Compliance with Wetland and Buffer Regulations
In accordance with Title 15A NCAC 2H .0500 and Water Quality General Certification Number 3699,
condition number 5 (DWQ #10-0150), the following DEED NOTIFICATION shall be recorded in the
Cleveland County Registry. Said Deed Notification shall apply to parcel 10508, 240 Battleground Rd,
comprising a portion of the Cleveland County Generating Facility located in Cleveland County, North
Carolina as shown on plans titled "General Arrangement and Site Plan" prepared by Southern Company
Services Engineers.
"Portions of this plot of land may meet the requirements for designation as a wetland or stream. Any
subsequent fill or alteration of areas determined to meet the requirements for designation as a wetland
or stream shall conform to the requirements of the state rules adopted by the State of North Carolina in
force at the time of the proposed alteration. The intent of this provision is to prevent additional
wetland, stream, or buffer filling or draining, so the owner should not assume that a future application
for filling or draining would be approved. This covenant is intended to ensure continued compliance will
all rules adopted by the State of North Carolina, and therefore, the State of North Carolina may enforce
benefits. The covenant is to run with the land and shall be binding on all Parties and all persons claiming
under them."
