Please give a brief project description below. * Piedmont Natural Gas proposes to construct the Ramsey Road segment of the Highway 17 North Carolina Department of Transportation (NCDOT) Distribution Replacement Project (Project) near the City of Jacksonville in Onslow County, North Carolina. The Project is located along a 3.19-mile section of Ramsey Road (Route 1324) and Kellum Loop Road, northeast of the City of Jacksonville. The Project will begin approximately 0.17 miles east of the intersection of Route 1324 and Carolina Forest Boulevard, proceeds east along Route 1324 for approximately 3.12 miles, turns southeast and proceeds for 0.17 miles along Kellum Loop Road, and ends at New Bern Highway (Highway 17). The Project is being constructed to replace a portion of an existing natural gas distribution pipeline that extends along Highway 17. This portion of the pipeline will be decommissioned and removed due to a proposed NCDOT project involving Highway 17. The NCDOT project will consist of widening and reconfiguring Highway 17, and the existing pipeline needs to be relocated to allow for the expansion. A location map has been provided in Appendix D. The Project will consist of installing approximately 16,922 linear feet of 8- inch medium -dense polyethylene (MDPE) natural gas distribution pipeline within a proposed 35-foot-w4de construction easement. The easement will consist of a 20-foot-wide temporary work area and a 15-foot-wide permanent maintenance easement to remain post -construction. Construction will involve 11,309 feet of conventional open cut trenching, 5,438 feet of horizontal directional drilling (HDD), and 175 feet of auger bore. Construction will involve the use of typical heavy construction equipment (e.g., excavators, dozers, scrapers, side booms) and will be executed in compliance with all required permits and regulatory conditions. The Project will span across wetlands and tributaries associated with Wolf Swamp. The majority of the construction easement will be located within existing maintained utility easements; however, some tree clearing will be required within the construction easement to allow proper access and clearance for construction activities. Wetland Impacts A wetland delineation was conducted by Burns & McDonnell in September and October 2019 and identified multiple wetlands and other waterbodies within the Project. Impacts from construction activities within wetland areas will not result in any permanent loss of wetlands. Construction activities associated with the 20-foot-wide temporary work area will result in 15 temporary impacts to wetlands associated with clearing, grubbing, and construction support for pipeline installation. Construction activities associated with the 15-foot-wide permanent maintenance easement will result in four temporary impacts to palustrine emergent (PEM) BURNS SME-DONNELL Ms. Rachel Capito U.S. Army Corps of Engineers October 26, 2020 Page 3 wetlands associated with open trenching and HDD activities. Although these areas are located within the permanent maintenance easement, post -construction pipeline maintenance will not result in a permanent conversion of the PEM areas and are therefore, considered temporary impacts. The impacted areas will be returned to original grade and restored prior to demobilization of the project. Vegetation will not be permanently altered and allowed to return naturally over time. Locations of these impacts are illustrated on the Impact Figures in Appendix D. Total acreage of temporary impacts has been provided below and are outlined in detail in Table 3 in Appendix B. Activities associated with construction and routine post -construction pipeline maintenance within the 15-foot-wide permanent maintenance easement will result in seven permanent conversion impacts to palustrine forested (PFO) and palustrine scrub -shrub (PSS) wetlands. Due to Piedmont's Integrity Management Guidelines, PFO and PSS areas on the surface of the HDD will be cleared with roots left in -place. This will result in a conversion of PFO and PSS wetlands to PEM wetlands. No permanent fills within wetland areas will occur as a result of the Project Temporary Impacts: 0.795-acre PFO 0.593-acre PSS 0.338-acre PEM Permanent Conversion Impacts: 0.016-acre PFO to PEM 1.03-acre PSS to PEM Waterways: This project will cross the mainstem of Wolf Swamp (S-01) via HDD as illustrated on sheet 12 of the Design Drawings. The HDD will cross underneath the stream channel at a minimum depth of five feet below the bottom of the channel. As a result, no impacts to the mainstem of Wolf Swamp are anticipated. The project will also result in temporary impacts to four potentially jurisdictional ditches via open trenching methods. These locations are illustrated on pages 2, 7, and 10 of the Impact Figure and on sheets 6, 13, and 16 of the Design Drawings. Upon completion of construction at each location, the ditches will be restored to preconstruction conditions. Total linear feet of temporary impacts are provided below and outlined in detail in Table 4. BURNS 1%ME-DONNELL Ms. Rachel Capito U.S. Army Corps of Engineers October 26, 2020 Page 4 Temporary Impacts: 87.06 linear feet — potentially jurisdictional ditches Indirect impacts to waters are anticipated to be minimal as Best Management Practices (BMPs) will be installed for the purposes of erosion and sediment controls which are illustrated on the Design Drawings. BMPs will be inspected regularly to confirm proper maintenance and function. Threatened & Endangered Species According to the U.S. Fish and Wildlife Service Information, Planning, and Conservation (FWS IPaQ report, the following federally protected species may occur within the vicinity of the Project: • West Indian manatee (Trichechus manatus) • Eastern black rail (Laterallus jamaicensis ssp. Jamaicensis) • Piping plover (Charadrius melodus) • Red knot (Calidris canutus rufa) • Red -cockaded woodpecker (Picoides borealis) • American alligator (Alligator miss iss ippiensis) • Green sea turtle (Chelonia mydas) • Kemp's Ridley sea turtle (Lepidochelys kempii) • Leatherback sea turtle (Dermochelys coriacea) • Loggerhead sea turtle (Caretta caretta) • Cooley's meadowrue (Thalictrum cooleyi) • Golden sedge (Carex lutea) • Pondberry (Lindera melissifolia) • Rough -leaved loosestrife (Lysimachia asperulaefolia) • Seabeach amaranth (Amaranthus pumilus) No critical habitats were determined to be within the Project area. A protected species habitat assessment letter was prepared and submitted to the U.S. Fish and Wildlife Service (USFWS) Raleigh Ecological Services Field Office on October 1, 2020 to request consultation under the requirements of Section 7 of the Endangered Species Act (ESA). Burns & McDonnell proposed that the Project is not likely to adversely affect federally listed species. A copy of the letter has been provided in Appendix G. At the time of submittal of this PCN, a response from USFWS had not been received. Correspondence from USFWS will be submitted to the USACE upon receipt. BURNS &;MEDONNELL Ms. Rachel Capito U.S. Army Corps of Engineers October 26, 2020 Page 5 Cultural Resources According to the State Historic Preservation Office's (SHPO) HPOWEB GIS service application online for non -archaeological historic -age resources, no previous surveys were documented within the proposed area of potential effects (APE). One previously recorded non -archeological historic - age resource was located within the APE near the eastern terminus of the Project: • Resource # ON0263 —Benjamin Lee Parker House — Unevaluated (Surveyed Only) A project review letter was prepared and submitted to the State Historic Preservation Office (SHPO) in Raleigh, North Carolina on September 24, 2020 requesting consultation under the requirements of Section 106 of the National Historic Preservation Act (NHPA). A copy of the letter has been provided in Appendix G. At the time of submittal of this PCN, a response from SHPO had not been received. Correspondence from SHPO will be submitted to USACE upon receipt. Alternatives Analysis Avoidance and minimization of impacts to wetlands and other waterbodies was attempted by routing the pipeline within and adjacent to already existing and maintained utility and NCDOT easements. The temporary work area and permanent maintenance easement were kept as narrow as possible to minimize disturbances during construction and maintenance. The majority of impacts will be temporary, and the Proj ect will not result in a loss of wetlands or other waterbodies. The pipeline will be partially installed using HDD, which means the permanent pipeline easement will not require earth work. Tree clearing will be required as part of PNG's Integrity Management Plan; however, stumps and root systems will remain in place. Construction matting will be used at the open cut stream and wetland crossings to help minimize the disturbance. The project will be constructed in accordance with state/local and federal guidelines pertaining to minimizing impacts during construction. An approved and certified erosion and sediment control plan will be provided to the contractor for proper implementation of appropriate BMPs. Additionally, measures to minimize wetland and stream channel impacts from vehicle activity will be utilized. Summation The proposed Project intends to relocate a natural gas distribution pipeline in response to the widening of Highway 17 by NCDOT. Multiple wetlands and potentially jurisdictional ditch impacts are anticipated; however, the majority of impacts will be temporary, and no permanent loss of jurisdictional wetlands will occur. The Project will result in the permanent conversion of 0.016-acre of PFO wetlands and 1.03-acres of PSS wetlands to PEM wetlands. No impacts to federal listed species are anticipated and no critical habitat was determined to be within the Project. One historical property was identified within the Project area, which we are awaiting consultation from SHPO on how to proceed. The following sections provide information on the proposed Project and summarize the completed wetland delineation. INTRODUCTION The client proposes to construct approximately 16,922 linear feet of 8" medium -dense polyethylene (MDPE) natural gas pipeline in Onslow County, North Carolina. The Project is located north of Jacksonville, North Carolina, west of New Bern Highway (Highway 17), and is accessible via Ramsey Road (Route 1324). A General Location Map illustrating the Project location has been included in Attachment A (Figure A-1). Potential construction activities associated with the Project may include clearing, grubbing, and construction of pipeline infrastructure. The proposed Project has the potential to impact wetlands or other waterbodies that may be under the jurisdiction of the U.S. Army Corps of Engineers (USACE) as designated by Section 404 of the Clean Water Act. In an effort to avoid and minimize potential impacts to regulated waterbodies, Burns & McDonnell conducted a wetland delineation within an approximately 100- foot-wide corridor along an approximate 3.19-mile-long section of Ramsey Road (Route 1324) and Kellum Loop Road (Study Area) to determine the boundaries and extent of wetlands and other water bodies including streams, ditches, ponds, etc. The Study Area was approximately 30.17 acres in size, which is larger than the proposed 11.30 acres Project area. METHODS The following discussions summarize the methods used to review existing data and conduct the wetland delineation. Existing Data Review Burns & McDonnell reviewed publicly available background information for the Study Area prior to conducting a site visit. This background information included the U.S. Geological burnsmrd. ram BURNS 'WDONNELL Ms. Rachel Capito Wilmington Regulatory Field Office October 7, 2020 Page 2 Survey (USGS) 7.5-minute topographic maps, U.S. Fish & Wildlife Service (USFWS) National Wetland Inventory (NWI) map, and U.S. Department of Agriculture (USDA) Natural Resources Conservation Service (MRCS) 2014 Soil Survey Geographic (SSURGO) digital data for Onslow County. Maps generated from this publicly available data are included as Figures A-2 and A-3 in Attachment A. Wetland presence based only on background information, including NWI maps, cannot be assumed to be an accurate assessment of potentially occurring jurisdictional wetlands. Wetland identification criteria differ between the USACE and other agencies. As an example, wetlands shown on an NWI map may not be under the jurisdiction of the USACE, and USACE- jurisdictional wetlands are not always included on the NWI maps. A field visit is necessary to identify any wetlands, streams, or other waterbodies that may be present. Wetland Delineation Field Survey An onsite wetland delineation of the Study Area was completed in accordance with the 1987 Corps of Engineers Wetlands Delineation Manual and the 2010 Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Coastal Plain (Regional Supplement). Sample plots were established at multiple locations and Wetland Determination Data Forms from the Regional Supplement were completed to characterize the Study Area (Attachment B). Vegetation, soil conditions, and hydrologic indicators were recorded at each of these sample plots. Locations of sample plots and other identified features were surveyed in the field by Burns & McDonnell using a submeter Global Positioning System (GPS) antenna. Natural color photographs were taken onsite and are included in Attachment C. RESULTS The following sections describe the results of the existing data review and the completed wetland delineation. Existing Data Review The existing USGS topographic maps for Jacksonville North, NC (2019 Revision) and Kellum, NC (2019 Revision) were reviewed to familiarize Burns & McDonnell wetland personnel with the topography of the Study Area and potential locations of wetlands and other waterbodies (Figure A-2). The USGS topographic maps indicate the Study Area consists of mostly developed residential and commercial areas with several agricultural and forested areas along the northern side of Ramsey Road (Route 1324) with mainly flat terrain, and multiple drainage features and unnamed tributaries draining into Wolf Swamp (Figure A-2). The USFWS NWI map indicates a linear freshwater forested/shrub wetland located within the Study Area (Figure A-2). BURNS 'WDONNELL Ms. Rachel Capito Wilmington Regulatory Field Office October 9, 2020 Page 3 The NRCS SSURGO digital data indicates the Study Area is underlain primarily by Rains fine sandy loam, 0 to 2 percent slopes, Atlantic Coast Flatwoods; Goldsboro fine sandy loam, 0 to 2 percent slopes; and Lynchburg fine sandy loam, 0 to 2 percent slopes, Atlantic Coast Flatwoods. Rains fine sandy loam and Lynchburg fine sandy loam are considered hydric in Onslow County, North Carolina (Figure A-3). Wetland Delineation Field Survey Between September 23 and 27, 2019 and October 10 and 11, 2019, Patrick Meier, wetland specialist with Burns & McDonnell, conducted a wetland delineation of the Study Area to identify the presence of wetlands, streams, and other waterbodies. The Study Area was largely composed of developed residential and commercial areas, agricultural fields, and forested areas with flat terrain, and multiple drainage features. Vegetation: Typical woody species within the Study Area consisted of sweetgum (Liquidambar styraciflua), loblolly pine (Pious taeda), red maple (Acer rubrum), sweet -bay (Magnolia virginiana), and southern bayberry (Morella cerifera). Typical herbaceous species within the Study Area consisted of giant plume grass (Saccharum giganteum), bushy bluestem (Andropogon glomeratus), broom -sedge (Andropogon virginicus), tall goldenrod (Solidago altissima), saw -tooth blackberry (Rubus argutus), and Japanese honeysuckle (Lonicera japonica). Soils: Typical soil colors ranged from dark black (10YR 2/1) to light gray (2.5Y 5/2) with a typical texture of sandy loam. Hydrology: The primary sources of hydrology within the Study Area were ground water table and surface runoff. Typical indictors of hydrology included geomorphic position and FAC- neutral test. Delineated Areas: Wetlands During the delineation a total of 4.438 acres of potentially jurisdictional wetlands were located within the Study Area. Typical site conditions for each wetland classification are described below and locations of the wetland areas are shown in Figure A-4. Table 1 provides the quantity for each wetland classification delineated within the Study Area. Vegetation typically present within these areas consisted of loblolly pine, sweet -bay, wax myrtle, and red maple. Wetland hydrology was typically indicated by soil saturation. Observed soils typically ranged from black (10YR 2/1) to light gray (2.5Y 511). Hydric soil was typically indicated by a thick dark surface. Palustrine Scrub -Shrub (PSS) 3.083 acres: The majority of wetland areas identified within the Study Area were classified as PSS. These wetlands typically occurred as wetland flats within a maintained utility easement. Vegetation typically present within these areas consisted of loblolly pine, sweet -bay, giant plume grass, and cottongrass bulrush (Scirpus cyperinus). Wetland hydrology was typically indicated by soil saturation, geomorphic position, and FAC-neutral test. Observed soils typically ranged from very dark gray (10YR 2/1) to light gray (2.5Y 5/1) in color with a sandy loam texture. Hydric soil was typically indicated by a thick dark surface and a depleted matrix with redox concentrations. Palustrine Emergent Wetlands (PEA/1) 0.392-acre: PEM wetlands typically occurred as roadside wetland drainages and stream channel buffers. Typical vegetation within this area consisted of wand panic grass (Panicum virgatum), handsome -harry (Rhexia virginica), giant plume grass, broom -sedge, slender goldentop (Euthamia carohniana), and Japanese stilt grass (Microstegium vimineum). Wetland hydrology was indicated by surface cracks, geomorphic position, and FAC neutral test. Observed soils ranged from very dark brown (IOYR 2/1) to light gray (IOYR 511) with a sandy loam texture. Hydric soil was typically indicated by a depleted matrix. Table 2 provides the classification and length of the stream. The stream is also described below and displayed on Figure A-4. Table 2: Type and Size of Wetlands Delineated within the Study Area Stream Number Stream Type a Length (linear feet) S-1 Perennial 71.94 Stream-1 (S-1): S-1, the Wolf Swamp mainstem, is located near the eastern end of the Study Area off Ramsey Road. The stream is fed by surface runoff from adjacent upland area(s) and flows to the south where it enters a culvert pipe and leaves the Study Area (Figure A-4). The channel averaged approximately 10 feet wide and the banks averaged approximately 3 feet deep. Substrate within the channel consisted of a sandy loam. Riparian vegetation along the banks consisted of water oak (Quercus nigra), swamp smart weed (Persicaria hydropiperoides), and Japanese stilt grass. Delineated Areas: Jurisdictional Ditches Approximately 5,640.72 linear feet (L.F.) of potentially jurisdictional ditches were located within the Study Area. These features were delineated based on information from the document "Ditches in North Carolina" (February 2017), provided by the U.S. Army Corps of Engineers Wilmington District. These features typically occurred as vegetated roadside and agricultural ditches that were fed by upslope wetland sources or displayed wetland characteristics such as ordinary high water mark (OHWM), presence of groundwater, inundation, or saturation. Dominant vegetation within these features typically occurred as FAC or wetter species. SUMMARY Burns & McDonnell conducted a wetland delineation of the Study Area on September 23 and 27, 2019 and October 10 and 11, 2019 to determine the presence of wetlands, stream channels, and other waterbodies. 0.963-acre of PFO, 3.083 acres of PSS wetlands, and 0.392-acre of PEM wetlands, 71.94 L.F. of stream channel, and 5,640.72 L.F. of jurisdictional ditches were identified. On behalf of Piedmont Natural Gas, Burns & McDonnell respectfully requests a preliminary jurisdictional determination of the water resources identified in the Study Area. The Project, which will result in impacts on waters of the U.S., will require a Nationwide Permit No. 12 from the U.S. Army Corps of Engineers (USACE), Wilmington District. The following information is being provided to the U.S. Fish and Wildlife Service (USFWS) for review and concurrence under the requirements of Section 7 of the Endangered Species Act (ESA). A Project Location map is provided in Attachment A. INTRODUCTION PNG plans to install approximately 16,922 linear feet of 8" medium -dense polyethylene (MDPE) natural gas distribution pipeline in Onslow County, NC. The Project is located within an approximate 3.19-mile-long section along Ramsey Road (Route 1324) and Kellum Loop Road. The project starts approximately 0.17 miles east of the intersection of Route 1324 and Carolina Forest Boulevard, proceeds east along Route 1324 for approximately 3.12 miles, turns southeast and proceeds for 0.17 miles along Kellum Loop Road, and ends at New Bern Highway (Highway 17).The pipeline will cross various land use types consisting primarily of mixed hardwood pine forest, agricultural fields, residential and commercial areas, and existing maintained utility and NCDOT right-of-way. The habitat assessment was conducted along the proposed pipeline route using a 100-foot-wide survey corridor along Route 1324 and Kellum Loop Road (Study Area). The Study Area is approximately 30.17 acres total, which is larger than the 11.30 acres that will be temporarily impacted during construction. HABITAT ASSESSMENT In September 2019, Burns & McDonnell biologists completed a pedestrian survey of the Project Study Area to evaluate the potential for federally protected species habitat to occur within the Project area. 7201 Glen Forest Drive \ Suite 100 \ Richmond, VA 23226 burnsmcd.com BURNS;&MGDONNELL Mr. Pete Benjamin U.S. Fish & Wildlife Service October 1, 2020 Page 2 In addition to the pedestrian field survey, an Information for Planning and Consultation (IPaC) report was pulled for the Project. The IPaC listed the West Indian manatee (Trichechus manatus), three bird species (piping plover [Charadrius melodus], red knot [Calidris canutus rufa], and red -cockaded woodpecker [Picoides borealis]), five reptile species (green sea turtle [Chelonia mydas], Kemp's ridley sea turtle [Lepidochelys kempii], leatherback sea turtle [Dermochelys coriacea], and loggerhead sea turtle [Caretta caretta]), and five flowering plants (Cooley's meadowrue [Thalictrum cooleyi], golden sedge [Carex lutea], pondberry [Lindera melissifolia], rough -leaved loosestrife [Lysimachia asperulaefolia], and seabeach amaranth [Amaranthus pumilus]) as potentially occurring in the Project Study Area. Additionally, one bird species (eastern black rail [Laterallus jamaicensis ssp. Jamaicensis]) was listed as proposed threatened and one reptile species (American alligator [Alligator miss iss ippiensis]) was listed as threatened due to similarity of appearance (Table 1). There were no proposed critical habitats documented on the IPaC. Additionally, a desktop review was performed using aerial imagery, USFWS National Wetlands Inventory (NWI) data, U.S. Department of Agriculture Natural Resources Conservation Service (NRCS) 2017 Web Soil Survey for Onslow County, NC, and United States Geological Survey (USGS) National Hydrography Dataset (NHD) data. Source: U.S. Fish and Wildlife Service — http:Hecos.fws.gov/ipac/, Accessed August 04, 2020; ANALYSIS BY SPECIES This habitat assessment includes species under the jurisdiction of the USFWS and protected by the ESA (16 U.S.C. 1531 et seq.). The USFWS IPaC was used to identify federally protected species with potential to occur in the Project area (https://ecos.fws.gov/ipac/). The West Indian manatee, piping plover, red knot, red -cockaded woodpecker, green sea turtle, kemp's ridley sea turtle, leatherback sea turtle, loggerhead sea turtle, Cooley's meadowrue, golden sedge, pondberry, rough -leaved loosestrife, and seabeach amaranth were listed as federally endangered and identified by IPaC as species protected by the ESA. No designated critical habitat for these federally protected species is located within the Project area. Additionally, the bald eagle (Haliaeetus leucocephalus), which is federally protected by the Bald and Golden Eagle Protection Act (BGEPA) (16 U.S.C. 668), was evaluated. If impacts to migratory bird species are anticipated, it is recommended that construction be restricted during NC's migratory bird nesting season (April 15 — September 15). No nests were observed during the September 2019 environmental field surveys. Mammals The federally threatened West Indian manatee commonly prefers fresh, brackish, or marine habitats, including shallow coastal bays, lagoons, estuaries, and inland rivers of varying salinity extremes. The Study Area is located within previously developed urban and suburban areas and existing NCDOT right-of-way (ROW). There is one freshwater stream crossings along Route 1324, however this location did not display suitable habitat conditions. Additionally, impacts at this location will be avoided by use of horizontal directional drill (HDD). Based on a lack of BURNS;&MGDONNELL Mr. Pete Benjamin U.S. Fish & Wildlife Service October 1, 2020 Page 5 suitable habitat along the Study Area, the Project is not anticipated to result in adverse effects on the West Indian manatee or suitable West Indian manatee habitat. Birds The federally threatened piping plover and red knot typically prefer areas along ocean shores such as coastal beaches, sandflats, and mudflats. Furthermore, the red knot also is known to in- habit salt and freshwater marshes, lagoons, mangrove swamps, and shorelines of large lakes. These habitats were not observed within the Study Area during the field survey. Therefore, the Project is not anticipated to result in adverse effects to the piping plover and red knot, or suitable habitat for either species. The federally endangered red -cockaded woodpecker prefers open pine forest habitat containing longleaf or southern pines. The red -cockaded woodpecker (RCW) excavates cavities exclusively in living mature pine trees. Suitable habitat requires pine trees with decayed heartwood and little to no mid -story growth. As stated previously, the Study Area was located within existing developed areas and maintained NCDOT ROW, therefore no suitable habitat was observed within the Study Area. Based on this observation, the Project is not anticipated to result in adverse effects on the RCW or suitable RCW habitat. Bald Eagle The BGEPA prohibits take of bald eagles. Bald eagles are year-round residents in Onslow County, NC. The Survey Corridor does not intersect any major reservoirs or rivers that could be used by nesting eagles. If active bald eagle nests are observed, PNG will work with the USFWS to prevent disturbance and stay within federal and state regulatory compliance. Based on a lack of suitable habitat along the Study Area, the Project is not anticipated to have adverse effects on bald eagles. Reptiles Suitable habitat for the federally threatened green sea turtle and loggerhead sea turtle consists of shallow waters, bays, and inlets as well as lagoons and shoals. Additionally, the loggerhead sea turtle prefers salt marshes, creeks, and mouths of large rivers. Most of these habitat types were not observed within the Study Area. The Project will cross the mainstem of Wolf Swamp, however this area did not appear to be suitable habitat. Furthermore, the crossing will be conducted via horizontal directional drilling (HDD) and will not result in any impacts. Therefore, the Project is not anticipated to result in adverse effects to the green sea turtle or loggerhead sea turtle. The federally endangered Kemp's Ridley sea turtle typically prefers inshore habitats containing muddy or sandy bottoms. The endangered leatherback sea turtle typically prefers pelagic waters and sandy nesting beaches with proximity to deep waters. These habitat types were not observed within the Study Area. Therefore, the Project is not anticipated to result in adverse effects to the Kemp's Ridley or leatherback sea turtles. BURNSlkME-DONNELL Mr. Pete Benjamin U.S. Fish & Wildlife Service October 1, 2020 Page 6 Flowering Plants The federally endangered golden sedge typically occurs within the ecotone between the pine savanna and adjacent wet hardwood or hardwood/conifer forest. Pondberry typically prefers bottomland and hardwood wetlands and depressional features in more coastal areas. Rough - leaved loosestrife typically prefers edges between longleaf pine uplands and pond pine pocosins, as well as deep peat in low shrub communities of large Carolina bays. The federally threatened seabeach amaranth typically prefers barrier beaches with overwash flats and lower developing dunes. The habitats listed for each of these species was not observed within the Study Area. The federally endangered Cooley's meadowrue typically prefers grass -sedge bogs and wet pine savannahs as well as roadside ditches, woodland clearings, and powerline rights -of -way. Roadside ditches are present within the Study Area, however they exist within currently maintained utility easements. Therefore, the Project is not anticipated to result in adverse effects to Cooley's meadowrue, golden sedge, pondberry, rough -leaved loosestrife, or seabeach amaranth. CONCLUSIONS Based on the results of the habitat assessment, Burns & McDonnell has concluded that the proposed Project is not likely to adversely affect federally listed species. (Burns & McDonnell), on behalf of Piedmont Natural Gas (PNG) has prepared the following request for consultation under Section 106 of the National Historic Preservation Act for the proposed Highway 17 NCDOT Distribution Replacement Project Ramsey Road (Project) in Onslow County, North Carolina (Figures 1 and 2). The proposed area of potential effects (APE) is located at 34.810566,-77.380336 and totals 11.3 acres. The Project includes installation of approximately 17, 250 feet of 8-inch medium -dense polyethylene (MDPE) natural gas distribution pipeline. The pipeline will be constructed within new 15-foot-wide permanent easement and utilize 20-foot-wide temporary easements during construction. The pipeline will be constructed via a combination of open cut and bore methods. The proposed depth of impact is between 3 and 15 feet. The proposed limits of disturbance (LOD) are shown in the accompanying LOD kmz. The proposed Project, which will result in impacts on waters of the U.S., will require a Nationwide Permit 12 from the U.S. Army Corps of Engineers (USACE), Wilmington District. Piedmont Natural Gas has not submitted its permit application with the USACE regarding this Project, however, due to project time constraints, the application may be submitted prior to SHPO concurrence. This project review letter compiles known cultural resources in the Project vicinity. BACKGROUND REVIEW Burns & McDonnell reviewed previously recorded cultural resources and surveys within a Study Area extending 1 mile beyond the Project (Figure 3) Burns & McDonnell received record search results from the North Carolina Office of the State Archaeologist (OSA) for the Project on September 10, 2020. Burns & McDonnell also reviewed the State Historic Preservation Office's (SHPO's) HPOWEB GIS service application online for non -archaeological historic -age resources within the Study Area on September 11, 2020. No previous surveys are documented within the APE. Four historic -age non -archaeological resources and four archaeological sites were identified within the 1-mile Study Area (Figure 3; Tables 1 and 2). The Benjamin Lee Parker House (Resource ON0419) is mapped within the eastern terminus of the APE at the intersection of U.S. Hwy 17 and Kellum Loop Road. A review of available aerial imagery indicates a building stood at that location until 2003 but was no longer extant by 2005. All of the previously recorded historic -age resources were recorded in 1987 and none have been assessed for NRHP eligibility. No additional information about the resources was available on HPOWeb. No additional information was available in the file provided by OSA. None of the sites appear to have been assessed for NRHP eligibility. Geological Survey (USGS) topographic maps of the APE indicates that several buildings stood at the intersection of Ramsey Road and Drummer Kellum Road near the center of the APE by 1943 but are no longer extant by 1977/1978 (USGS 1943, 1977, 1978). At least three cemeteries associated with the community are also depicted on these later maps, though all are outside the proposed APE (USGS 1977 and 1978). Ramsey Road in its current configuration was built between 1956 and 1977 (NETR 2020, USGS 1977). It appears many of the buildings were razed prior to or during its construction. The proposed Project would be underground and has little potential to impact historic -age non -archaeological resources. The proposed Project crosses Wolf Swamp east of the intersection of Ramsey Road and Drummer Kellum Road. Soil along this perennial stream is mapped as Muckalee loam (MRCS 2020). These alluvial soils may have potential to harbor buried archaeological deposits, however, may be disturbed from construction of the structure carrying Ramsey Road across the stream. The map and imagery review also showed land use in the Project vicinity may affect the likelihood of intact archaeological sites crossed by the Project. Most of the eastern half of the Project has been under cultivation since at least 1956, while the western portion appears to be active timber plantation. Archaeological deposits, if present, are likely to be disturbed. Your review of and comments on this records review for the Piedmont Natural Gas Highway 17 NCDOT Distribution Replacement Project Ramsey Road is appreciated. A USACE Nationwide Permit 12 is anticipated for the Project, and the USACE has previously requested that Piedmont Natural Gas should follow your recommendations regarding any additional cultural resources surveys. APPENDIX H - PNG PERMANENTLY MAINTAINED ACCESS CORRIDOR PROTOCOL PIEDMONT NATURAL GAS Permanently Maintained Access Corridor Protocol To Comply with NC Water Quality General Certification No. 4133 To comply with the NC Water Quality General Certification No. 4133 condition for permanent maintained access corridors in wetlands and across stream channels to not exceed 30 feet wide for gas utility lines, Piedmont Natural Gas has implemented the following protocol. Piedmont Natural Gas does not use herbicides to maintain vegetation on permanent access corridors. Mowing equipment and tree trimming equipment is utilized where feasible to ensure there is a clear line of sight of the pipeline corridor to perform inspections per Pipeline and Hazardous Materials Safety Administration (PHMSA) regulations. Much of the inspections are conducted using aerial patrols which is why it is important to ensure the tree canopy does not cover the pipeline corridor. Piedmont Natural Gas right-of-way(ROW) maintenance staff utilize GIS software to identify permanent access corridors based on recorded property easement data imported to the company internal asset management system. Note, the ROW maintenance staff do not use construction or permit drawings to plan maintenance activities. Once a project obtains environmental permits and/or approvals, the shapefile data of the jurisdictional features delineation is imported to the internal asset management system, displaying on an environmental layer which allows the jurisdictional boundaries viewable by the ROW maintenance staff when planning maintenance activities. Piedmont Natural Gas ROW maintenance staff have been trained on the NC GC 4133 conditions for permanent maintained access corridors and are aware of the allowable maintenance widths. Often it is difficult to perform vegetation maintenance in wetlands and at stream channels where there is steep terrain or wet conditions limiting vehicular use resulting in less than 30 feet maintained, thus complying with the NC GC 4133.
