Thanks for the update. The draft Notice of Deficiency is currently with the DEQ attorney and
management for review. It may be a little while before it is issued, but it essentially provides your
options and instructions for submitting a “streamlined” permit renewal application.

Following up on our recent conversation, I wanted to let you know that The Fund for Sandy Point
North Carolina, LLC, definitely wishes to keep its NPDES Permit in place, as the permit is required
by our authorizing legislation. Development of the project has obviously been significantly
delayed — first by entitlement delays, then by the recession and slow recovery, and most recently
by the illness and death of our financial partner, Wayne Huizenga. We are actively pursuing
development opportunities and would be pleased to meet with you at your convenience to discuss
our development plans and future NPDES compliance.

The Sandy Point NPDES MS4 Permit is scheduled to be audited this year. I understand that
development has not yet commenced, so the “audit” will be primarily focused on discussion
of options for reissuing the permit (which is required as part of the standard audit process).
EPA has requested that I perform a site visit regardless of development status. Please let me
know if any of the following meeting options will work for you.
Meeting at Quible’s offices in Powells Point either August 28, 29 or 30.
Meeting in Edenton either August 19, 21, 22 or 23.
