PROJECT SUMMARY: This project is being proposed as a major modification to Major Permit 214-06. The applicant proposes outfall pipe improvements, excavation, grading and development of the existing high ground with all associated infrastructure such as an access road, parking and the relocation of an existing berm. They are also proposing to construct a six lane boat ramp area with two sheet pile breakwaters, for public use to the previously authorized development. 9. Narrative Descri tp ion The Town of Morehead City Newport River boat ramp project is located on the Morehead/Beaufort causeway at 301Highway 70 within the Newport River and north of the existing high rise bridge. The tract is bordered by a spoil island owned and used by the NC Ports Authority to the east and the DOT Hwy 70 Bridge right-of-way to the south. The Town of Morehead City property is 181,748 square feet in its entirety and is an average of 10' above NHW. Presently there is an existing public fishing pier, bulkhead, riprap, boardwalk, public restroom and parking lot on this tract. Approximately 816 ft' of coastal marsh and 1,649 ftz of USACOE designated wetlands are located within the immediate vicinity of the boatramp project area that would be affected. The coastal wetlands consist predominately of S ap rtina patens. The undeveloped portion of the high ground is comprised of cedars and scrub bushes and a few areas of jurisdictional wetlands. The developed portion of the high ground contains a public rest room facility, parking lot, boardwalk and paved access road. The Morehead City Land Use Plan classifies this property as Port Mixed Use, with all parts of the AEC classified Conservation. This section of the Newport River is not designated as Primary Nursery Area and is closed to the taking of shellfish. The Newport River is approximately 2,300' wide at the location and carries a water classification of SC. Riparian corridors were established during the original permitted proposal. All development of the current proposal meets the required setbacks. Substrate in the Newport River is mostly sand and silt. No SAV's or shellfish beds were observed within the proposal project area. 10. Proiect Description: The existing major permit # 214-06, which was issued on December 20, 2006, authorized the public fishing pier replacement and expansion and shoreline stabilization with riprap. A modification was issued on May 4, 2009 to add a 16' x 100' extension to the existing pier as well as a 15' x 30' "T"-shaped platform. The current proposal is for the development of the high ground portion, improvements on the outfall pipe, excavation and the construction of a six-lane boat ramp with two breakwaters for public use. The proposed ramp would be 128' wide and 68' long with six travel lanes separated by five floating docks. Each travel lane would be 17' wide and 68' in length. There would be a 34' x 145' concrete apron at the top of the ramp area. The apron would be located at the nhw contour on the north side and 47'above nhw on the south side of the ramp. The northern most travel lane for the concrete ramp would extend 60' below nhw with the southern most travel lane for the concrete ramp extending 35' below nhw and 33' above Field Investigation Report: Town of Morehead City Page 03 nhw. There are no wetlands on the northern most section of the ramp area however; construction of the southern most section would require the removal of a total of 816ft2 of coastal wetlands and 1,649 ft2 of USACOE designated wetlands. There would be five floating piers within the ramp area which would help designate the six travel lanes for launching. The southern most pier would consist of two sections of floating dock accessed by two gangways. The first section would be located 27' waterward of the concrete apron and retain the dimensions of 8' x 12'. The second section, which would be 67' waterward of the concrete apron, would be 8' x 25' in size. The three inner floating piers would each be 8' x 91' and would extend a maximum of 62' to 82' below nhw depending on location. There would be two breakwaters located along the northern most floating dock as well as the southern most floating dock. Both of the breakwaters would be 129' long and would extend a maximum distance of 105' below nhw. To facilitate use of the boatramp area the applicants are proposing to excavate a section of shallow bottom with a hydraulic pipeline. A total of 2,760 cubic yards of material would be removed below nhw. The excavation dimensions are 153' x 175'. The average existing depth is -2.4'nlw with a proposed final depth of -4' nlw. The connecting water depths within this area range from -5'nlw to -6'nlw. A portion of the ramp area would be dredged as well. The dimension for this area are 68' x 130'. The average depth in this area is -0'nlw and would have a final depth of -4'nlw. There is an 816 ft' expanse of coastal wetlands as well as a 1,649 ft2 section of USACOE designated wetlands within this area that would be excavated. The high ground development consists of the relocation of an existing berm, replacement of an existing effluent pipe, construction of a temporary access road through the NC State Ports Authority property and the construction of a 58 space car/trailer parking lot. The impervious surface for the entire tract is 50.8% and 7.25% within the Coastal Shoreline AEC. The proposed upland development would require a total of 365,468 ft2 of high ground to be graded and filled. The 58-space car/trailer parking area would be located east and directly behind the proposed boat ramp area. The southern most spaces would be located a distance of 105' from nhw and the northern most spaces would be 90' from nhw. The new parking lot would connect to and be accessed through the northeast corner of the existing pier parking lot. There is an existing confined dredge disposal facility that would be utilized for spoil disposal. It is located on the adjacent NC State Ports Authority property. Currently the western most existing berm is on the Town of Morehead City lease site and would be relocated to accommodate for the new access road. The berm would be moved east from its current location to the NC State Port facility property. The berm would start from grade and rise with an outer 3:1 ratio, depending on location, to a flat ridge, then fall with an inner 3:1 ratio. The fill height would be a maximum of 15'. All sides of the berm would be designed in this manner. The berm would allow for a maximum water level of 14'. The Field Investigation Report: Town of Morehead City Page 04 existing ground surface is at + 5' with the berm height at +20' from existing grade. It would be located 265' above nhw. There is an existing 510' long effluent pipe leaving the spoil area and discharging into the closed portion of the Newport River. A 120' section of the existing effluent pipe as well as 22 wooden support cradles would be removed and replaced. The pipe would be 36 inch 12 gauge galvanized corrugated steel pipe. Due to an expanse of coastal wetlands at this location it would be placed landward of the coastal wetlands and a minimum of 4' above existing grade. 11. Anticipated Impacts: The upland portion of this project would require the grading and filling of 365,468 ft2 with a finished impervious percentage of 7.25% within the AEC and 50.8% for the entire tract. The proposed docks would shade 3,288ft2 and incorporate 17,250 ft2 of open water. The excavation for the boatramp would disturb 34,660 ft2 of shallow bottom habitat, 816 ft' of coastal wetlands, 1,649 ft' of USACOE designated wetlands and remove 2,760 cubic yards of sandy/silty material from the system. The excavation and setting of pilings has the potential to cause a temporary increase in turbidity during construction and excavation activities. The width of the floating piers would be greater than six feet, however it would improve public safety and access to the estuarine system. The boatramp would add needed public boating access to the Town of Morehead City Area. There should be no undue interference to navigation along this section of shoreline. The proposal would also remove an existing dilapidated asbestos sea wall material from the estuarine system. SUBJECT: COMMENTS & RECOMMENDATIONS - CAMA MAJOR PERMIT- TOWN OF MOREHEAD CITY NEWPORT RIVER BOAT RAMP HWY 70, MOREHEAD-CITY DATE: 7/26/10 The following are my comments and recommendations regarding the aforementioned proposal. The proposal is for the construction of a six travel lane boatramp for public use, excavation, breakwaters, berm relocation, effluent pipe repair as well as all associated upland development (parking lot,access rd etc). The proposal would place a total of five docks within the boatramp area to help with access for the six travel lanes. The docks would extend a maximum of 82' below nhw in a 2,300' water body. There would be two 128.75' breakwaters constructed as well which would extend a maximum distance of 105' below nhw. A total of 2,760 cubic yards of material would be removed below nhw to a final depth of -4' nlw from an average depth of -2.4 n1w. The boat ramp excavation would remove a total of 816 square feet of coastal wetlands and 1,649 square feet of USACOE designated wetlands however per 15A NCAC 07H.0208 (b) (1) (A) could be allowed through fringes or regularly and irregularly flooded coastal wetlands if the loss of wetlands would not cause a significant adverse impact and if there is no reasonable alternative that would avoid the wetland losses. The high ground work would grade and fill a total of 365,468 square feet. The total area to be covered by impervious within the AEC would be 7.25% and 50.8% outside the AEC. The width of the docks would be greater than six feet, however per 7H.0208 (6) (A) could be permitted if the greater width is necessary for safety or to improve public use access. Therefore I recommend the project be authorized as proposed on plats dated received June 28, 2010, contingent upon the following specific conditions and all applicable standard conditions: 1. Remnants of the old asbestos bulkhead shall be disposed of in accordance with all state and federal regulations. 10. The temporary placement or double handling of excavated fill materials within waters or vegetated wetlands is not authorized. 11. All disturbed areas will be properly graded and provided ground cover sufficient to restrain erosion within thirty (30) working days of project completion. June 18, 2010 Date Contract 49-Newport River Boat Ramp Project Name Town of Morehead City Applicant Nam Applicant Signature NARRATIVE DESCRIPTION CONTRACT 49 - NEWPORT RIVER BOAT RAMP TOWN OF MOREHEAD CITY JUNE, 2010 The Town of Morehead City proposes to construct a boat ramp with 6 travel lanes and associated parking on Radio Island to increase public boat access opportunities for the public to the Newport River and surrounding waters. Planning for the project has been ongoing for the past two years. An Environmental Assessment (EA) was prepared by Dial Cordy and Associates in August, 2009 in accordance with the State Environmental Policy Act (SEPA) and submitted to Valerie W. McMillan, Director, State Environmental Review Clearinghouse, Department of Administration with a request the EA be reviewed and the Notice of No Significant Impact be accepted by the Department of Administration. The Department of Administration notified Morehead City by letter dated September 30, 2009, that the document had been reviewed and that "...no further State Clearinghouse review action on your part is needed for compliance with the North Carolina Environmental Policy Act...". Plans and specifications for the construction of the proposed improvements have since been completed. The Town is currently seeking the various permits required for project construction and plans to receive bids in the near future. The proposed construction site is located on State property leased by the Town of Morehead City (MHC) on Radio Island immediately north of US Highway 70 after crossing the MHC-Beaufort high rise bridge over the Newport River when travelling from MHC to Beaufort. The southern end of the site has a fishing pier and adjoining parking lot. The portion of the property north of the pier and pier parking area is presently occupied by the western portion of a Confined Dredge Facility (CDF) operated by the NC State Ports Authority (NCSPA) that is located on the town's property and the NCSPA adjoining property. Construction of the boat ramp and parking area will require relocation of the existing CDF western dike to the east to the NCSPA property to accommodate construction of the boat ramp and associated parking on the MHC property. The existing CDF outlet structure is within MHC's parcel and proposed construction footprint, therefore the outlet structure and piping will also be replaced. The first task of construction will involve the establishment of a temporary access road through the NCSPA property and existing CDF to the MHC property. This temporary road will allow construction to proceed with minimal disruption to the public's ongoing use of the public pier and parking area. Only the final paving and ramp construction will require access through the existing pier parking lot. On-site materials may be used to construct the new western dike on the NCSPA property; however, it is anticipated some off-site clay fill material will be required to construct the dike core and some off-site topsoil will be required to provide a final cover suitable for final landscaping. DOC After the outfall pipe improvements have been constructed and CDF dike has been re-located, a new temporary CDF (within the NCSPA CDF footprint) will be constructed on the NCSPA property to accommodate the dredging required to construct the boat ramp and access to the Newport River. The new outfall pipe will be used to accommodate any effluent discharge from the temporary CDF to the Newport River. The contractor will bear the responsibility to comply with Division of Water Quality requirements regarding discharge quality. Dredging activities will be restricted to the October through March time frame unless otherwise authorized by the regulatory agencies. Boat ramp construction will be completed following completion of dredging activities. The final construction task will be paving the parking area. Permits required in order to complete the project include LAMA, Stormwater, and Erosion Control. Approximately 8.5 acres will be disturbed during construction. The development will include a stormwater control system designed in accordance with 15A NCAC 02H .1008 to control and treat the runoff from all surfaces generated by 1.5 inches of rainfall, or the difference in the stormwater runoff from all surfaces from the predevelopment and post development conditions for a one-year, 24-hr storm, whichever is greater. The proposed stormwater system will be an engineered, on-site, below grade, non-discharge infiltration system. Approximately 816 square feet of coastal wetlands and 1,649 square feet of freshwater wetlands will be excavated in order to construct the boat ramp. Based on the drawings that were received on June 17, 2010, the NCSPA approves the project scope of work which includes the use and modification to the Confined Disposal Facility (CDF) owned by the NCSPA on Radio Island north of Highway 70. This use includes the disposal of approximately 3,000 cubic yards of dredged material in the CDF from the proposed boat ramp area. Due to CDF layout modification, the NCSPA is required to obtain a Mining Permit Modification from the Division of Land Quality. My staff has begun this process, but final approval for construction of the Newport River Boat Ramp project shall not given until the Mining Permit Modification is approved. Any cost associated with this permit modification shall be paid for by the Town of Morehead City. It should be noted that any approval conveyed by the NCSPA is for the modifications on the property owned by the NCSPA. The proposed location of the new boat ramp and parking area is currently owned by the North Carolina Department of Administration and additional approvals / updated lease agreements may be required from that agency for this project.
