Dear Mr. Jones:
The Division of Water Quality (Division) has completed the review of the 401 Water Quality Certification
application associated with the project listed above.
It has been determined that the subject project does not require written concurrence from the Division and is
deemed certified, if the conditions required by Water Quality Certification No. 3821 are followed (attached) and
if the residence is constructed in accordance with the revised site plan.
Please note that Little Hogback Creek has a special management strategy [ref. 15A NCAC 2B.0225(13)] and
post construction stormwater must comply with the requirements stated for Outstanding Resource Waters [ref.
15A NCAC 2H .1007]. As your consultant has indicated in the additional information submitted to this office
(and as indicated in your site plan dated May 19, 2010), the impervious surface percentage is approximately
5%, which is considered low density requiring vegetated stormwater conveyances instead of discrete
stormwater collection systems. The revised site plan also indicates that impervious surfaces (including the
house and gravel parking area) are greater than 30 feet from surfaces waters, which is also required by the
stormwater rules for Outstanding Resource Waters. Should you ever exceed 12% impervious surface area,
stormwater systems will be required on your site.
In addition to the above stipulations, you should obtain or otherwise comply with any other required federal,
state or local permits before proceeding with the project, including (but not limited to) Jackson County Erosion
and Sediment Control regulations.
