A brief summary of the comments contained in your correspondence on behalf of the Division of Water Quality, Transportation Permitting Unit are summarized below, along with the corresponding responses. Comment: For the purposes of the Table of Uses in the Jordan Buffer Rules, the bridge crossing is considered a crossing only within the area between the end bents, all other impacts to Horsepen Creek and the UT are considered parallel impacts. Please delineate parallel buffer impacts to Horsepen Creek and the UT to Horsepen Creek (Stream A) for roadway approaches separately on your permit drawings, and provide approval of associated mitigation for the parallel impacts. Response: The plan depicting the parallel buffer impacts to Horsepen Creek and Stream A resulting from roadway approaches is included as Attachment A - Figure 9 (revised). Parallel impacts resulting from roadway approaches totaling 2,553 sq. ft. in Zone 1 and 4,280 sq. ft. in Zone 2 will be mitigated by the purchase of 7,659 sq. ft. of Buffer I and 6,420 sq. ft. of Buffer 11 riparian buffer credits from the North Carolina Ecosystem Enhancement Program (NCEEP). Approval for the purchase of these riparian buffer credits, as well as the stream mitigation credits is included as Attachment B. Comment: Fill out the buffer impact table, separating out the impacts from the roadway approaches, bridge, walking trail (separate from sidewalk), and utility impacts. Response: A buffer impact table separating out the impacts from the roadway approaches, bridge, walking trail, and utility impacts is included as Attachment C - Buffer Impact Table. an employee-owned cornpam providing qualip'service since 1912 Ms. Amy Euliss September 23, 2010 Page 2 Comment: Show the walking trail on plans and associated buffer impacts that are beyond those impacts necessary for the bridge/road. Response: The walking trail buffer impacts have been separated from the bridge/roadway and utility impacts and are depicted on Attachment A - Figure 9 (revised). Comment: Explain why fill slopes cannot be further reduced to 1.5:1 to further avoid parallel buffer impacts. Response: According to Shannon Leonard in the Winston Salem office of NCDENR Land Quality Section, NCDENR will not approve roadway slopes steeper than 2:1 for the Ballinger Road Bridge Replacement Project. A revised roadway and bridge plan that utilizes a 2:1 slope has been prepared for the project and has reduced parallel impacts to the buffers, as well as direct impacts to Stream A. Impacts to Stream A have been reduced from 94 linear feet of permanent impact (763 sq. ft.) to 87 linear feet of impact (725 sq. ft.). The revised roadway and bridge plan is included as Attachment D - Figure 6 (revised). Comment: Provide a plan and profile for the relocated stream. Although this is not a natural channel design, the Division needs enough detail to ensure the proper dimensions will be constructed and that grade controls are included if necessary. Response: The plan and profile for the relocated stream is included as Attachment E - Figure 11). Comment: Show a proposal for shifting road to the other side, including an overlay of impacts to the mitigation site. Response: The City of Greensboro cannot shift the roadway to the other side due to the FedEx mitigation site located on the south side of Ballinger Road. Please see the attached PTAA Airport Development Plan that depicts the various PTAA mitigation sites as green cross-hatching, and the Ballinger Road Bridge Replacement Project site as a red dot surrounded by orange highlight (Attachment F - PTAA Airport Development Plan). Comment: Include NCDOT as the owner of the road, if they currently and will continue to own the road. Response: The City of Greensboro is the owner of the road, has been the owner of the road, and provides the maintenance for the bridge and roadway. The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will be approved by the permit issuing agencies as mitigation for project impacts. It a , is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. You,museal'so This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following table. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to, be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the N.C. Department of Environment and Natural Resources' Ecosystem Enhancement Program In-Lieu Fee Instrument dated July 28, 2010.
