Good morning John:
Rather than confuse you with a bunch of red-line edits, I am providing a clean version of the Franklin WQC
with Duke's suggested edits for your consideration. We ask you to please review the clean version and see
what you think. We can then provide you with redline edits if in fact you need them.
We took your revised draft, accepted all your revisions in Word and then made a few additional changes aimed
at making the document as clear as possible for compliance assurance. Here is a summary of the edits we made:
1) Removed the Certificate of Completion since this 401 provides for changes in operational procedures 4-
and not construction.
2) Tightened up the use of abbreviations and acronyms to be consistent with technical reports and articles
3) We have made changes to Condition 6 that we believe more accurately depict the content of Addendum
No. 3. Addendum No. 3 contains the requirement for the Sediment Removal Pilot Study. Addendum
No. 3 does not contain a "Short Term Sediment Management Plan."
4) We have made changes to Condition 7 to clarify the intent. The goal of Addendum No. 3 is to develop a
Long-Term Sediment Management Plan. In our opinion this is a more suitable point for the Town of
Franklin to be involved in the consultation rather than the highly technical aspect of sediment
monitoring.
5) Corrected a few typos.
John we greatly appreciate the opportunity to review these documents ahead of time. I would be glad to
discuss this with you any time today. Once we have had a chance to talk I will forward our comments on
the remainder of the WQC's.

Dear Mr. Dorney;
The following comments are submitted on behalf of the Town of Franklin, Macon
County, NC to the June 9, 2010 issued water quality certificate for relicensing of Project
No. 2603.
1. We request that the Town of Franklin be made part of all future proceedings
involving Lake Emory and/or the Franklin Project. including, but not limited to,
any meetings or conference calls, etc., between Duke Energy Carolinas and any
and all resource agencies such as the NC Wildlife Resources Commission, U. S.
Fish and Wildlife Service, NC Divisions of Water Quality, Land Resources, or
Water Resources. We further request that the Town of Franklin be placed on the
mailing list to receive copies of all correspondence between your Division, Duke
Energy Carolinas and the above named resource agencies.
2. The 401 certificate should be corrected and reissued to reflect the fact that we are
referring to the Franklin Hydroelectric Plant and not the Mission plant in
Cherokee/Clay Counties.
3. Page 4, # 8. The Town of Franklin requests that when the Shoreline Management
Plan and the Long and Short Term Sediment Management are developed, we
would like to have an active role in preparing this document. Of particular 4
concern is our desire to insure that all recreational facilities, such as boat ramps,
canoe portage, and bank and handicapped fishing access be included in the
Shoreline Management Plan. In addition, we will be requesting that this Sediment
Management Plan for Lake Emory include dredging of the entire lake, not just
that part in front of the trash racks. Along with the full lake dredging, a
monitoring program should be established for incoming sediment and a target
trapment rate be mandated for the lake. This will insure that the Little Tennessee
River downstream of Lake Emory will be protected. Of course, along with the
dredging of Lake Emory, we will be requesting that Duke Energy Carolinas
institute an aquatic habitat improvement program for Lake Emory.
