Determination
Dear Mr. Spencer:
Please find enclosed our submittal package for a Preliminary jurisdictional Determination.
Field work for this determination was completed on October 1, 2009. The site is located near
the intersection of Longstreet Road and W Luzon Drive in Fort Bragg, Fayetteville, NC. The
project involves the removal of an existing stormwater CMP and restoration of Tank Creek.
The wetland has been delineated by McKim and Creed as a PFO, directly abutting relatively
permanent waters. Additional wetland boundaries upstream of the CMP culvert were
provided to McKim and Creed by the ACE. Total stream impacts are 377 feet with
approximately 550 linear feet of new stream created. This is a net increase in stream length of
173 linear feet. Total wetlands impacted are 0.68 acres.

Project will consist of removing 96" CMP and restoring Tank Creek. Stream side slopes will be laid back and stabilized
with erosion control matting. A Rosgen Priority 1 bankfull bench will be created. Log drops structures will also be placed
in the stream to dissipate energy. Abandonded railroad bed will be sloped 3:1 to new restored stream.

Wetland Delineation for CMP Removal for Abandoned Railroad Bert at Tank Creek February, 2010
1.0 Introduction
This report provides a description of wetlands identified by McKim & Creed on a site
visit on October 1, 2009 to the CMP Retnoval for Abandoned Railroad Bed at Tank Creek.
The project site is located near the intersection of Longstreet Road and W Luzon Drive
in FT Bragg, Fayetteville, NC. Upstream of the project area lies a wetland which has
been delineated by Fish and Wildlife Service (from now on referred to as FWS) as
PSS4A; see Exhibit #1. Downstream of the project area lies a wetland also delineated by
FWS as a PFO1Ad.
The conservation of wetland and stream resources is a significant component of land
development and an essential element of sound land stewardship. The wetland/stream
at the CMP Retnoval site is protected as follows:
Section 404 of the Federal Clean Water Act prohibits the discharge of dredge or fill
material in waters of the United States without authorization from the U. S. Army

Corps of Engineers. Section 10 of the Federal Rivers and Harbors Act of 1899
prohibits the obstruction or alteration of navigable waters of the United States
without a Corps permit. This means that no activity can occur in wetlands or
streams without Corps permission.
The first step in obtaining approval for activities that may impact wetlands and streams
is the accurate delineation of wetland and stream resources. This report provides
information needed by land planners, engineers, landscape architects, and federal, state
and county environmental regulators to insure the proper and legal conservation of
these resources. Wetlands and streams are dynamic natural systems that change in size
and function over time. The legal limits to the resources should not be considered
defined until the Army Corps of Engineers (ACE) has inspected the delineation and an
official letter has been received recognizing this delineation as accurate and complete.
The length of time this delineation is considered valid will be defined in the approval
letter and is usually five years.
2.0 Methods
The following definition of wetlands is the regulatory definition used by the U.S.
Environmental Protection Agency and the ACE in non-agricultural areas:
"Those areas that are inundated or saturated by surface or ground water at a
frequency and duration sufficient to support, and that under normal circumstances
do support, a prevalence of vegetation typically adapted for life in saturated soil
conditions. Wetlands generally include swamps, marshes, bogs, and similar
areas".
Three criteria must be satisfied for an area to be determined wetlands:
• Vegetation must be present which has the ability to grow, effectively compete,
reproduce, and/or persist in saturated soil conditions.
+ Hydric soils must be present as defined by indicator characteristics of prolonged
anaerobic and saturated conditions.
• Hydrology must be present which results in periodic inundation or prolonged
saturation of the biologically active portion of the soil.
The procedure used to delineate wetlands at the site is defined in the Interim Regional
Supplement to the Corps of Engineers Wetland Delineation Manalal: Atlantic and Gulf Coastal
Plain Region (Wetland Regulatory Assistance Program, 2008). Available data on

hydrology, soils, vegetation, and land use was obtained in various formats including
GIS and or online data servers; this data was obtained from various agencies. Detailed
soils descriptions were taken from the Soil Survey of Cumberland County, North
Carolina. National Wetland Inventory Maps were also utilized (see Exhibit 1) as well as
an on site inspection. The site is located in the Ira-ter Coastal Plain (LRR-P).
Field inspection of the property was conducted on October 1, 2009 during fair weather.
Observations were made in the field to identify any atypical conditions such as artificial
disturbances that may have influenced the presence of hydric soils or vegetation.
Representative observation areas were selected based on field judgment to determine
limits based on hydraulic gradient, plant community change, and obvious physical
topographic changes. Probable wetland areas were physically probed for the presence
of hydric soils. These soils were tested and deemed hydric or non-hydric based on field
observation per page 32-39 of the ACE Interim Regional Supplement (See photo below).
Vegetation, soils, and hydrology were examined at each of five (5) observation areas
indicated as WB-01 to WB-05, see Appendix B for Data Sheets. WB-01 was located
upstream of the culvert in an area previously delineated by others as a wetland. WB-02
thru WB-05 were located downstream of the culvert and are used as data for wetlands
as shown on exhibit entitled "Wetland Delineation at Railroad Bed near Longstreet
Road." The limits of wetlands were defined by placing sequentially pink flags along the
outer limit of the wetlar boundary.
Dominant plant species at each observation point are described in the data sheets under
Appendix A. Indicator status was assigned as defined in the National List of Plant Species
That Occur in Wetlands (Environmental Laboratory, 1987). Hydrophytic vegetation was
determined to be present when more than fifty percent of the dominant species had an
indicator status of obligate, facultative wet, or facultative, according to the "50-20" rule.
The prevalence index was also used to determine if hydrophytic vegetation is present,
methodology is described on page 25 of the ACE Draft Regional Supplement. The

prevalence index is a value which shows the prevalence of hydrophytic vegetation the
range is from 1 to 5, a value of 3 or less indicates hydrophytic vegetation is present.
Shallow soil excavations were made to a depth of 24 inches or refusal to determine if
hydric soil characteristics were present. Indicators of frequent flooding or prolonged
saturation which were searched for included the presence of organic soils, histic
epipedons, sulfic material, aquic or peraquic moisture regimes, and soil colors that were
gleyed or had a matrix chroma of two or less. Indicators of wetland hydrology which
were searched for included visual observation of soil satiation, water marks, drift
lines, sediment deposits, and drainage patterns. The vegetation, soil, and hydrologic
features documented were used to characterize wetlands according to the U. S. Fisli and
Wildlife Service Classification of Wetlands and Deep Water Habitats, (Cowardin, 1979) as
well as the North Carolina Division of Coastal Management (DCM) Wetland Mapping in
Coastal North Carolina (1999).
3.0 Results
Wetland (adjacent to a PSS4A, PFO1Ad, and RPM
The wetland lies at the base of a fairly steep bluff tapering down from a railroad bed,
the area then flattens out into a flat floodplain area which meets all three ACE criteria;
obvious hydrologic support, a dominant hydrophytic plant community and obvious
hydric soils, see Photo 2. This wetland area is abutting Tank Creek which is considered
a Relatively Permanent Waters (RPW). This area is dominated by loblolly pine (Pinlts
taeda), Chinese Privet (Ligustrurn sinense), Sweet Bay (Magnolia virginiana), and other tree
species within a sluggish backwater area between the culvert tinder the abandoned
railroad bed and a culvert under Longstreet Road.

Perennial Stream (RPW)
Tank Creek is assessed as being perennial based on the NC Division of Water Quality Stream
Identification Form. As seen from the photos within Appendix B there is a high abundance of
a photo algae, which identifies this stream holds water for significant portions of the year. This
reach was scored at 48.8 points in the downstream portion below the railroad bed and culvert,
per the North Carolina Division of Water Quality Stream Identification Form (see Appendix B);
a score between 20 and 29 is considered an indication of an intermittent stream (<=19 is
ephemeral, >=30 is considered perennial). The USACE Stream Quality Assessment worksheet
was also conducted were this reach received a score of 61. Therefore both methods yield
perennial scores based on the field assessment.
4.0 Conclusion
Five wetland test points (WB's) were conducted to verify limits of wetlands; location of
WB's are shown on the exhibit titled "Wetland Delineation at Railroad Bed near
Longstreet Road." and data for each can be found in Appendix A as recorded on ACE
Routine Wetland Determination data forms (Appendix B). As a conservative
approximation of the boundary the top of bank line was used for the platting of the
wetland boundary.
In the previous section, jurisdictional wetlands located on the Fort Bragg Culvert
Replacement Project site property are defined. The limits of wetland resources should
be confirmed by the ACE prior to proceeding with plans to impact this site if impact
will be close to or within the flagged wetland limits. We strongly recommend
minimizing wetland and stream disturbance to the greatest extent possible,

This project involves the removal of an existing collapsed corrugated metal pipe,
located under an abandoned railroad bed. After removing the culvert the project
encompasses a variety of stream restoration methodologies to mimic per existing
conditions before the railroad bed existed. The design team has selected a Rosgen Type
1 restoration in order to establish an adequate floodplain to deposit sediment, dissipate
energy, and provide habitat.

The BAg horizon, where present, has hue of 10YR,
=value of 5 through 7, and chroma of 1 or 2. Few to
common yellow and brown mottles are present in some
!;pedons. The BAg horizon is loam or silt loam. The Btg
=horizon has hue of 1OYR, value of 5 to 7, and chroma of
1 or 2. Mottles are in shades of yellow, brown, or red.
The Btg horizon is clay loam or loam.
The BCg horizon is similar to the Big horizon in color
and texture. It is gray and contains yellow, brown, and
red mottles in most pedons. It is variable In texture. It
consists of layers of sand, sandy loam, sandy clay loam,
silty clay loam, or clay.
Johnston Series
The Johnston series consists of vary poorly drained
soils that formed in loamy, stratified fluvial sediment on
flood plains along streams. This soil is on the Coastal
Plain. Slope Is less than 2 percent.
Typical pedon of Johnston loam, in Cumberland
County, Is approximately 8 miles southeast of
Fayetteville, 0.2 mile west of the Intersection of State
Road 2018 and State Road 2019 along State Road
2018, and 100 feet north of the road;
A--O to 42 Inches; very dark gray (10YR 3/1) loam;
weak fine granular structure; friable, strongly acid;
clear wavy boundary.
ACg-42 to 52 inches; dark grayish brown (10YR 4/2)
sandy loam; massive; friable; strongly acid; clear

Cg--52 to 80 inches; light brownish gray (10YR 6/2)

' The Kalmla series consists of well drained soils that
formed in sandy fluvial sediment on terraces of Lower
Little River and Rockfish Creek. Slope ranges from 0 to
2 percent.
Typical pedon of Kalmla loamy sand, 0 to 2 percent
slopes, In Cumberland County, about 5 miles south of
Fayetteville on U.S. Highway 301, 2.5 miles east on

State Road 2220, 0.2 mile northwest along farm road,

through 6, and chroma of i or 2. The E horizon has hue
of IOYR, value of 5 through 8, and chroma of 3 or 4, or
it has hue of 2.5Y, value of 6, and chroma of 4.
The St horizon has hue of 10YR, value of 5 or 6, and
chroma of 4 through 8; or it has hue of 7.5YR, value of
5, and chroma of 6 through 8. It Is sandy clay loam or
sandy loam.
The C horizon Is sand or loamy sand. Few to common,
fine and medium pebbles are present In some pedons.
Kenansville Series
The Kenansville series consists of well drained soils
that formed in loamy, fluvial sediment on terraces along
Lower Little River and Rockfish Creek. Slope ranges
from 0 to 3 percent.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
11 pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
