Dear Ms. Karoly:
We are submitting the additional information requested from written
correspondence on May 25, 2006. We are requesting for NC Division of Water
Quality (NCDWQ) written approval under Section 401, Clean Water Act, 33 USC
1344. This will assist in compliance with Water Quality Certification (WQC) 3402
and it's accompanying Nationwide Permit (NWP) 39. We have addressed your
included written comments in the following paragraphs.
3. Please provide full plan sheets showing all level spreader locations at a
scale of no smaller than 1"=50' and clearly distinguishing Zone 1 and Zone 2
within the protected riparian buffer. It appears from the most recent plans you
have submitted (Drawing No. C3) that level spreaders are located within the
protected riparian buffer.
Please refer to three 11" x 17" Detail Sheets of the proposed level spreader
locations. Regarding the level spreaders surrounding the pond, Level Spreader # 1
is located on the John Mitchell Road side (South). A wooden structure is located
outside of Zone 2 and an earthen structure is placed immediately inside Zone 2.
The level spreaders located on the opposite side of the pond are both earthen
constructed, the lower one partially located in Zone 2 and the upper completely
outside of the riparian buffers. Details for all of these level spreaders are located on
the previously submitted level spreader worksheets and on Drawing No. C3 (Storm
Drainage and Erosion Control Plan). All non-earthen level spreaders will be placed
outside of riparian buffers. We have also highlighted the buffer line reflecting the
new pond elevation. Furthermore, the streets surrounding the pond will be
constructed without raised curbs to facilitate sheet flow.
The requested information on the previous pages and attached
documentation listed below should provide the necessary information required to
secure written concurrence for impacts to Neuse River Buffers, streams, and
wetlands; and meet requirements for GC's 3402 under DWQ 401 Water Quality
