The town was issued its first MS4 permit in 2007. China Grove continues to improve and expand the scope of the stormwater management program. Currently the Town of China Grove funds the stormwater management program through the General Fund. This report details the Town of China Grove's Stormwater function for the 2019-2020 reporting period. A. Program Implementation 1. The 2019-2020 budget of $10,000 was not adequate to support a compliant MS4 program. The stormwater administrator will promote and present a five-year plan to increase the budget and overall scope of the stormwater program. 2. The Town of China Grove implements its stormwater plan and evaluates the performance every year through the annual report. Over the next five-year permitting period the Town of China Grove will collect more information during program implementation to analyze the effectiveness and cost of the program functions. 3. The Town of China Grove has not updated the Stormwater Management Plan since 2012. Beginning with the 2020-2021 reporting period the Town of China Grove will update the Stormwater Management Plan at least on an annual basis. 4. The Town of China Grove maintains a robust Stormwater website with information for residents and developers. The current Stormwater Management Plan is not on the website. Upon approval, the new Stormwater Management Plan will be made available. The Stormwater Administrator has a paper hard copy available for review upon request. 5. The Town of China Grove will submit all Stormwater Management Plan changes to the division for review and approval prior to adoption. 6. Rowan County implements the Construction Site Runoff minimum control measure on behalf of the Town. Currently there is no document showing an official agreement between the town and county. The Stormwater Administrator is working with Rowan County to develop an agreement. Rowan County has implemented minimum control measures on construction site on behalf of the town since the 1970's. The Town of China Grove monitors and inspects construction sites to mitigate illicit discharges from runoff. The Town of China Grove is a member of the Regional Stormwater Partnership of the Carolinas. The RSPC is a non-profit organization dedicated to stormwater education in the Charlotte -Metro region. The RSPC advertises on regional tv and radio stations to promote stormwater awareness and a pollution hotline/reporting mechanism. 7. The Town maintains written procedures for the implementation of the six minimum control measures. Our procedures are compiled into the Stormwater Administrators Handbook. B. Public Education and Outreach BMPs for Public Education and Outreach 1. The Town of China Grove is dedicated to the education of residents and businesses across sectors. Our public education and outreach program includes a broad range of 3 1 P a g e information from general stormwater information to industry specific information targeting specific pollutants. 2. Through the process of identifying target pollutants and stressors the town has concluded that the likely issues and pollutants in China Grove include household chemicals and petroleum products, construction runoff, and restaurant based illicit discharges from outdoor washing and dumpster maintenance. 5. The Town of China Grove maintains an information website that is frequently updated with the most current information available. The Stormwater Program website is promoted on the stormwater truck, on planning business cards, and at 19 town sponsored events each year. 6. Throughout the reporting period the Town of China Grove distributes a variety of general and industry specific flyers, posters, post cards, brochures, and booklets. The Town of China Grove maintains and promotes a reporting website/email and hotline. 8. The Town of China Grove maintains an on -going public education and outreach program which looks for new ways to promote best practices for residents and business. The Town is an active member of the Regional Stormwater Partnership of the Carolinas which promote education and water quality in the Charlotte -Metro Region. The available education resources increase each year. The town will continue to develop new materials and test new media. The town maintains a website, Facebook, and Instagram profiles. A social media campaign will be implemented in year one. Unfortunately, mailed materials will still be 5 1 P a g e necessary to target specific industries and target pollutants. The town will work hard to implement a cost effective and targeted educational program. C. Public Involvement and Participation 1. The town currently promotes and conducts a volunteer drain marking program. In 2020 an Eagle Scout candidate volunteered and coordinated a marking and inventory project painting No Dumping information on 75 catch basins in the Grants Creek Drainage Basin. 2. The Town will continue to improve the public involvement and participation opportunities using social media -based monitoring programs. 3. The Town of China Grove maintains and informational website with hotline and email -based reporting mechanisms. Analysis of Performance and Effectiveness The current Public Involvement and Participation program is only partially compliant. The town will develop a social media -based creek and pollution monitoring program in year one of the new permit. The town will continue to maintain our website with the most up to date reference materials available. The town will continue to advertise and maintain our hotline and website pollution reporting mechanisms. D. Illicit Discharge Detection and Elimination (IDDE) 1. The Town of China Grove Stormwater Quality Management and Discharge Control ordinance is located within the Town Code and maintains adequate regulatory mechanisms to prohibit illicit discharges and enforce penalties for violations of the IDDE program. 2. The Town of China Grove maintains and complete storm sewer system map locating and identifying gravity mains (size and material) and catch basins. The major outfalls are easily identified. All streams are mapped as part of the National Flood Insurance Rate Maps. 3. The Town of China Grove currently inspects major outfalls but does not have a written procedure. There is a check list available for the Stormwater Administrator to reference. The inspections are then stored and inventoried within the town's iWorq system. The written procedure is in progress in a draft format and will be available as a year one goal of our new permit. 4. The Town of China Grove does not have a written procedure for IDDE investigations. However, the Stormwater Administrator and Code Enforcement Officer will conduct investigations of possible illicit discharges. The Town does maintain a database which tracks illicit discharge investigations from start to finish. The database tracks information including responsible party, NOVs, clean-up remedies, and educational information distributed. 5. The Town maintains a database to thoroughly track illicit discharges. Refer to number 5 above. 6. The Town trains employees and has posted posters including reporting mechanisms. 7. The Town of China Grove has identified specific industries and business which are likely to contribute to stormwater pollution. The Town has tailored the public 6 1 P a g e education and outreach program to educate the public of the hazards associated with illegal discharges and improper disposal of waste. 8. The Town of China Grove uses the iWorq system to track all NOVs including stormwater NOVs. In this reporting period the Stormwater Administrator issued two notice of violations: 1) for the illegal discharge of washing machine water into a ditch, 2) pouring motor oil into grass. Analysis of Performance and Effectiveness The town's IDDE program is functionally operational and effective. The town actively trains staff to recognize and report illicit discharges to the Stormwater Administrator. The Stormwater Administrator has systems in place to document and inventory violations. Tracking complaints and violation from initial report to conclusion. E. Construction Site Runoff Controls 1. The Town of China Grove delegates the Erosion and Sediment Control Program, through agreement, to Rowan County. The Town of China Grove understands we are responsible for the successful implementation of this control measure through oversight. We monitor active construction sites to mitigate stormwater impacts. The Town includes educational information for construction site waste management with commercial zoning permits. F. Post -Construction Site Runoff Controls 1. The Town maintains legal authority through Town Code and Chapter 8 of the UDO. 2. The Town of China Grove requires long-term operation and maintenance agreements for Stormwater Control Measures (SCMs). The Town of China Grove requires annual inspection reports to be submitted annual on the anniversary of the SCM entering service. The inspection must be performed by a qualified inspector. 3. The Town of China Grove contracts with McGill and Associates for Stormwater Plan reviews. McGill and Associates also serve as a technical consultant and resource to ensure compliance with the Post -Construction measures. 4. The Town of China Grove maintains an inventory of structural BMPs within the corporate limits. 5. All surety guarantees, operation and maintenance agreements, and BMPs are recorded in the Rowan County Register of Deeds Office. 6. The Town requires a recorded operations and maintenance plan for each structural SCM. 7. The Town of China Grove conducts regular after storm inspections of each structural SCM. When maintenance or repair is needed the Stormwater Administrator is able to send an inspection report documenting the findings to the responsible party. 8. The Town of China Grove has adopted a Post -Construction Manual to serve as a reference for staff, and developers which includes checklists, requirements, and standards. The manual is available on our user-friendly website. 9. The Town of China Grove issues reminder letters for annual inspections. The Town also maintains the iWorq system to track inspections and violations of structural stormwater control measures. 7 1 P a g e G. Pollution Prevention and Good Housekeeping for Municipal Operations 1. The Town of China Grove inspects each municipal facility on a quarterly basis, and whenever an issue arises. The Stormwater Administrator will inspect each facility using the standardize form within the iWorq system. Any illicit discharges, or potential stormwater polluting situations shall be documented and reported to the responsible department head. 3. The Town has developed and implemented a spill response plan and reporting mechanism. 4. The Town of China Grove cleans paved municipal facility parking lots regularly using a landscaping contractor. The town has recently begun a street sweeping program collecting 16 tons in materials over two days of continuous sweeping. Over the next permit term, the frequency of street sweeping is expected to increase. 5. The Town of China Grove inspects catch basins on a weekly basis as part of our on- going maintenance operations. When a major storm is forecast the Public Works department will inspect and clean catch basins in flood prone areas. 6. The Town does not own or maintain and Structural Stormwater Control measures. 7. Not Applicable 8. Town staff, and contractors whom apply herbicides, or pesticides maintain the proper education and licenses. The Stormwater Administrator keeps copies of the license on file. The Town of China Grove, in year one of the new permit, is taking corrective action and installing a secondary containment system for our herbicide storage. 9. In year one of the new permit the Town of China Grove will develop regular Good Housekeeping trainings for employees. The Town of China Grove minimizes stormwater runoff from vehicle and equipment washing/clean by using commercial carwashes, washing equipment in graveled storage yards, and utilizing sanitary sewer drains whenever possible. H. Total Maximum Daily Loads 1. The Town of China Grove does not discharge into a receiving water within a TMDL watershed. Overall Program Assessment The Town of China Grove operates a functioning Stormwater Quality and Management Program which largely meets the intent of the NPDES Permit. After reviewing our audit and self -audit we realize the program is not compliant. Over the first year of the next permit period we will develop and implement written procedures and an IDDE investigation process. Assessment of Compliance with NPDES Permit The Town of China Grove received a Notice of Violation, on October 14t', 2020, for missing key procedural documentation. The Town of China Grove intends to take corrective action and adopt procedures for Illicit Discharge Detection and Elimination inspection and reporting in the first year of the next permit. Assessment of Legal Authorities The Town of China Grove maintains adequate legal authority to enforce our polices and assess penalties through the following sources: Chapter 54 Article V. Stormwater Quality Management and Discharge Control Unified Development Ordinance Chapter 8 The Town will assess and update these ordinances annually and update as needed. The appeals process needs to be amended to direct stormwater appeals to the board of adjustment. Currently the appeals process relies on an appointed hearing officer. The board of adjustment provides residents with a more objective appeals process. Inspections The Town of China Grove stormwater administrator conducts the following inspections routinely: SCM After Storm Inspections, IDDE/Complaints. Over the next permit period the following inspections and procedures shall be implemented: Municipal Facilities, Dry Weather Flow, O and M of SW drainage network, Industry Specific, Containers/Dumpsters. We also 9 1 P a g e expect the frequency of these inspection to increase over the next permit term as documentation and reporting becomes increasingly automated and streamlined through the iWorq system. Enforcement Actions The Town of China Grove has adequate enforcement abilities within the adopted legal authorities. Fiscal Analysis The stormwater programs budget for the 2019-2020 fiscal years was $10,000. The Town of China Grove works hard to utilize cost effective BMPs to educate and engage with residents and developers. In order to gain compliance with our MS4 permit the town needs to increase program funding. 101Page
