PROJECT SUMMARY: The applicant is proposing to construct a 4-slip docking facility shared between two lots. Field Investigation Report: Ross Lampe Page 2 of 3 9. Narrative Description: The property consists of two adjacent lots located 591 Florence Road (SR 1324) near Merritt, Pamlico County. Lot #1 is 255,697 square feet and Lot #2 is 162,914 square feet. This tract has 408' of shoreline frontage on Trent Creek. The applicant wishes to construct a 4-slip docking facility within Trent Creek, a tributary of the Bay River. Trent Creek is a part of the Neuse River Basin. Trent Creek averages 117' across at this location. The current vegetation on the tract mainly consists of upland grasses, trees, and Coastal Wetlands. The Coastal Wetland vegetation is dominated by Black Needle Rush (Juncus roemerianus). These Coastal Wetlands adjacent to Lots 1 & 2 make up an area of approximately 323,136 square feet. There is a mosquito ditch, or unnamed tributary (UT), within the Coastal Wetlands of Lot 2. This feature averages 8' in width. The elevation of the tract is + 4' nwl. These two lots are currently developed only with a shared gravel access driveway connecting to Florence Road. There are Section 404 Wetlands on both lots. The Pamlico County Land Use Plan classifies the project area as Rural with Services, with CAMA AEC's classified as Conservation. These waters Trent Creek are designated as Primary Nursery Area and are closed to shellfish harvesting. These waters carry a water quality classification of SC; Sw, NSW. The bottom substrate is soft without shell. The immediate offshore water depths in this area range from -5' to -12' nwl. There is no SAV within the immediate vicinity of the project area. 10. Proposed Development: The request is for the new construction of a 4-slip shared docking facility on Lots 1 & 2 as an amenity to sell. Future single-family residential development will performed by the future owners. This 4-slip docking facility will serve the two lots and straddle the shared property line. This docking facility will have two components: a 2-slip docking facility in Trent Creek and a 2-slip kayak platform in the UT within Lot 2. The fixed wooden pier access will be 4' wide and 870' long to connect to a "T" platform on the Trent Creek tributary. The kayak platform will be 100' from the landward edge of the Coastal Wetlands and connect to the UT. The access pier will follow the lots' shared property line and traverse across the Coastal Wetlands. The connecting "T" platform will be 8' wide and 32' long. This platform will have three tie pilings to support two formalized boat slips. These boat slips will have the capability of supporting vessels of up to 16' in length. The water depth is -4.9' nwl at this location. At the edge of the UT, there will be a 6' wide and 16' long fixed platform. There will be a kayak rack on this platform. This rack will support the storage of 2 kayaks/canoes. 11. Anticipated Impacts: The pier will shade 3,168 fe of Coastal Wetlands and 200 fe of Section 404 Wetlands. This pier will cross perpendicular through the Neuse River Riparian Buffer. The kayak platform will shade 144 fe of Coastal Wetlands. The 2-slip docking facility on Trent Creek will result in the usurpation of 672 fe of Public Trust Waters. There will be 400 fe of platform area along 408' of shoreline adjacent to Trent Creek. This docking facility will extend 28' waterward into the Trent Creek tributary, which averages 117' wide at this location. This docking facility will be constructed landward of the navigable slough of the tributary and should not pose a hazard to navigation. These waters Trent Creek are designated as Primary Nursery Area and are closed to shellfish harvesting. These waters carry a water quality classification of SC; Sw, NSW. The bottom substrate is soft without shell. Water depths in the slips are -4.9' nwl. There is no SAV in the project area. Gregson, Director Dee Freeman, Secretary MEMORANDUM DATE: May 17, 2010 TO: Doug Huggett THRU: Ted Tyndall FROM: Brad Connell SUBJECT: Comments and Recommendations - CAMA Major Permit - Ross Lampe, Pamlico County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal involves the usurpation of 672 square feet of Public Trust Waters. These waters of Trent Creek are closed to shellfish harvest. This waterbody is a Primary Nursery Area. This proposed docking facility appears to meet the specific use standards listed in 15A NCAC 07H .0208(b)(6). Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) The authorized structures and associated activity must not cause an unacceptable interference with navigation, and shall not extend greater than 29' waterward; 2) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification; 3) Any portion of the permitted access pier and docking facilities built over coastal wetlands must not exceed six feet in width and must be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking; 4) This permit authorizes a maximum of four boat slips. At no time shall more than four vessels be moored or docked at the facility.
