Pursuant to 15A NCAC 02H .0107(d), a certificate of coverage (COC) shall be issued when the Director determines that water quality standards are met. The application has not met the following requirements: 15A NCAC 02B .0206(d)(2) "If the 30Q2 and 7Q10 flows are both estimated to be zero, no new or expanded (additional) discharge of oxygen consuming waste will be allowed. Requirements for existing discharges to streams where the 30Q2 and 7Q10 flows are both estimated to be zero will be determined on a case -by -case basis." The 30Q2 and 7Q10 were estimated by the United States Geological Survey (USGS) to be zero for the location at Outfall 001 discharging to receiving waters designated as an unnamed tributary to Cold Water Creek [stream segmentl3-17-9-4-(1.5)], a waterbody currently Classified C within Subbasin 03-07-02 [HUC 03040105] of the Yadkin -Pee Dee River Basin. In accordance with 15A NCAC 02H .0112(6), your application for Certificate of Coverage (CO) NPDES General Permit NCG550000 is hereby denied. [mikel@LashEngineering.com] February 12, 2015 Memo To: Derek Denard From: Michael Parke Subject: Paula Yost Residence (proposed) General Permit No. NCG551646 Cabarrus County This Office has conducted a review of the subject SFR permit application and supporting information received in this Office on February 3, 2015. Specifically, Ms. Yost has applied to install a pre-fab wastewater treatment system to serve a proposed 4-bedroom on a lot of approximately 2 acres. Listed below are specific comments with regards to the application and regional office recommendations. 1. Although the site is approximately two acres, there is a considerable amount of undeveloped property adjacent to this site (approximately 90 acres) that is part of an estate owned by the same family that may be available to the applicant for some type of non -discharge alternative. If additional acreage could be acquired (either through an easement or purchase), there may be sufficient soils located on the property that would support some type of a spray or drip irrigation treatment system. Additional soils information would be needed pending the location of additional acreage that would be available to the applicant for this purpose. 2. There was little or no evaluation by the applicant's engineer of other on -site non -discharge alternatives such as drip irrigation or spray irrigation, possibly due to the fact that the proposed lot is only two acres in size. As referenced in No. 1 above, additional non -discharge options need to be considered when the availability of additional acreage may be present. Per 15A NCAC 02H .0105(c) (2), a summary of all waste treatment disposal options that were considered should be included in the application and why the proposed system was selected. This summary should provide enough detail to ascertain whether all non -discharge disposal options (both surface and subsurface) have been evaluated by a soils scientist. A site visit was conducted on February 11, 2015 of the receiving stream and the proposed point of discharge. Observations made during the site visit indicate that the proposed point of discharge would enter a small channel that originates on the property. On the day of the site visit, the channel's flow was estimated to be approximately 1-2 gpm at the point where the channel intersected another UT to Cold Water Creek immediately south of the proposed lot. It should be noted, however, that on the day of the site visit, the area had recently experienced a significant rainfall event, which coupled with seasonally high GW flows likely led to the observation of flow in the channel. Given the very small drainage area and channel characteristics observed, it is suspected that the channel is intermittent at best and is likely subject to periods of low or no flow, especially during the summer months. 7Q10/30Q2 estimates for this channel at the proposed point of discharge are 0 cfs. Page Two It should be noted that 15A NCAC 02B .0206(d)(2) stipulates that if the 7Q10 and 30Q2 flows of the proposed receiving waters are estimated to be zero, then no new or expanded discharges of oxygen consuming wastes can be allowed. Based on our preliminary review of this application (and the February 11ffi site visit), the channel that exists on this property is estimated to have zero 7Q10/30Q2 flow. It is unclear as to whether the Division is applying the aforementioned Rule to SFRS, however, this Office recommends that the issuance of a SFR permit be contingent on whether the applicant has access to positive flow surface waters for which to assimilate their wastewater. Furthermore, consideration for SFR permit issuance apparently is not being given depending on whether or not a residence has been established on the lot. This means that SFR permits are being issued to allow for discharges from residences proposed for undeveloped lots where local County Health Departments have determined that conventional subsurface systems cannot be approved. If SFR discharges are being approved to dry ditches and channels having 7Q10/30Q2 flows that are estimated to be zero, this would appear to be contrary to the intent of the Rule noted above. Furthermore, allowing the issuance of SFR permits on undeveloped lots imposes added pressure on the Division to authorize discharges on lots which likely should not be developed due to extremely poor draining soils, topographical constraints such as in flood prone areas, or they happen to be located adjacent to a water supply reservoir where direct access to the reservoir (via pipe) is not allowed by the regulating utility company. In most cases, there are generally good reasons why certain lots sit empty for years in built -out developments — there is no acceptable subsurface means of handling the disposal of the wastewater generated from a residence built on the property. Typically, these lots are offered for sale at substantially cheaper prices than adjacent lots where conventional septic systems have been approved by the Division of Environmental Health (DEH). Eventually, these marginal lots with poor soils or other topographic issues become attractive to prospective homeowners so much so that they are willing to ignore their due diligence and buy the property in the hope that they can get some kind of disposal system permitted. Fortunately, many prospective homeowners do not enter into a contractual agreement on the property, so their inability to obtain a SFR permit does not pose an economic hardship. However, a number of cases have come through this Office where sufficient soils information existed prior to the sale of the property that documented the existence of poorly drained soils or severe topographical constraints and the buyer continued with the purchase of the lot without assurance of a permanent wastewater disposal option. This Office has historically denied all SFR applications except in cases where there was an existing residence and DEH and outside soil experts had documented that there were no surface or sub -surface non - discharge alternatives. Even when SFR permits were granted in this region, attempts were made to obtain direct access to surface waters so that assimilation of the effluent could be met. Allowing discharges to dry ditches and other conveyances sets the Division up for complaints from down gradient property owners from both an aesthetic as well as a public health standpoint. Continuing to allow dry -ditch discharges from SFRS highlights a level of disparity that exists in our NPDES application review process for SFRS, is contrary to the Rule noted above, and is inconsistent with the way we review other domestic wastewater discharge permits. /mlp NCDENR North Carolina Department of Environment and Natural Resources Pat McCrory John E.
