The Wilmington District, Corps of Engineers (Corps) has received a prospectus
describing the establishment of a wetland compensatory mitigation bank known as the
Pancho Stream and Wetland Mitigation Bank located northeast of Newton Grove and
southwest of Princeton, adjacent to and including Kennedy Mill Branch, in Wayne
County North Carolina.
Specific plans and location information are described below and shown on the attached
plans. This Public Notice and all attached plans are also available on the Wilmington
District Web Site at www.saw.usace.army.mil/wetlands

The Corps will evaluate this prospectus and the establishment of the Pancho Stream and
Wetland Mitigation Bank in accordance with the procedures outlined in 33CFR Part 332
Compensatory Mitigation for Losses ofAquatic Resources. Additionally, this proposal
will be reviewed pursuant to the permitting authority under Section 404 of the Clean
Waters Act if construction involves the discharge of fill material in waters and/or
wetlands of the United States.
Location
The 104 acre property is located on the north and south sides of Stevens Mill Road
(NCSR 1008), northeast of Newton Grove and southwest of Princeton, adjacent to and
including Kennedy Mill Branch, in Wayne County, North Carolina. The property is
located on the south side of the Wayne/Johnston County line.

Applicant's Stated Purpose
The bank sponsor proposes to establish and operate a wetland and stream compensatory
mitigation bank to compensate for losses authorized by applicable federal and state
regulatory programs.
Project Description
The sponsor proposes a combination of restoration, enhancement and preservation of
streams and wetlands on the property. Proposed actions include removing livestock from
the stream, stream banks, wetlands and floodplain, eliminating application of fertilizer
and pesticides and establishing a riparian buffer adjacent to streams and wetlands. As
proposed, an estimated 104 acres of stream and riparian forested wetland restoration,
enhancement and preservation may be realized as a result of the project. Upon execution
of the mitigation banking instrument, a conservation easement for the site will be
conveyed to an appropriate public land trust organization.
The proposed Geographic Service Area for this bank includes the 8 -digit hydrologic unit
code (HUC) from the Lower Neuse River, HUC 03020201. The proposed bank may
provide wetland and stream mitigation credits for Section 404 authorized impacts.
Evaluation and Commenting Information
The Corps of Engineers is soliciting comments from the public; Federal, State and local
agencies and officials, including any consolidate State Viewpoint or written position of
the Governor; Indian Tribes and other interested parties in order to consider and evaluate
the establishment of the Pancho Stream and Wetland Mitigation Bank. Any comments
received will be considered by the Corps of Engineers in evaluating the approval of this
bank. All factors which may be relevant to the proposal will be considered including the
cumulative effects thereof, among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historic properties, fish and wildlife values, flood
hazards, flood plain values (in accordance with Executive Order 11988), land use,
navigation, shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safety, food and fiber production, mineral needs,
considerations of property ownership, and, in general, the needs and welfare of the
people.
The Corps has reviewed the proposal and has examined all information provided by the
sponsors. Preliminary review of this proposal indicates the following: 1. An
environmental impact statement (EIS) will not be required. 2. No listed species of fish,
wildlife, or plant (or their critical habitat) listed as endangered or threatened under the
Endangered Species Act of 1973 are expected to be effected by the construction of this
bank; and 3. No cultural or historic resources considered eligible or potentially eligible
for listing on the National Register of Historic Places are located within the proposed
project site. Accordingly, the Corps is making a "no effect" determination for threatened
and endangered species and for cultural and/or historic resources at this time.
