Wilson, P.E., Environmental Engineer�� Subject: RD-Penrose 1, LLC 4 MW Biomass Electric Facility NCDENR Project No. 13-0344 Environmental Review Comments Transylvania County RD-Penrose 1, LLC has applied for a certificate to construct a 4 MW Biomass Electric Generating facility in Penrose, Transylvania County, NC. The following concerns may, or will likely, need to be addressed: If the discharge of wastewater resulting from the process is necessary, it should be properly permitted through the Division of Water Quality. Alternatives to direct discharge must be investigated. It is unclear from the information provided if discharge of wastewater, cooling water, or domestic wastewater will be necessary. 2. NPDES Construction Stormwater Permit NCGO 10000 — This permit is issued concurrently with an approved Sediment and Erosion Control plan to control stormwater discharges from construction activities. If the project will disturb greater than one acre, an NCG010000 permit is required. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers, a 401 Water Quality Certification is necessary. Depending on the amount of impact to streams and/or wetlands along the proposed route — written concurrence from this office may be required. The DWQ is unsure if jurisdictional waters or wetlands will be impacted by the proposed project — this should be confirmed prior to impacts to the site (it appears that much of the construction will be conducted on existing impervious area). Depending on the size and impervious surface of the total project, a stormwater management plan (or post -construction stormwater BMPs), may be required through the 401 Certification. Wilson, Environmental Engineer `,`V / Subject: USDA - Pisgah National Forest — Courthouse Creek Project Environmental Assessment Project No.: 13-0208 Transylvania County The USDA Forest Service wishes to address and update current conditions/resources in Pisgah National Forest, specifically the Courthouse Creek Project area. The Division of Water Quality, Asheville Regional Office, has no additional comments from those presented with the Scoping Comments, October 2011 (which are listed again, below). The Division of Water Quality has the following comments: The USDA should ensure that all Forestry Practice Guidelines are met/maintained during the project. 2. NPDES Construction Stormwater Permit NCG010000 —This permit is issued concurrently with an approved Sediment and Erosion Control plan to control stormwater discharges from construction activities. If the proposed project will disturb greater than one acre (and an approved Sediment and Erosion Control plan is necessary), an NCGO10000 permit is required. 3. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers (ACOE), a 401 Water Quality Certification is necessary. Depending on the amount of impact to a stream and/or wetland — written concurrence from this office may be required. From the information in the document, the Division understands that there may not be additional impacts to streams with replacements of culverts and bridges (this should be confirmed and the ACOE contacted if necessary). Wilson, Environmental Engineer Subject: Cottages at Brevard CDBG - Environmental Review Comments DENR Project No. 12-0211 Transylvania County The proposal is for the construction of a 48 unit family housing development off N. Broad Street in Brevard, NC (the document references PIN 8586-74-6503). The comments listed below are similar to DWQ's comments dated July 1, 2011. The following concerns may, or will likely, need to be addressed: NPDES Construction Stormwater Permit NCGO10000 — This permit is issued concurrently with an approved Sediment and Erosion Control plan to control stormwater discharges from construction activities. If the proposed project will disturb greater than one acre, an NCGO 10000 permit is required. 2. 401 Water Quality Certification — If a 404 permit is required by the Army Corp of Engineers (ACOE), a 401 Water Quality Certification is necessary. Depending on the amount of impact to a stream and/or wetland — written concurrence from this office may be required. It appears that waters have been identified and a 404 issued by the ACOE. It is the DWQ's understanding that post construction BMPs have been designed as required (ref. Condition 12 of Water Quality Certification 3821 associated with the NWP29 issued by the ACOE). 3. City of Brevard requirements —the project should comply with any applicable City ordinances. 4. Wastewater — The DWQ assumes that the complex can tie-in to the existing sewer system (contact the City of Brevard). Thank you for the opportunity to comment.
