Sullins Director Dee Freeman Secretary July 28, 2010 Mr. Glen Hockney 109 White Plans Road Middletown-Engelhard, NC 27824-9381 DWQ Project # 10-0614 Hyde County Subject: Review for 401 Water Quality Certification and Authorization Certificate per the Tar-Pamlico River Buffer Protection Rules (15A NCAC 2B.0259) Middletown Creek, Tar-Pamlico River Basin Dear Mr. Hockney: On July 23, 2010 this Office received a request from you to conduct an on-site visit to review a canal area for in-water placement of a methane gas collection system. The site visit was conducted by Roberto Scheller and Anthony Scarbraugh of this Office on July 27, 2010. After review of your proposed methane gas collection system and installation site (see attached maps) it was determined that a Water Quality General Certification is not required for your proposed project if constructed as presented at the time of site visit. However, you should contact the Army Corp of Engineers (COE) to see if a Nationwide Permit is required for placement of structures in an artificial canal. This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0259. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, and Non-discharge regulations. You are authorized to clear an 8 foot wide work access corridor through the riparian buffer to provide water access. Please note that no additional buffer clearing is approved at this time and additional clearing would constitute a violation of the Tar-Pamlico River Basin Riparian Rules. If at anytime during construction of your project you determine that you cannot meet these conditions or if there are any additional impacts to wetlands, riparian buffers, or water quality, you must contact this office immediately.
