The anonymous complaint alleged that poultry litter was stockpiled within a field in close proximity to surface water, and along the banks of an unnamed tributary (UT) to Roaring Fork adjacent to the field. During the onsite complaint investigation of the above referenced parcel, DWR staff observed poultry litter stockpiles along the banks of the UT to Roaring Fork. Therefore, it appears that the litter was applied without maintaining the setback of 25 feet that is required for perennial streams and waterbodies. Per 15A NCAC 02T .1303, dry litter poultry operations are deemed permitted. This means that while these operations are not required to apply for permits, they must follow general requirements as outlined in statutes and rules. A copy of these rules is included for your reference. The rules state that stockpiles of poultry litter must not be closer than 100 feet to perennial streams and perennial waterbodies and must not remain uncovered for more than 15 days. For land application of poultry litter, a setback of 25 feet from perennial streams and perennial waterbodies must be maintained. Runoff of litter due to improper storage and land application can lead to discharges which can result in violations or enforcement actions. Our office understands that you own the property in question, but the cropping of the field and therefore the poultry litter is managed by Mitchell Bottomley. Please ensure that the rules for dry litter poultry are adhered to on your property going forward such that no violations may occur in the future.
