APPROVAL OF STORMWA TER MANAGEMENT PLAN (SMP) - MODIFICATION
Dear Mr. Poole,
On March 2, 2010, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to the
City of Charlotte to place fill within or otherwise impact 256 linear feet of perennial stream for the
purpose of constructing the proposed Dixie River road realignment in Mecklenburg County.
On June 9, 2010 the 401 Oversight/Express Permitting Unit of the DWQ received your application from
Mr. Chris Estes of Estes Design, Inc., requesting for review and approval of a modification to the
Stormwater Management Plan (SMP) associated with the proposed development. The requested
modification, as shown on the plan sheets received with your application, includes:
1. Revision to Culvert 2 from 200 linear feet of 6'x5' box culvert to 205 linear feet of 72" RCP.
This culvert receives flows from wet detention pond 2 and is sited on a non jurisdictional stream.
Therefore, the resulting impact does not affect the total impacts permitted in the 401 Water
Quality Certification;
2. Both the impervious area and total drainage area to wet detention pond 2 have increased. The
DWQ has determined that these increases do not require structural modification to wet pond 2
and its associated devices.
As a result, the DWQ approves the requested modification and accepts the SMP received with your
application to satisfy the stormwater management requirement in the Water Quality Certification. You are
required to meet the following conditions:
1. The stormwater treatment devices, consisting of two wet detention ponds, and all associated
appurtenances, stormwater conveyances, and the grading and drainage patterns depicted on the
revised plans received on June 9, 2010, as approved by this office must be maintained in
perpetuity. No changes to the structural stormwater practices shall be made without written
authorization from the Division of Water Quality. The stormwater management structures shall
have maintenance access and at least 10-foot drainage easement on each side to allow for the
ability to maintain the structures, to perform corrective actions and shall provide protection of the
structures from potential alterations by future property owners.

2. All operation and maintenance activities shall be followed as stipulated in the notarized operation
and maintenance (O & M) agreements received with your application, and signed by Mr. Poole
on June 2, 2010.
3. Notification of Construction: The applicant and/or authorized agent shall contact the DWQ
Express Review Program in writing at the letterhead address within ten (10) days of the
commencement of construction.
This letter completes the review by the Division of Water Quality under Section 401 of the Clean Water
