see attached EEP ILF letter). DPR is proposing a ''/z:1 compensatory mitigation ratio for the following reasons: 1.) the jurisdictional wetland area has been impounded and disturbed by human development since the mid 1900's and was only recently drained (< 5 years ago), 2.) this wetland was given a `Low' functional rating per the North Carolina Wetland Assessment Method (NCWAM) conducted by DPR staff and verified by USACE staff, and 3.) there are no significant aquatic or other natural resources currently listed within the project area. Compensatory mitigation is not being required for impacts to the existing bypass channel and open waters. Supplemental compensatory mitigation to satisfy DWQ requirements is not anticipated for impacts to wetlands because project impacts are primarily associated with re-inundation of a formerly ponded area and will be well below their required mitigation threshold. 'T'he purpose of this proposed project is to repair the earthen dam surrounding the lower pond area of the historic swim beach within the newly renovated Mayo Mountain Access area. These repairs will be conducted to address structural integrity issues concerning the existing dam that have been ongoing 1'()r the past several years. Structures/fill that will be placed in jurisdictional waters include the following structures composed of riprap: check dams, apron, spillway slope stabilization, and plunge pool. Additionally a stone filter berm will be placed around a manhole riser and two precast concrete ' manholes will form barrels w=ithin the primary spillway. Means and methods of compliance with the contract documents are the responsibility of the contractor who wins the bid. The proposed full pond elevation is anticipated to be approximately 676.6 feet. The total anticipated area of disturbance of this project is approximately 0.72 acres. Please prepare a fund transfer form in the amount of $570 payable to the NC Division of Water Quality to cover the administrative fee for the processing of this WQC request. The WQC is required as part of an Individual Permit application that will be submitted to the US Army Corps of Engineers for this project.
