NORTH CAROLINA DIVISION OF WATER QUALITY
PUBLIC NOTICE is hereby given that Duke Energy Carolinas, LLC North Carolina, has applied to the
North Carolina Division of Water Quality for a Water Quality Certification pursuant to Section 401 of the
Federal Clean Water Act and Water Quality Commission rules in 15A NCAC 2H 1300. The activity for
this Certification is sought to relicense the Mission hydroelectric plant on the Hiwasee River in Macon
County. The application refers to water quality-related provisions of the Tuckaseegee Settlement
Agreement dated December 2003 as proposed conditions of the 401 Water Quality Certification. The
application discusses water quality-related improvements that are planned to the hydroelectric facilities
including minimum flow release, water quality monitoring and compensatory flow mitigation. A draft 401
Certification is also available for review.
The public is invited to comment on the above-mentioned application and Certification to the Division of
Water Quality. Comments shall be in writing and shall be received by the Division no later than May 28,
2010. Comments should be sent to the N.C. Division of Water Quality, Non-Discharge Branch, 2321
Crabtree Boulevard, Suite 250, Raleigh, NC 27604, Attn: John Dorney (919-733-9646 Fax: 919-733-
6893). A copy of the application is on file at the Division office at 2090 US Highway 70, Swannanoa, NC
28778 (Asheville Regional Office fax 828-299-7043) through Mr. Kevin Barnett during normal business
hours from 8:00 a.m. to 5:00 p.m., Monday through Friday, and may be inspected by the public.
