JAY ZIMMERMAN Director ♦RECEIVED/NCDENRlDWR AUG 2 9 2016 WQROS MOORESVILLE REGIONAL OFFICE The U.S. Environmental Protection Agency (EPA) recently published the National Pollutant Discharge Elimination System (NPDES) Electronic Reporting Rule. The rule requires NPDES regulated facilities to report information electronically, instead of filing written paper reports. The rule does not change what information is required from facilities. It only changes the method by which information is provided (i.e., electronic rather than paper -based). EPA is phasing in the requirements of the rule over a 5-year period. The two phases of the rule, and their key milestones, are: • Phase 1—Starting on December 21, 2016, regulated entities that are required to submit Discharge Monitoring Reports (DMRs) will begin submitting these reports electronically. If you are currently reporting your DMR data electronically using eDMR, then you simply need to continue reporting in the same way as you are now. The key change is that, starting on December 21, 2016, electronic reporting of DMRs will be required, instead of voluntary. ® Phase 2—Starting on December 21, 2020, regulated entities that are required to submit certain other NPDES reports will begin submitting these reports electronically. Reports covered in the second phase include Notices of Intent to discharge in compliance with an NPDES general permit, Sewer Overflow/Bypass Event Reports, and a number of other NPDES program reports. Incorporating Electronic Reporting Requirements into NPDES Permits The NPDES Electronic Reporting Rule requires authorized NPDES programs to incorporate electronic reporting requirements into NPDES permits beginning December 21, 2015. Under the new rule, the electronic reporting process supersedes the paper reporting process. According to our files, your NPDES permit became effective after November 2013, and should contain the requirement to electronically report your Discharge Monitoring Reports using NC DWR's eDMR system. In addition to requiring permittees to report information electronically, the rule also requires permittees to identify the initial recipient for the NPDES electronic reporting data [see 40 CFR 122.41(I)(9)]. Permittees are required to electronically submit the required NPDES information to the appropriate initial recipient, as determined by EPA. By July 18, 2016, EPA must identify and publish on its web site and in the Federal Register a listing of initial recipients by state and by NPDES data group. Once available, you can use EPA's web site to find out or determine the initial recipient of your electronic submission. NC DWR has submitted a request to EPA to be the initial recipient for the following NPDES data groups: 1. Discharge Monitoring Reports; 2. General Permit Reports [Notices of Intent to discharge (NOIs); Notices of Termination (NOTs)]; 3. Pretreatment Program Reports; and 4. Sewer Overflow/Bypass Event Reports EPA's web site will also link to the appropriate electronic reporting tool for each type of electronic submission for each state. The installation of the continuous 12" PVC pipe was completed on February 28, 2014. Stalite is waiting for weather conditions to improve to complete the diversion dam to divert base flow through the 12" pipe and allow storm water into the treatment works basin. Stalite will inform the Division of Water Resource of the completion of the project. Please review the draft very carefully to ensure thorough understanding of the conditions and requirements it contains. The draft permit contains a number of changes in its terms from those found in your current permit. A summary of those changes follows: • The current permit included a determination that the facility's settling/holding ponds are located in - stream, within the existing watercourse of the unnamed tributary to Long Creek. As such, the ponds and connecting channels are waters of the state and all discharges into the stream should be controlled and monitored. The consequence of this determination was that Carolina Stalite Company would be required to either modify its existing treatment system and/or relocate the existing stream channel in order remain in compliance with water quality regulations. The Division deferred any requirement for additional monitoring of individual waste streams resulting from Carolina Stalite Company activities until the beginning of the upcoming permit cycle in order to give the Company sufficient time to plan, finance and implement a response to the situation. In reports provided to the Division, the Company has stated it plans to install a piping system to carry the base flow of the uruiamed tributary to Long Creels from a point upstream of the first settling basin to a point downstream of the last settling basin, and into the established stream channel, thereby separating it from the flow through the treatment system. The Company has indicated that it anticipates construction of the aforementioned pipe will be completed prior to the effective date of the new permit. Because this has not occurred as of the date of the preparation of this draft permit, the existing condition A. (2.) has been replaced with a permit reopener condition that would allow the permit to be modified to include additional monitoring of discharges to the existing watercourse, should this become necessary. The temperature of the effluent shall not cause an increase in the temperature of the receiving stream of more than 2.8 °C and in no case cause the ambient water temperature to exceed 32°C. 4. PERMIT REOPENER — ADDITIONAL OUTFALLS In the event that construction of a pipe that will allow the base stream flow of the unnamed tributary to Long Creels to bypass and not comingle with Carolina Stalite Company's treatment basins is not completed by the effective date of this permit, this permit may be reopened to require additional monitoring of wastewater entering the existing watercourse. Carolina Stalite Company shall continue to provide the Mooresville Regional Office with regular reports regarding the status of the construction project until the time of its completion. ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these regulations will be adopted and is beginning implementation in late 2013. NOTE: This special condition supplements or supersedes the following sections within Part 11 of this permit (Standard Conditions for NPDES Pernzits): • Section B. (11.) (a)) Beginning no later than 90 days from the effective date of this pennit, the permittee shall begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR / DWR / Information Processing Unit ATTENTION: Central Files / eDMR 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. Requests for temporary waivers from the NPDES electronic reporting requirements must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary waiver by the Division. ELECTRONIC REPORTING OF ➢)ISCHARGE MONITORING REPORTS, continued Regardless of the submission method, the first DMR is due on the last day of the month following the issuance of the permit or in the case of a new facility, on the last day of the month following the commencement of discharge. 2. Signatory Requirements [Supplements Section B. (11.) (b) and supersedes Section B. (11.) (d)1 All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II, Section B. (1 l.)(a) or by a duly authorized representative of that person as described in Part 11, Section B. (1 L)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting purposes. For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account and login credentials to access the eDMR system. Records Retention [Supplements Section D. (6.)] The perinittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions. These records or copies shall be maintained for a period of at least 3 years from the date of the report. This period may be extended by request of the Director at any time [40 CFR 122.41]. Upon observation of the sheen, absorbent booms were placed at the discharge pipe and downstream of the discharge pipe to control the effluent. Absorbent pads were deployed as needed to collect any pooled oil sheen. The source of the oil causing the sheen was identified, and the leaking piece of equipment was taken off line until the leak was repaired. The source of the leak was an oil line that had ruptured sometime during the morning of February 1, 2010 after the daily pre -shift inspection. The leaking hose was replaced and all leaked oil was cleaned up with absorbent materials and disposed of properly. The leak did not exceed 5 gallons, and is estimated to be around 1 gallon. This estimation is based on the fact that additional oil was not required after the leak was repaired and the equipment was returned to service. Carolina Stalite is currently investigating additional safeguards to be installed in front of the effluent discharge pipe to help collect any future events. Modification of Existing -Treatment Works & Progress Reports Recent inspections of the facility have concluded its settling/holding ponds are located in -stream, within the existing watercourse of the unnamed tributary to Long Creek. As such, the ponds and connecting channels are deemed waters of the state and all discharges into the stream should be controlled and monitored (as opposed to the current practice of monitoring being conducted only at the outfall from the farthest downstream pond). The consequence of this determination is that Carolina Stalite Company will have to either modify its existing treatment system and/or relocate the existing stream channel in order remain in compliance with water quality regulations. Realizing that an appropriate response to this circumstance will require planning, funding and construction, the Division will defer any requirement that Carolina Stalite Company make modifications to its current treatment system until the beginning of the next permit cycle (i.e., no earlier than March 1, 2014), at which time the permit will be modified to reflect the existing stream and discharge characteristics. In order to ensure progress in this matter, Carolina Stalite Company is required to submit annual progress reports to the Mooresville Regional Office detailing 1.) changes the Company plans to make regarding treatment units and/or the stream channel; and 2.) actions taken to. implement the planned changes (e.g. studies, permit acquisition, construction). Dear Mr. Agner: Enclosed is a copy of the Compliance Evaluation Inspection Report for the inspection conducted at the subject facility on March 14, 2008 by Mr. Wes Bell of this Office. In addition, grab samples were collected at various discharge locations during the follow-up investigation performed by Mr. Bell on March 27, 2008. The results of these analyses will be forwarded to you under separate cover. Prior to 1970, the designated receiving stream (unnamed tributary to Long Creek) was piped underneath most of the facility's site grounds. As a result of the inspections/investigations, DWQ/MRO staff have determined that the facility's process wastewater is being combined with the receiving stream (at two separate locations) prior to discharging into the two final settling basins (operated in series). All NPDES monitoring (except upstream turbidity) is currently performed at the outlet of the final settling basin. Please be advised that you will be provided further NPDES guidance regarding these discharges and the receiving stream once all information (including analytical results) have been reviewed by DWQ personnel. PERMIT: The permit authorizes the continued operation of an existing wastewater treatment system consisting of three stormwater catch basins and four settling basins with solids storage. The permit for this facility became effective on 511/00. and expires on 2/29/04. RECORDS AND REPORTS: Records and reports consisting of calibration data, monthly monitoring reports, chain of custody forms, laboratory analyses, and correspondence regarding NPDES Permit requirements were reviewed -at the time of the'inspection. The records were well maintained and accessible. FACILITY SITE REVIEW/OPERATIONS & MAINTENANCE: The subject facility appeared to be well maintained and in good operational condition at the time of the inspection. The area surrounding the settling ponds was well vegetated and showed no signs of erosion. All domestic wastewater is treated on -site via septic tank/nitrification field. LABORATORY: Aquasource, Inc. (Certification #365) in Concord, N.C. has been contracted to provide analytical support. The pH meter and thermometer appeared to be properly calibrated. The pH calibration time was documented; however, the ORC and staff must ensure that the laboratory analyst is documented for all calibrations and on -site analyses. The start -and end times .for the settleable solids test were not documented .to verify compliance with Standard Methods, 18th Edition - Method 2540 T. EFFLUENT/RECEIVING WATERS: The facility -discharges into an unnamed tributary to Long Creek, which is a Class C water in the'Yadkin-Pee Dee River Basin. The effluent discharge was clear with no suspended solids or foam. The receiving stream did not appear to be negatively impacted. The outfall location was accessible. SELF -MONITORING PROGRAM: Self -monitoring reports were reviewed for the period June 2001 through May 2002, inclusive. No limit violations were reported. All monitoring frequencies were correct. On numerous occasions, the fifteen minute holding time for pH analyses was exceeded. Please be advised that pH analyses must be within fifteen minutes (following sample collection) as required by CFR 136.3 Table II. The remaining analyses appeared to be meet the required holding times and were properly preserved. Carolina Stalite Company Page Three FLOW MEASUREMENT: Instantaneous flow is measured by a staff gauge and the corresponding flow calculations of the effluent pipe. SLUDGE DISPOSAL: The solids collected in the settling basins are periodically removed and reused into the production process. SEWER OVERFLOW: Please be advised that pursuant to Part II, Section E of your NPDES permit, and North Carolina Administrative Code (NCAC) 15A 2B .0506 (a)(2), any failure of a collection system, pumping -station or treatment facility -resulting in a bypass witbout treatment of -all or any portion of _the wastewater shall be reported to the central office or the appropriate regional office (Mooresville Regional Office 704-663-1699) as soon as possible but no later than 24 hours from the time the permittee became aware of the bypass. Overflows and spills occurring outside normal business hours may also be reported to the Division's Emergency Response personnel at 800-662-7956, 800- 858-0368, or 919-733-3300. A written report shall also be provided within five (5) days of the time of the incident. The report shall contain a description of the bypass, and its cause; the period of the bypass, including exact dates and times, and if the bypass has not been corrected, the anticipated time it is expected to continue; and steps taken (or planned) to reduce, eliminate, and prevent recurrence of the similar events. Any spill that reaches surface waters (i.e. any spill that reaches any water already present in a conveyance, stream, ditch, etc...) or any spill greater than 1,000 gallons on the ground that does not reach surface waters must be reported. An adequate spill response for those spills reaching surface waters should include an evaluation downstream of the point at which the spill entered surface waters to determine if a fish kill occurred. - The evaluation should also include the collection of upstream dissolved oxygen and pH measurements for background information and dissolved oxygen and pH measurements at multiple points downstream of the entry point to document any negative impact. Failure to report the bypass of collection system, pumping station or treatment facility subjects violators to penalties of up to $25,000.00 per day per violation.
