Dear Mr. Harwood:
On June 3, 2010, the Division of Water Quality (DWQ) received your application dated June 2, 2010, to fill or
otherwise impact 142 linear feet of perennial stream, and an undisclosed square footage of Zone 1 Neuse River
basin protected riparian buffer, and an undisclosed square footage of Zone 2 Neuse River basin protected
riparian buffer, to construct the proposed stream restoration project at the site. The DWQ has determined that
your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetlands and/or streams
on the subject property. Therefore, unless we receive five copies of the additional information requested below,
we will place this project on hold as incomplete until we receive this additional information. If we do not
receive the requested information, your project will be formally returned as incomplete. Please provide the
following information so that we may continue to review your project.
Additional Information Requested:
1. Please note this project as proposed appears to require buffer authorization from the DWQ, and if that is
the case you will need written concurrence from the DWQ and submission of an application fee of $240.
2. This Office believes that the buffer impacts labeled on the plans as storm water BUT can be moved or
reconfigured to avoid the impacts to the buffers. Please revise the plans to avoid the impacts.
3. Buffer mitigation is required for the proposed storm water pond buffer impacts. Please submit a
mitigation plan detailing the amount of buffer impact for Zone 1 and/or Zone 2 and how the impact will
be mitigated.
4. Please provide an agent authorization letter for the application signature.
5. Please verify that the corner of the proposed parking deck is located outside the 50-foot buffer, as
measured horizontally from the top of bank.
