(Wood) previously submitted a Joint Individual Permit (IP) Application for the L.V. Sutton Energy Complex - Sutton Lake Dam Rearmament and Vegetation Removal Project located at the L.V. Sutton Energy Complex in New Hanover County, North Carolina. The U.S. Army Corps of Engineers (USACE) issued Action ID SAW-2011-00858 for authorization of fill impacts to jurisdictional waters on March 30, 2019 and the NC Department of Environmental Quality, Division of Water Resources (NCDEQ-DWR) issues an Individual 401 Water Quality Certification WQC004207 on March 20, 2020. A request is made herein for a modification of the issued USACE IP and NCDEQ-DWR WgC004207. The modification request includes background information, the rationale (updated purpose and need) for the proposed action, updated Plan Viewdrawings, updated tabular data on newwetland impacts, and compensatory mitigation. The proposed modification to the issued USACE IP (SAW-2011-00858) and NCDEW-DWR Certification (WQC004207) is necessary to address the following item of concern. This item of concern must be resolved for completion (closure) of the Sutton Lake Dam Rearmament and Vegetation Removal Project and to assure that the authorized activities onsite for the project are in compliance with USACE regulatory requirements. The item of concern entails the additional placement of stone (rip -rap) within the 15- foot zone (repair area) from the toe of the dam. The stone was placed beyond (waterward of) the six-foot zone and was a field action that occurred during the initial construction effort to armor the cleared zone with geotextile fabric and rip -rap. Furthermore, the field change was based on engineering judgement, or necessity, that additional armament would be required in specific observed locations. This action resulted in an additional impact of 0.493 acre to Wetland E. Background Information The L.V. Sutton Energy Complex (plant) was a 575-megawatt coal-fired plant and three oil - fueled combustion turbine power generators. The coal-fired plant was retired in November 2013, with demolition of the coal plant and older combustion turbines completed in 2017. The L.V. Sutton Energy Complex is now a 625-megawatt natural gas combined -cycle plant, which began operation in 2013. The Cape Fear River abuts the western edges of the plant property. Sutton Energy Complex November 12, 2020 Dam Rearmament and Vegetation Removal Project Page 2 On the morning of September 14, 2018, Hurricane Florence made landfall in southeastern North Carolina. Three breaches occurred in the Sutton Lake Dam due to the hurricane. The breaches were repaired, but the effects of the hurricane necessitated that Duke Energy increase the structural integrity of the Sutton Lake Dam. Duke Energy desired to complete the rearmament of the Sutton Lake Dam before subsequent hurricane(s) strike Wilmington. Since its construction in 1972, trees and shrubbery have grown unchecked around the base of the dam. To restore the integrity of the Sutton Lake Dam, Duke Energy proposed to remove vegetation off the slope of the dam and a 15-foot zone from the toe of the dam. Under the issued USACE IP, trees within the 15-foot zone were cut at the base of the tree and the root ball left intact to minimize potential wetland impacts. The first six -feet of the 15-foot zone (waterward from the dam toe) was permanently armored (repair area). Maintaining this six-foot clearing would facilitate regular dam safety inspections. The remainder of the 15-foot clearing (i.e., nine -foot working area) was temporarily impacted during construction and allowed to return to its native state after the completion of the project. The permitted project purpose was to clear volunteer vegetation from the dam slope and 15- foot zone. The project purpose was based on the following needs: • To facilitate regular dam safety inspections; • Improve structural integrity of the Sutton Lake Dam by armoring the dam with geotextile fabric and rip -rap to withstand future hurricane events; and • To ensure the health and safety of citizens living downstream of the L.V. Sutton Energy Complex. The USACE IP application submittal package included information on alternatives analysis and a comparison of design plans for rearmament of the Sutton Lake Dam. All action alternatives included rip -rap and geotextile placed along the entire (3.6 miles) interior slope (cooling lake side) of the dam for rearmament. The three plans were based on the materials used to solidify the crest and exterior slope of the dam above the elevation of eight -feet. The three design plans (rip -rap with geoextile, fabriform, and hydroturf) entailed the placement of rip -rap and geotextile within the six-foot offset from the toe of the dam. The rip -rap with geotextile method was determined to be the preferred alternative for the method of rearmament. The singular wetland area within the project area was Wetland E, a riverine swamp forest. Wetland E was conterminous with the 15-foot zone from the toe of the dam, which, as permitted, would be permanently affected by dam rearmament and temporarily impacted by vegetation removal. The total permanent and temporary wetland impacts from the Sutton Lake Dam Rearmament and Vegetation Removal Project was calculated to be 6.38 acres. A total of 2.93 acres were to be permanently impacted, while a total of 3.45 acres were to be temporarily impacted. The open water repair area to Sutton Lake (including the Intake Canals) was to encompass 3.20 acres. USACE and NCDEQ-DWR Individual Permit Modification L.V. Sutton Energy Complex November 12, 2020 Dam Rearmament and Vegetation Removal Project Page 3 Compensatory mitigation for the permitted impacts for the Sutton Lake Dam Rearmament and Vegetation Removal Project was satisfied through the purchase of riparian wetland mitigation credits from the Lower Cape Fear Umbrella Mitigation Bank (Cape Fear River basin; Hydrologic Unit 03030005). The mitigation requirement was 2.51 acres of riparian wetlands. In -lieu fee, on - site mitigation, and off -site mitigation opportunities were not explored because the mitigation bank option was already available. The purpose of the post -permit activities as identified under this IP modification request was to clear volunteer vegetation from the dam slope within additional (expanded) areas of armament within the 15-foot zone from the toe of the dam, but beyond the first six feet. This purpose was based on the following needs: • To provide additional armament, or protection, waterward of the toe of the dam (area of rip -rap; and • To assure that the area of additional armament would be free of shrubby vegetation (i.e., which entailed the removal of shrubby vegetation) and the structural integrity of the work area be uncompromised. The needs of the project as originally completed are also applicable to the current action and include: • To facilitate regular dam safety inspections; • Improve structural integrity of the Sutton Lake Dam by armoring the dam with geotextile fabric and rip -rap to withstand future hurricane events; and • To ensure the health and safety of citizens living downstream of the L.V. Sutton Energy Complex. Mitigation for the originally permitted 2.51-acre impact to Wetland E was provided through the purchase of riparian wetland mitigation credits from the Lower Cape Fear Umbrella Mitigation Bank. A 2:1 mitigation ratio was established. The North Carolina Division of Water Resources received the acceptance letter from the Lower Cape Fear Umbrella Mitigation Bank (dated March 4, 2020) to meet this mitigation requirement. Mitigation for the additional impact of 0.493 acre to Wetland E will also be obtained through the Cape Fear Umbrella Mitigation Bank. A mitigation ratio of 2:1 is proposed for 0.418 acre of riparian wetland impact area within Bays 1, 2, 3, and 4 with a North Carolina Wetland Assessment Method (NCWAM) overall rating of high for the functionality of those wetland USACE and NCDEQ-DWR Individual Permit Modification L.V. A mitigation ratio of 1:1 is proposed for 0.075 acre of riparian wetland impact area within Bays 5 and 6 with a NCWAM overall rating of low or medium for the functionality of those wetland impacts areas. As rounded to the one -hundredth place, the additional mitigation that will be purchased from the Lower Cape Fear Umbrella Mitigation Bank will include the sum of 0.84 credit and 0.08 credit, or a total of 0.92 credit. All of the wetland impact areas are depicted on the attached updated Plan View drawings. The table below presents the proposed compensatory mitigation amounts for the additional impacts to jurisdictional wetlands (Wetland E) under the aforementioned post -permit action. These activities had no effect on environmental justice for the surrounding residential communities; did not impact noise - sensitive land uses; and did not impact air quality locally or regionally. Furthermore, impacts to local or regional land use, aesthetics and visual resources, geologic features, biotic communities, aquatic communities, and traffic and transportation were insubstantial.
