Dear Mr. Grimaldi:
This is to inform you that the Division of Water Resources did not receive the monitoring report for
August 2016. This is in violation of Part II, condition D.(2.)of the NPDES permit, as well as 15A NCAC
2B .506(a),which requires the submittal of Discharge Monitoring Reports no later than the last calendar
day following the reporting period. Failure to submit reports as required will subject the violator to the
assessment of a civil penalty of up to $25,000 per violation.
To prevent further action,please submit the reports within fifteen(15)days of receipt of this notice. If
this facility is inactive or not constructed, you may submit a written request to suspend monitoring. The
request should include a begin date and an end date for the period of monitoring.
Additionally, this letter provides notice that this office will recommend the assessment of civil penalties if
future reports are not received within the required time frame during the next twelve(12)reporting
months. The Division must take these steps because timely submittal of discharge monitoring reports is
essential to the efficient operation of our water quality programs. We appreciate your assistance in this

Dear NPDES Permittee:
The U.S. Environmental Protection Agency(EPA) recently published the National Pollutant Discharge
Elimination System (NPDES) Electronic Reporting Rule.The rule requires NPDES regulated facilities to
report information electronically, instead of filing written paper reports.The rule does not change what
information is required from facilities. It only changes the method by which information is provided (i.e.,
electronic rather than paper-based).
EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their
key milestones, are:
• Phase 1—Starting on December 21,2016, regulated entities that are required to submit Discharge
Monitoring Reports (DMRs) will begin submitting these reports electronically, instead of on
paper. If you are currently reporting your DMR data electronically using eDMR,then you simply
need to continue reporting in the same way as you are now. The key change is that, starting on
December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary.
• Phase 2—Starting on December 21,2020,regulated entities that are required to submit certain
other NPDES reports will begin submitting these reports electronically, instead of on paper.-
Reports covered in the second phase include Notices of Intent to discharge in compliance with an
NPDES general permit,Sewer Overflow/Bypass Event Reports, and a number of other NPDES
program reports.

Sixty Days' Notice of Minor Modification of the Subject NPDES Permit
The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic
reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule,the
electronic reporting process supersedes the paper reporting process outlined in your existing permit. To
bring your permit up-to-date with the new reporting requirements,this letter serves to notify you that in
sixty days your NPDES permit will be modified to incorporate the new electronic reporting requirements.
The modification will require electronic reporting in place of paper-based reporting. Electronic reporting
will be required beginning as indicated above for Phases 1 and 2 reporting. Please attach the enclosed
NPDES Permit Standard Conditions Part III—Addendum to your permit. This permit modification becomes
effective on July 1,2016.
All other terms and conditions in the original permit remain unchanged and in full effect. This
modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency
dated October 15, 2007.
If any parts contained in this modification are unacceptable to you,then you have the right to file a
petition for a contested case with the Office of Administrative Hearings within thirty(30) days following
receipt of this letter. This petition must conform to the requirements of Chapter 150E of the North
Carolina General Statutes. Petitions must be timely filed with the Office of Administrative Hearings, Post
Office Drawer 11666, Raleigh, North Carolina 27604. If you do not file a petition within the required time,
the agency decision shall be final and binding. If you have questions concerning this permit modification,

On January 21,2016,the Division issued a Notice of Violation(NOV)against Daniel Jonathan Stowe
Conservancy—Daniel Stowe Botanical Garden WTP. The NOV was based upon a violation of the
reporting requirement by failing to file the November 2015 Discharge Monitoring Report with the
Division of Water Resources within the thirty(30)day reporting period. Subsequent to your receipt of
the NOV, Christine Cordy contacted the Division indicating that the November 2015 DMR was submitted
on December 24,2015 by e-mail to DWR staff. The e-mailed copy was received by our staff on
December 28,2015. As a result, I have withdrawn the NOV against Daniel Jonathan Stowe Conservancy
—Daniel Stowe Botanical Garden WTP for the cited violation and directed that the record of this violation
be removed from our files. However, original signed(wet signature)copies should be sent to the address
indicated on the DMR forms. Electronic submission is available only by eDMR and will be a permit
requirement when your permit is renewed.

Please accept the Garden's application to renew NPDES Permit No.NC0088684 via Short Form C—
WTP, attached hereto along with the necessary supporting documentation.
The reverse osmosis system at the Garden's Orchid Conservatory functions to purify the water supply for
hand irrigation and a high pressure fog system that maintains proper humidity in the greenhouse. Well
water supplies the purification system and wastewater is delivered to a nearby unnamed tributary of
Catawba Creek via underground storm drainage.
The Garden requests that two additional factors be considered in the permit review process including the
recent establishment of a significantly reduced flowrate as well as the Garden's proposal to reduce
monitoring frequencies while viable engineering alternatives are explored.
A new flowmeter was installed, calibrated and commissioned on May 16, 2014 with the approval of
NCDENR. The new flowmeter is installed directly off the RO system, whereas the original flowmeter
was installed further downstream in the storm drain at a point after other storm water is introduced into
the system. The average daily flow over the past eight months is 0.00029 MGD,whereas the existing
permit acknowledges 0.003552 MGD. The original flowmeter and historical flow data associated with the
permit in question capture an inflated flow volume that included water sources other than the RO reject
water. The reduced actual flow has motivated the Garden to explore engineering alternatives, most
especially the merits of a non-discharge permit to deliver wastewater to the ground surface via irrigation.
Engineering alternatives are desirable because the monitoring requirements established by the existing
NPDES permit present a financial burden to the Garden,which hereby proposes that measurement
frequencies across almost all parameters be considered for reduction. The Garden is bound to
environmental stewardship by its very mission and remains committed to maintaining its NPDES permit
in good standing, but wishes to identify cost-saving opportunities while engineering alternatives are
explored. The historical data has remained mostly static and wastewater characteristics present a
reasonably low potential to fluctuate and exceed environmental limitations. Reduced measurement
frequencies will make permit compliance more manageable for the Garden without undermining the
assurance that no environmental threat is created by the operation of the RO system.
Please consider the aforementioned scenarios along with our permit application and notify the Garden if
any additional information is required.

-Only one pH concentration was reported for July and August of 2014 whereas the permit requires
twice per month monitoring. Please submit an amended DMR for both months with the missing values
(July 30th and August 26th.
-The March 2014 DMR does not note the failure of the whole effluent toxicity testing performed on
March 18, 2014. Please submit an amended DMR with the missing toxicity testing.
-The copper and zinc concentrations on the July 2014 DMR were reported with the wrong units of
measure; please revise this data and submit an amended July 2014 DMR.
You are currently reporting flow using an incorrect EPA parameter code. Please revise your DMR
template for all future submissions;flow should be reported under EPA parameter code 50050 not
00059.
You have been reporting turbidity using units of measure of"mg/L"whereas the correct units of
measure are NTU; please revise your DMR template to reflect the correct units of measure.
The contracted analytical laboratory is noting a flow totalizer reading twice during each monitoring
month but only reporting one flow value as required by the permit. The NPDES Permit Standard
Conditions that apply to all NPDES permits(Part II of your permit that appears after Section A(3)) notes
the following in Section E. regarding Reporting Requirements. Specifically, Item 5 on monitoring
reports notes, "If the permittee monitors any pollutant more frequently than required by this permit using
test procedures approved under 40 CFR Part 136 and at a sampling location specified in this permit or
other appropriate instrument governing the discharge(e.g. a flow meter),the results of such monitoring
shall be included in the calculation and reporting of the data submitted on the DMR." Please ensure that
flow is reported for each day a totalizer reading is taken on future monthly DMRs.

This is to inform you that the Division of Water Resources did not receive your monthly monitoring report
for December 2013. In addition,the January 2014 monitoring report was received late on March 28,2014.
This is in violation of Part II, condition D(2)of the NPDES permit,as well as 15A NCAC 2B .506(a),which
requires the submittal of Discharge Monitoring Reports no later than the last calendar day following the
reporting period. Failure to submit reports as required will subject the violator to the assessment of a civil
penalty of up to$25,000 per violation. You will be considered noncompliant with the self-monitoring
requirements of your NPDES permit until the report has been submitted.
To prevent further action,please submit said report within fifteen(15)days of receipt of this notice.
Additionally,this letter provides notice that this office will recommend the assessment of civil penalties if
future reports are not received within the required time frame during the next twelve(12)reporting months.

permit (May 2012) added monthly turbidity monitoring with an effective date of June 1, 2012. A
review of the September 2012 DMR and the associated laboratory data notes that the WTP effluent
was sampled for turbidity on September 11, 2012 but not reported on the DMR.
For future DMR reporting please add a column to the DMR that reports turbidity in NTU units using
EPA parameter code 00070. Your reporting code must match the code in our compliance database
for the data entry staff to log your monitoring results and credit you with the required monitoring.

Chapter 143,Article 21 of the North Carolina General Statutes (G.S.) authorizes and
directs the Environmental Management Commission of the Department of Environment
&Natural Resources to protect and preserve the water resources of the State. The
Division of Water Quality (DWQ) has the delegated authority to enforce adopted
pollution control rules and regulations.
Enclosed please find a copy of the Compliance Evaluation Inspection Report for the
inspection conducted at the subject facility on May 31, 2011 by Ms. Donna Hood of this
Office. The facility continues to have documentation and operational problems. Because of
the small amount of flow from the facility and the costly expense of maintaining an NPDES
discharge permit, it is highly recommended that the facility investigate alternatives to
discharging the filter backwash from the reverse osmosis system. Please contact Mr.
Michael Parker, of this Office,to help explore possible alternatives.
This report is being issued as a Notice of Violation (NOV) because of the violations of
the subject NPDES permit and North Carolina General Statute (G.S.) 143-215.1 as detailed

• DMRs for April 2010-March 2011 were reviewed for the inspection. The facility had the following
deficiencies:
1. The original form for toxicity is not mailed to the environmental sciences branch.
2. Failure to monitor Total Dissolved Solids, in June 2010
3. Exceedances of monthly average flow limit in February, March and April 2010.
4. Failure to report arsenic, copper, iron, zinc, and total nitrogen on the September 2010 DMR
5. Failure to report toxicity results on several DMRs in the review period.
6. Reporting toxicity on DMRs during months that it was not performed.
7. Reporting 'ND' on the DMR instead of the reporting limit of the analytical test
8. Reporting 'less than' numbers for monthly averages.
All twelve DMRs should be amended and resubmitted.
It was noted during the inspection that the facility may not be sampling backwash water, but instead
sampling overflow/purge water. The facility should contact the manufacturer for correct procedures to
ensure the actual waste stream that should be sampled is what is being sampled.
It was also noted during the inspection that other wastewaters, like boiler blowdown, also discharge to the
same outfall. All piping, including but not limited to floor drain, sump pump and boiler blowdown discharge,
in the lower level should be investigated with definitive results known, documented and retained by the
facility.

This is to inform you that the Environmental Sciences Section has not received your quarterly toxicity
self-monitoring report form for the month of March 2011. This is in violation of Title 15A of the North
Carolina Administrative Code,Chapter 2, Subchapter 2B, Section .0506 (a)(1)(A)which states that
"monthly monitoring reports shall be filed no later than 30 days after the end of the reporting period for
which the report was made."
Please remember that reporting of toxicity self-monitoring data is a dual requirement. Toxicity test results must
be entered on your Discharge Monitoring Report and the Toxicity Reporting Form (AT Report Form). The AT
report form must be submitted to: DWQ/ESS, 1621 Mail Service Center, Raleigh NC 27699-1621 within the
required time frame.
Your NPDES permit requires you to submit an Aquatic Toxicity Self-Monitoring Form to this office during a
month in which toxicity testing is required,regardless of whether a discharge occurs from the facility. Please
ensure that AT test forms labeled"No Flow"are sent to this office during months when no discharge occurs and
the facility is required to perform toxicity testing.

WHOLE EFFLUENT TOXICITY MONITORING AND REPORTING INFORMATION
➢ The following items are provided in an effort to assist you with identifying critical and sometimes overlooked toxicity testing and reporting
information. Please take time to review this information.The items below do not address or include all the toxicity testing and reporting
requirements contained in your NPDES permit. If you should have any questions about your toxicity testing requirement,please contact Mr.
John Giorgino with the Aquatic Toxicology Unit at(919)743-8401 or another Unit representative at the same number.
➢ The permittee is responsible for ensuring that toxicity testing is conducted according to the permit requirement and that toxicity report forms are
appropriately filed.
➢ The reporting of whole effluent toxicity testing data is a dual requirement. All toxicity test results must be entered(with the appropriate
parameter code)on your monthly Discharge Monitoring Report which is submitted to:

➢ Toxicity test results shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period
(eg,January test result is due by the end of February).
➢ Toxicity test condition language contained in your NPDES permit may require use of multiple concentration toxicity testing upon failure of any
single quarterly toxicity test. If the initial pass/fail test fails or if the chronic value is lower than the permit limit,then at least two multiple
concentration toxicity tests(one per month)will be conducted over the following two months. As many analyses as can be completed will be ,
accepted. If your NPDES permit does not require use of multiple concentration toxicity testing upon failure of any single quarterly test,you
may choose to conduct either single concentration toxicity testing or multiple concentration toxicity testing per the Division's WET enforcement
initiatives effective July 1, 1999. Follow-up multiple concentration toxicity testing will influence the Division's enforcement response.
➢ Toxicity testing months are specified by the NPDES Permit,except for NPDES Permits which contain episodic toxicity monitoring
requirements(eg,if the testing months specified in your NPDES permit are March,June,September,and December,then toxicity testing must
be conducted during these months).
➢ If your NPDES Permit specifies episodic monitoring and your facility does not have a discharge from January 1-June 30,then you must provide
written notification to the Environmental Sciences Section by June 30 that a discharge did not occur during the first six months of the calendar
year.
➢ If you receive notification from your contract laboratory that a test was invalidated,you should immediately notify the Environmental Sciences
Section at(919)743-8401 and provide written documentation indicating why the test was invalidated and the date when follow-up testing will
occur.
➢ If your facility is required to conduct toxicity testing during a month in which no discharge occurs,you should complete the information block
located at the top of the AT form indicating the facility name,permit number,pipe number,county and the month/year of the subject report.
You should also write"No Flow"on the AT form,sign the form and submit following normal procedures.
➢ The Aquatic Toxicity Test forms shall be signed by the facility's Operator in Responsible Charge(ORC)except for facilities which have not
received a facility classification. In these cases,a duly authorized facility representative must sign the AT form. The AT form must also be
signed by the performing lab supervisor.
➢ To determine if your AT test forms were received on time by the Division of Water Quality,you may consider submitting your toxicity test
results certified mail,return receipt requested to the Environmental Sciences Section.

Thank you for your e-mail received in our office on March 19, 2009 in response to the subject notice of
violation (NOV). The information you provided showed the facility made a good faith effort to submit
the December 2008 discharge monitoring report (DMR) within the statutory time frame, but the DMR
became lost during its transport to our Central Files office. Based upon this information the NOV has
been retracted and its record has been removed from our data systems. Monitoring data provided along
with your e-mail has been entered into our compliance monitoring database.
Thank you for your prompt attention to this matter and the diligence you have shown in getting it
resolved. Your commitment to the NPDES program and the timely submittal of required data is
appreciated.

A.(2)CHRONIC TOXICITY PERMIT LIMIT(QUARTERLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, guarterly monitoring using test procedures outlined in
the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or
subsequent versions or"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"(Revised-
February 1998) or subsequent versions. The tests will be performed during the months of March, June,
September and December. Effluent sampling for this testing shall be performed at the NPDES permitted
final effluent discharge below all treatment processes.
If the test procedure,performed as the first test of any single quarter, results in a failure or ChV below
the permit limit, then multiple-concentration testing shall be performed at a minimum, in each of the two
following months, as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test
Procedure"(Revised-February 1998)or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the
highest concentration having no detectable impairment of reproduction or survival and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment," collection methods, exposure regimes, and further statistical methods are specified
in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised-February 1998)
or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on
the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the
parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally,DWQ Form
AT-3 (original)is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is
employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity(AT)test form
indicating the facility name, permit number, pipe number, county, and the month/year of the report with the
notation of"No Flow" in the comment area of the form. The report shall be submitted to the Environmental
Sciences Branch at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required,
monitoring will be required during the following month. Should any test data from this monitoring
requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to
the receiving stream,this permit may be re-opened and modified to include alternate monitoring requirements
or limits.
NOTE: Failure to achieve test conditions as specified in the cited document,such as minimum control
organism survival,minimum control organism reproduction,and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later than
the last day of the month following the month of the initial monitoring.

SUMMARY
Daniel Stowe Botanical Garden's Orchid Conservatory is installing a reverse osmosis (RO) water
purification system as part of the construction of an Orchid Conservatory at the facility. The RO system
will be used to purify water used to hand-water plants inside the conservatory,as well as supply water for
the high pressure misting system overhead, used to provide additional moisture to the air within the
conservatory. The facility is designed to provide 3,800 gallons of purified water per day. The backwash
wastewater is estimated to be 3800 gallons per day. Daniel Stowe Botanical Garden requests the
Division to issue NPDES permit to discharge the backwash wastewater to an unnamed tributary to
Catawba Creek.
The receiving stream(Catawba Creek)is classified C waters in the Catawba River Basin. This reach is listed on the
2006-303(d)list.It is impaired for biological integrity.
PERMITTING STRATEGY

The Division of Water Quality has reviewed your Engineering Alternative Analysis (EAA) for
the Orchid Conservatory at Daniel Botanical Garden. The Division concurs with the conclusions and
recommendations of the EAA. The EAA you submitted is sufficient to meet the Alternative Analysis
requirements for a new discharge.
The Division will now move forward to drafting of the new NPDES permit. The draft permit will
be published in a local newspaper in your area. The entire permitting process may take between 60 and
120 days. If the draft permit causes significant protest from local citizens, governmental organizations,
and/or environmental groups, a public hearing may be scheduled and issuance of the final permit may be
further delayed. In some cases the Division may modify or deny the request for a new permit based on
public hearing results.
