Send all suspicious email as an attachment to report.spam@nc.gov Good morning Bethany, I am emailing to address the questions (below) that you raised for the termination request for NCC190862 (Regency at Flowers). 1) The Grantee in the Deed uploaded with the NOT request lists KL Flowers Plantation LLC. This entity does not match the permittee listed on that later permit, True Homes LLC. Was there a subsequent sale that explains the discrepancy? Or perhaps True Homes LLC is only responsible for construction activities on that property? True Homes has not bought the property (and thus KL Flowers Plantation owns it) but are responsible for the construction activities. The discrepancy in acres is due to different ideas for what phase 1 means. Toll Brothers were going to disturb 33 acres of the site as part of phase 1 whereas True Homes is disturbing 40 acres (of the total site) as their phase 1. 2) Was Phase 1 disturbance referenced in the first E&SC approval completed by Toll Brothers, or was the project sold before this activity was completed? Toll Brothers never even started any construction on this site. 3) If it was not sold prior to that completion, was there ever a close-out inspection for Phase 1 by Johnston County? N/A Essentially, Toll Brothers was going to wait to buy the property until all of the permits were approved. The permits were approved but they ended up backing out and not buying the property. Thus, they essentially did nothing with the site and want to terminate this NCG01. True Homes is now responsible for the construction activities on this site and if you would like more details on it, Toll Brothers will not know this information. If you could grant Toll Brothers this NOT request, it would be much appreciated. I hope that helps and please give me a call if you have any further questions. The current developer is a different company that already has a COC for the site (NCC201232)." We noted the original E&SC Plan was issued to Toll Brothers for 33 acres of disturbance (Regency at Flowers NW 13, Phase 1). This is a different approval than the one obtained by True Homes, LLC for 40 acres of disturbance. Please note, it appears that Toll Brothers was correct in obtaining the original COC. An entity does not necessarily need to own the property to be responsible for the construction activity on it — which the original E&SC approval implied that Toll Brothers had. However, if Phase 1 was completed and another entity has assumed responsibility for further construction, the termination is appropriate.
