A copy of the Compliance Inspection Report is enclosed for your review. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG120000 under Certificate of Coverage NCG120047. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as the Pigeon River, a Class C waterbody in the French Broad River Basin. As a result of the site inspection, the following permit conditions violation is noted: Non-Stormwater Discharge: The report received by the division was confirmed on site. Process water resulting from the installation of the liner at the new cell was pumped into the adjacent stormwater basin and discharged. Required Response and corrective action: You are required to respond to this office, in writing, within 30 calendar days from receipt of this notice. I met with John Preston on site. During the inspection, the following items were noted: 1) Soapy water used to test the seams of the liner was discharged into an adjacent stormwater basin. This basin overtopped and discharged soapy water. The NCG120000 General Permit does not permit the discharge of non-stormwater. Soapy water used to test the seams of the liner is process water and cannot discharge. Please see the enclosed Notice for corrective actions. 2) While reports of "No Discharge the Period" have been recorded, 2 outfalls were observed discharging at the time of the inspection. The permittee shall sample and analyze the stormwater outfalls as soon as possible and follow all reporting requirements found in the NCG120000 General Permit.
