The former Jose's Restaurant at the subject address previously had a state permit to discharge wastewater. The last
permittee of record — Malinda Duvall — allowed the permit to expire and made no request to renew it.
A Certified Letter [attached] was sent to Ms. Duvall last month informing her of the permit's expiration. The original
letter was returned to the Division marked "Unclaimed" by USPS.
This message is to notify the relevant County authorities that the subject location has no valid wastewater permit with
the State of NC. Whatever activities are undertaken at that location in the future should be permitted by the
County. EPA restrictions do not allow us to reactivate a permit once it has been made Inactive.

The NPDES permit for the Jose's Restaurant WWTP expires on April 30, 2017. This notice is
being sent to explain the requirements for your permit renewal application.
Federal (40 CFR 122) and state (15A NCAC 2H.0105 (e)) regulations require that permit renewal
applications be filed at least 180 days prior to expiration of the current permit. Your renewal
application was due to the Division no later than November 1, 2016. Failure to apply for renewal
by the regulatory deadline has denied this facility the automatic permit extension described in
NCGS 150B.
Use the attached checklists to complete your renewal package. The checklists identify the items
you must submit with the renewal application.
If all wastewater discharge has ceased at this facility and you wish to rescind this permit, simply
reply to this letter.

The Division has reviewed your request to suspend submission of monthly Discharge Monitoring
Reports (DMRs), submitted on behalf of the permittee.
After considering the recommendations of the staff in the Winston-Salem Regional Office, I have
agreed to waive the requirement to submit monthly DMRs for the subject facility, effective
November 1, 2015. The DMRs up through and including) October 2015 should be submitted as
usual.
Be advised that if any wastewater discharge occurs, the discharge must be monitored as per the
terms of the NPDES permit and other applicable rules or statutes. Please keep the Winston-
Salem Regional Office apprised of any pertinent developments that arise regarding this facility,
especially if the discharge is re -activated.
While requirements for operator visitation, monitoring and reporting are being waived, you are
still required to pay the Annual Administering and Compliance Monitoring Fee that is associated
with this and all NPDES permits.

this request for a temporary suspension of monthly monitoring

The restaurant opened approximately one year ago, but for
reasons unclear to the operators, the i;e l ephone and i r►.treriet.
service to the .restaurant; has been continuously disrupted. This
prevents them from operating with phone service, credit card
service, etc. They have been trying for several months to gel -
various carriers to help with the problem; bul-. so far rrol;hing
has been done to resolve. the prob "I em . This leaves them uncertain
from clay to day if they wi l 1 be able I-.o operat.e. under normal
conditions, so it was decided to te.mporarily cruse until the
situation is stabilized. TI-, is their intent to re -open as soon
as possible, and they will notify you when they are ready to
resume normal operations.
They are concerned that if they stop submitting reports
your office might assume that, they are no longer in business and
would lose validation of their discharge permit. They appreciate
