Dear Ms. Rooks:
On December 5, 2003 the Division of Water Quality (DWQ) was notified by receipt of your application
regarding your plan to fill wetlands or waters for the purpose of providing road connectivity in
Wake/Durham County. Approval from DWQ is required to disturb these areas. Please provide 7 copies
of the following information and refer to the DWQ # listed above in your reply. Please show these on
maps of suitable scale (for instance 1" = 100 feet) so we can begin to determine your projects'
compliance with 15A NCAC 211.0500.
Additional Information Requested:
You stated within your application that; "S&EC prepared a Nationwide Permit dated January
17, 2001 that included this stream crossing and other impacts for the Louis Stephens Road
project. The permit indicated the use of a bottomless culvert at this stream crossing and was
approved by your (US Army Corps of Engineers') Office." Was a 401 Water Quality
Certification issued for this project? If so, then please provide a copy of the authorization
letter or DWQ project number.
2. Your plans propose that use of "dual 72 inch RCP's". The impacted stream is identified on
your plans as a "4 foot channel". The DWQ believes that using dual 72" RCPs would widen
the stream from 4 feet at the proposed crossing to 12 feet. The DWQ believes this will
potentially destabilize the stream resulting in cumulative impacts to the stream. Please
redesign the crossing in a manner that will not widen the stream at the crossing or provide
evidence that the proposed plan will not destabilize the stream. You may choose to use a
single 72-inch RCP in alignment with the stream and multiple "flood plain" culverts (such as
dual 36" RCPs) at an invert elevation above the bankfull elevation of the stream.
3. Our rules require an evaluation of cumulative impacts for projects in relation to downstream
water;quality standards. Please examine the latest draft of DWQ's policy on our website and

provide a qualitative analysis which addresses cumulative impacts from growth associated
with this project.
