Dear Mr. Miller;
On February 13, 2007, the Division of Water Quality (DWQ} received your application dated February
12, 2007, to fill or otherwise impact 0.0067 acres of open waters below the normal pool lake level, 0.0033
acres of open waters above the normal pool lake level, and shade 0.0004 of open waters above the normal
pool lake level, and impact 168 square feet of Zone 1 of the Tar-Pamlico River basin protected riparian
buffer to construct a 147-foot bulkhead and 10'x16' dock and 12'x24' boathouse at the subject property.
On March 14, 2007, the DWQ received additional information from you, however, the DWQ has
determined that your application remains incomplete and/or provided inaccurate information as discussed
below. The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the
additional information requested below, we will have to move toward denial of your application as
required by 15A NCAC 2H .0506 and will place this project on (told as incomplete until we receive this
additional information. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. Your proposed seawall does not appear to be necessary due to the stabilizing presence of buffer
vegetation. Please provide justification for the.neccs5ity of a seawall along the entire lakefront
property line.
Please contact the DWQ within three weeks of tl,e date of this letter to verify that you have received this
letter and to provide us with a date that we may expect to receive this requested information. if we do not
receive this requested information within one week of the date you indicate it will be forthcoming, your
project will be withdrawn and you will need to reapply with a new application and a new fee. Please
contact me in writing and Lauren Cobb of the DWQ Raleigh Regional Office. If we do not hear from you
within three weeks, we will assume that you no longer want to pursue this project and we will consider
the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please he aware that any impacts requested within your application are not

On Apri14`h, 2007 we contact Ian McMillian as specified in your letter concerning the
application for Mark 1C~Iiller, DWQ project #07-0258, in regard to the seawall to the
property line. This application was received by DWQ on February 13, 2007. In the time
since permit was applied for, we have worked with Amy Chapman on another seawall
issue and how the construction of the boathouse and/or boat slip requires a seawall.
We discussed with Ms. Chapman that to properly construct the boathouse and/or boat slip
a 5'ft seawall on each side of the slip seawall is integral to the construction and necessary
for the retention of existing soils. Basically, as with the previously mentioned permit,
this is what necessary for this permit as well. A five foot section of seawall on either side
of the boathouse is needed to ensure the retention of existing soils.
