This application is to construct the channel and 50-foot forested buffer relocation/restoration associated with the subject project (an unnamed tributary to Cross Creek). It is anticipated that that the stormwater management plans will be reviewed by the City under its NPDES Phase II Stormwater program. The City is qualified to be a certified review agency. The site appears to have received large amounts of historical fill. Several buildings were recently removed from the site. Vegetation is sparse. See the attached EA and FONSI for additional details. 3b. List the total estimated acreage of all existing wetlands on the property: None. 3c. List the total estimated linear feet of all existing streams (intermittent and perennial) on the property: Approximately 270 of an unnamed tributary and approximately 900 feet of Cross Creek 3d. Explain the purpose of the proposed project: The purpose is to create a place for North Carolina veterans of war and others. See attached EA and FONSI for details. 3e. Describe the overall project in detail, including the type of equipment to be used: The project will develop mostly open park space exhibits with a small visitors center and parking. Stormwater BMPs and stream buffers will be provided. A highly impacted, small unnamed tributary will be relocated and restored along the side of the property. Equipment will include that typical of small to medium sized land development projects. An Environmental Assessmnet and Finding of No Significant Impact document was submitted through the State Clearing House. The document was not required, but the City decided to submit it voluntarily. The agency comments are considered to be non- significant and are attached. The project will be located in a FEMA flooplain and floodway. The project is being reviewed by the City's Floodplain Manager, and a No-Rise Certification is anticipated. 4. Jurisdictional Determinations 4a. Also included in this project are improvements to traffic operations at the Rowan Street, Bragg Boulevard and Murchison Road intersection. Intersection improvements such as a roundabout are being considered to help establish a seamless flow of traffic at this location which at this time consists of various one-way street segments and overall is disjointed and somewhat awkward. In addition, the enhancement of this location will serve as a gateway into Downtown Fayetteville with the proposed Festival Park anticipated to be a major local and regional destination. Right of way acquisition for this project is scheduled for FY 2012 and construction is scheduled to begin FY 2014. The Project Development and Environmental Analysis Branch has recently held a scoping meeting to discuss the project with NCDOT staff and will soon begin preparing the Environmental Assessment document. The Transportation Planning Branch has also recently prepared a traffic forecast which shows current traffic volumes and estimated future traffic volumes needed to determine the proper roadway and pavement design plans needed for optimal traffic operations. Project Description The City of Fayetteville is proposing to create the North Carolina Veterans Park (the Park) northwest of downtown Fayetteville in a heavily urbanized area. The Park site is approximately 8.5 acres in size and is bounded by the existing Airborne and Special Operations Museum (ASOM) to the south, Cross Creek to the north, Bragg Boulevard to the west, and a railroad corridor to the east, as shown on Figure 1. The Park campus will include a visitor's center of approximately 3,500 square feet, a 1.5 acre plaza area with a variety of outdoor exhibits and 3 acres of parking and vehicular access, which includes 2.5 acres of existing parking currently used by the ASOM. The new parking area will continue to be shared with the ASOM. The visitor's center will have restrooms and house indoor exhibits. The plaza area may include outdoor exhibits such as interpretive walls and art pieces, gardens, water features, and walks, which will connect to a greenway, Freedom Trail, along Bragg Boulevard. Universal design/accessibility will be a major emphasis in designing the improvements. The proposed design of the Park is shown in Figure 6. The majority of the Park site is currently within highly disturbed and/or paved areas. Land development activities, including excavation, grading, placement of fill, and building construction, will be necessary to establish the visitor's center, plaza and outdoor exhibits, landscaping, greenway, parking, and vehicular access. Construction of the Park will also include the restoration of a short section of a highly degraded tributary that emerges from a pipe and flows along the east side of Hillsborough Street to Cross Creek. Stormwater runoff from the Park will be treated using bioretention areas and other infiltration devices designed to improve water quality. Additionally, a 75 foot-wide riparian buffer along Cross Creek will be improved through the removal of fill material and establishment of native vegetation along the stream banks to filter pollutants and improve bank stabilization. 2. Purpose of Proposed Project The purpose of the Park, as established in Senate Bill 1611 of the General Assembly of North Carolina, is to honor North Carolina Veterans and provide a community Park downtown, while enhancing the downtown Fayetteville area. Public funding for the Park was approved by the North Carolina State Legislature in July, 2008, and the Park program was developed by a team of North Carolina Veterans Park Environmental Assessment 1 September 2009 stakeholders that included veterans from all military branches. Program elements will reflect the experience and lives of North Carolina veterans and their families from all branches and time periods. The Park is not intended to be as much of a memorial as it is a gathering place for veterans to share their lives and experiences with one another and with their family and friends. The main purpose of the Park is best described in the following paragraph which is the vision statement for the project: "From the soils of North Carolina, they left their families and homes with the purpose to serve their country. In service, they made sacrifices. They are Veterans. Veterans and their relations reflect on and share their experiences ... and heal. They feel pride in their service and want the world to know. Veterans find the power to live their lives and bond with their fellow veterans. They find inspiration as North Carolina welcomes them home and honors them." 3. Alternatives Analysis Two alternatives are considered in this document - no build and build. The no build alternative would result in avoidance of all impacts, and no change to the environmental conditions evaluated in the document. Additionally, this alternative would forego any environmental benefit resulting from stream restoration, installation of stormwater treatments, and establishment of riparian buffers proposed by the project. The City of Fayetteville has proposed the project as a public amenity and, more importantly, as a way to honor North Carolina veterans. This project purpose is particularly relevant at this point in time, given the recent efforts of North Carolina's veterans. Because the no build alternative would not meet this stated objective, this alternative is not considered a viable alternative. The second (selected) alternative includes construction of the Park at the proposed site. Section 4 of this document identifies the existing conditions on the selected site, and Section 5 describes the anticipated impacts associated with this alternative. The proposed site meets the project North Carolina Veterans Park Environmental Assessment 2 September 2009 purpose, and is located in close proximity to downtown Fayetteville and to the adjoining ASOM. This provides the added benefit of adding on to existing parking facilities to meet the parking demands of both the ASOM and the Park. The land for the proposed site is currently owned by the City of Fayetteville, thereby avoiding the additional cost of land acquisition. Additionally, the Park is intended to draw visitors from all over the State. It is anticipated that the proximity of the site to adjoining transportation corridors provides easy access to the well traveled 1-95 corridor, making it a convenient stop for those passing through the area. Other project sites were not considered for the Park. An important component of the Park is that it will act as a northwest gateway to downtown Fayetteville. This condition essentially eliminates other project locations due to several factors. There are no available parcels to the north of downtown Fayetteville that provide the necessary space and access as the proposed site. Most parcels are privately owned, not large enough, or improperly zoned for the proposed use. Selection of another site would also result in environmental impacts that may be equal to or greater than those associated with the selected alternative. 4. Environmental Conditions Field reconnaissance of the proposed site was conducted by Kimley-Horn and Associates, Inc. in March, 2009 to assess existing site conditions. The project area is approximately 8.5 acres and has been historically developed, but currently consists entirely of paved and grassy areas. A building in the northwest corner of the project area, visible on Figure 2, has recently been demolished and removed from the site. Cross Creek marks the northern boundary of the property. An unnamed tributary to Cross Creek is located parallel to and east of Hillsboro Street and provides an outlet for stormwater runoff from downtown Fayetteville. Site photographs taken in January and April, 2009 are included with this document as Appendix A. 4.1 Topography The majority of the site is relatively flat at an elevation of approximately 110 feet above mean sea level (MSL) at the highest point. A fairly steep embankment slopes to the lowest point, at approximately 80 feet above MSL at Cross Creek (Figure 3). Portions of the landscape have been graded, and fill has been added to the floodplain of Cross Creek for previous construction of the North Carolina Veterans Park Environmental Assessment 3 September 2009 existing paved parking lot associated with the ASOM. The project site is located within areas regulated by the Federal Emergency Management Agency (FEMA) as floodway (AEFW), 100-year floodplain (AE), and 500-year floodplain (Shaded X), based on review of the City of Fayetteville, Cumberland County, North Carolina Flood Insurance Rate Map (Panel 3720043700J, January 5, 2007) as shown on Figure 4. 4.2 Soils The project site is located in the geologic Cape Fear Formation of the southeastern Piedmont physiographic province of North Carolina. Based on a review of the Natural Resources Conservation Service (NRCS) Cumberland and Hoke Counties Soil Survey (NRCS, 1984), the project site soils are comprised of Urban Land and Roanoke-Urban land complex (Figure 5). The Urban Land map unit describes areas comprised of greater than 85 percent urban development. These areas are covered by buildings, houses, streets, parking lots, or other such urban uses. As a result of extensive urbanization, the natural soils have been altered by changes to the topography and original landscape. Surface runoff is very high in these areas, which increases the flooding hazard in low-lying areas. Urban land is not included on the North Carolina Hydric Soils List (NRCS; January, 2009). In the northern portion of the project area, the soils associated with Cross Creek are mapped as Roanoke-Urban land complex. This complex consists of areas of Roanoke soils intermingled with Urban land. Roanoke soils are nearly level and poorly drained with slow permeability. The seasonal high water table is at or near the ground surface for extended periods of time outside of the growing season. Due to slow surface runoff, ponding of water may result during wet periods and in some areas, this soil is subject to rare flooding. Roanoke-urban land complex is included on the North Carolina Hydric Soils List. The site review confirmed that soils within the project area have been impacted from urban development and consist primarily of various fill materials from previous grading and construction onsite. 4.3 Land Use The majority of the project site is currently open land and is not utilized for any specific purposes. Approximately 2.5 acres of the project site, south of Walter Street, are currently a North Carolina Veterans Park Environmental Assessment 4 September 2009 paved parking area used for the Airborne and Special Operations Museum (ASOM). The project area is zoned by the City of Fayetteville Planning Department as C2 - Central Business District and C3 - Heavy Commercial District. Adjacent properties are also zoned C2 or C3. 4.4 Wetlands The project area is located on upland soils and is well drained. No wetlands were identified on the project site during site review by KHA. The lack of wetlands onsite was confirmed by the U.S. Army Corps of Engineers (USACE) during a site review conducted on March 24, 2009. The U.S. Fish and Wildlife Service's (USFWS) National Wetland Inventory (NWI) map does not identify any wetlands onsite. A Jurisdictional Determination issued by the USACE on May 14, 2009 is included in Appendix B. 4.5 Prime or Unique Agricultural Lands Prime farmland does not include land already in or committed to urban development. There are no prime or unique agricultural lands identified in the project area. 4.6 Public Park Lands, Scenic, Recreational, and State Natural Areas The project site is located on property owned by the City of Fayetteville. Land purchases associated with the park site were made utilizing state grant funds; however, no federal funding was involved in the park purchase. No federal or state designated public park lands, scenic, recreational, or state natural areas are currently located within the proposed project site. The proposed project will establish a public park to honor North Carolina's Veterans. 4.7 Areas of Archaeological or Historical Value A review of properties that are listed or eligible for listing on the National Register of Historic Places within the vicinity of the project site was conducted at the State Historic Preservation Office (SHPO) on April 17, 2009. No listed properties or properties that are eligible for listing on National Register properties were identified within the project site. North Carolina Veterans Park Environmental Assessment 5 September 2009 Additionally, a review of maps and records was conducted at the Office of State Archaeology (OSA). Previous reviews of the project area by the OSA have identified a significant archaeological site within the vicinity of the project. An early Fayetteville spring, known as Scotch Spring, is located north of Hay Street, near Maiden Lane, east of the project site. Scotch Spring dates back to the McRae map of 1825 and is believed to have been used as early as the late 18th century. The precise location of the spring is unknown as the area is currently paved and used as a parking lot (Robinson, 1986). The estimated location of the spring is shown on Figure 2. No historical structures were observed during onsite review of the project area in March, 2009. 4.8 Air Quality Currently, air quality at the proposed project site is typical of general urban areas within the City of Fayetteville. Current sources of air emissions include automobiles, heating and cooling units, and generators. As of 2008, Cumberland County is a designated Attainment Area for ozone and particulate matter, as well as all other criteria pollutants. 4.9 Noise Levels Current noise levels onsite are typical of general urban areas within the City of Fayetteville and are largely attributable to vehicular traffic and generators. Existing noise levels at the project site are elevated during high volume traffic hours due to major thoroughfares located directly north, west, and east of the project area. An additional, existing source of noise is from railroad traffic to the east of the project area. 4.10 Water Resources 4.10.1 Surface Water The site is located within the Cape Fear River Basin (USGS Hydrologic Unit Code #03030004) and within North Carolina Division of Water Quality (NCDWQ) sub-basin 03-06-15. Cross Creek (stream index #18-27-(3)) and an unnamed tributary to Cross Creek (UT 1) were observed on the project site during the field review. Cross Creek is identified on the USGS topographic map as well as the NRCS Soil Survey and flows from west to east across the northern portion of the project site. From a point upstream of the project site to the Cape Fear River, Cross Creek is North Carolina Veterans Park Environmental Assessment 6 September 2009 classified as "C" waters. Class "C" waters are protected for uses such as secondary recreation, fishing, wildlife, fish consumption, aquatic life, and agriculture. The unnamed tributary to Cross Creek originates within the project site at the outfall of at least two cement culverts and flows for approximately 270 feet from south to north, along Hillsboro Street, to its confluence with Cross Creek. This tributary does not appear on the USGS topographic map or the NRCS Soil Survey. The entire project site drains either directly to Cross Creek or to Cross Creek by way of UT 1. The unnamed tributary to Cross Creek serves as an outlet for multiple stormwater collection points in downtown Fayetteville. Neither Cross Creek, nor the unnamed tributary to Cross Creek are included on the 2006 Final 303(d) List of Impaired Streams compiled by NCDWQ. Both Cross Creek and UT 1 are perennial features and are considered by the USACE to be Waters of the U.S. 4.10.2 Groundwater Based upon aquifer maps from the North Carolina Division of Water Resources, the project site is underlain by the freshwater extent of the Upper Cape Fear aquifer. The Upper Cape Fear aquifer is present at elevations of 295 feet above MSL to 2394 feet below MSL, averaging 394 feet below MSL. The aquifer is composed of very fine to coarse sands and occasional gravels. Wells typically yield 200 to 400 gallons per minute. 4.11 Forest Resources There are no forest resources on the site. Within the project boundary, vegetation is limited to thin buffers along Cross Creek and the unnamed tributary to Cross Creek. Plant species present within this buffer include, but are not limited to, red maple (Acer rubrum), sweetgum (Liquidambar styracifluo), loblolly pine (Pinus taeda), black willow (Salix nigra), and exotic invasive species including wisteria (Wisteria sp.) and Japanese honeysuckle (Lonicera japonica). Grassy areas maintained by periodic mowing include species such as clover (Trifolium sp.), Fescue sp., and dandelion (Taraxacum sp.). North Carolina Veterans Park Environmental Assessment 7 September 2009 4.12 Shellfish or Fish and Their Habitats Fish or shellfish habitat on the site is limited to Cross Creek and the unnamed tributary to Cross Creek. Both Cross Creek and its unnamed tributary are perennial features; however they do not provide high quality habitat for fish or shellfish. Both features are highly incised with eroding stream banks, and both are degraded as a result of their urban setting and high levels of stormwater input, which may lead to elevated levels of contaminants and pollution. 4.13 Wildlife and Natural Vegetation There is sparse natural vegetation within the site. Mammals typical of such urban settings, such as gray squirrel (Sciurus carolinensis), opossum (Didelphis virginiona), and eastern cottontail (Sylvilagus floridanus) may utilize the project site for foraging. Reptiles that may occur in and around the project site include black racer (Coluber constrictor), rat snake (Elaphe obsolete), and bullfrog (Rana catesbeiana). Birds observed during field reconnaissance included northern cardinal (Cardinalis cardinalis), American crow (Corvus brachyrhynchos), and Carolina wren (Thryothorus ludovicianus). A review of North Carolina Natural Heritage Program (NCNHP) and U.S. Fish and Wildlife Service (USFWS) lists of protected species for Cumberland County (conducted May 19, 2009) revealed thirty-two state threatened or endangered species. Included among these are seven federally listed threatened or endangered species (database updated 01/31/2008). Additionally, the review of the NCNHP element occurrence database identified no documented occurrences of any federally threatened or endangered species listed for Cumberland County onsite or within the site vicinity. Critical habitat was not observed during field reconnaissance for any state or federal species listed as threatened and endangered. A complete listing of all state and federal listed species for Cumberland County in included in Appendix D. 4.14 Introduction of Toxic Substances A review of an Environmental Data Resources, Inc. (EDR) Radius Map Report compiled on May 20, 2009 did not identify any hazardous or toxic substances stored, transported, or stored on the target property. The EDR Report (located in Appendix C) includes a complete list of North Carolina Veterans Park Environmental Assessment 8 September 2009 underground storage tanks and hazardous materials recorded at surrounding sites. Fifteen leaking underground storage tanks (LUSTS) and 23 U.S. Brownfields sites are located within approximately one half mile of the project site. 5. Environmental Consequences 5.1 Topography There will be impacts to the landscape. Existing asphalt will be removed and topography will be graded and altered to construct the visitor's center and new parking area. Fill material will be removed from the floodplain of Cross Creek and portions of the unnamed tributary to Cross Creek will be relocated. No indirect or cumulative impacts to topography will occur as a result of this project. 5.2 Soils The reconstruction of the existing parking lot and construction of the plaza, new parking area, and visitor's center will have minor impacts to soils. Historical fill will be removed from a floodplain bench along Cross Creek and a riparian buffer with native vegetation will be established. The proposed project will not result in indirect or cumulative impacts to soils in the vicinity of the project. 5.3 Land Use Currently, the project site exists as largely unused open space owned by the City of Fayetteville. The proposed project will transform this open space into an aesthetically pleasing open space and provide visitors and citizens of Fayetteville a community park as well as a enhance the northwest gateway of the Fayetteville downtown area. This project is consistent with the surrounding land uses, including the adjacent Airborne and Special Operations Museum which also serves as a salute to the United States Army's Airborne and Special Operations Units. The proposed project site and the adjacent properties are currently zoned as Business and Heavy North Carolina Veterans Park Environmental Assessment 9 September 2009 Commercial Districts. No Indirect or cumulative impacts to land use will occur as a result of the proposed project. 5.4 Wetlands Not applicable - no wetlands are located within the project area or immediate vicinity. No indirect or cumulative impacts are anticipated to wetlands as a result of this project. 5.5 Prime or Unique Agricultural Lands Not applicable - no Prime or Unique Agricultural Lands are located within the project area or immediate vicinity. In addition, there are no farmlands near the proposed site. Accordingly, no indirect or cumulative impacts are anticipated to Prime or Unique Agricultural Lands as a result of this project. 5.6 Public Park Lands, Scenic, Recreational, and State Natural Areas The proposed project will transform unused open space into a community park for utilization by visitors and citizens to downtown Fayetteville. 5.7 Areas of Archaeological or Historical Value Impacts to areas of archaeological or historical value are not anticipated to result from the construction of the proposed project. Coordination with SHPO and OSA will be conducted as necessary in response to any comments or recommendations presented by these agencies with regards to the proposed project. 5.8 Air Quality During construction, minor and transitory air quality impacts may occur primarily consisting of localized fugitive dust. There will be no open burning during construction. It is anticipated that post-construction air quality will remain at its pre-construction condition. No additional air quality permitting will be required. The proposed project will not result in indirect or cumulative impacts to air quality. North Carolina Veterans Park Environmental Assessment 10 September 2009 5.9 Noise Levels Temporary noise levels associated with the removal of existing concrete, grading, and construction of the new visitor's center, outdoor exhibits, and parking lot will be managed in accordance with local ordinances. Post-construction noise levels may be slightly elevated during park hours, but overall are anticipated to be consistent with pre-construction conditions. However, there may be specific organized community or military events that will occur from time to time that will experience increased noise levels to some degree. These increases to noise level will be short in duration and in compliance with the local ordinances governing noise level (including such restrictions as time of day). No indirect or cumulative impacts are anticipated to noise levels as a result of this project. 5.10 Water Resources 5.10.1 Surface Water The construction of the project may create the potential for temporary increases to the sediment loads in stormwater generated on-site during the construction process. The construction phase of the project will incorporate all City of Fayetteville and State of North Carolina mandated soil erosion and sedimentation control measures as defined by an approved project sediment and erosion control plan. Stormwater runoff from the Park will be treated using bioretention areas and other infiltration devices designed to improve water quality. The proposed project includes restoration of the unnamed tributary to Cross Creek using natural stream techniques. The channel will be relocated towards the railroad right-of-way and will continue to flow north to Cross Creek. Floodplain benches, riffle-pool complexes, and a riparian buffer will be established as part of the restoration. The proposed project also will establish a 75-foot wide vegetated buffer along the southern bank of Cross Creek, per the City of Fayetteville NPDES Phase II Stormwater ordinance. No indirect or cumulative impacts are anticipated to surface water as a result of this project. North Carolina Veterans Park Environmental Assessment 11 September 2009 5.10.2 Groundwater Groundwater resources will not be impacted by the proposed renovations or construction. The proposed facilities will utilize the existing infrastructure, thus no new wells will be installed. No indirect or cumulative impacts are anticipated to groundwater as a result of this project. 5.11 Forest Resources Not applicable - no forest resources are located within the project site or in the immediate vicinity of the project. Accordingly, the proposed project will not result in indirect or cumulative impacts to forest resources. 5.12 Shellfish or Fish and Their Habitats Construction activities may temporarily increase the levels of sediment erosion onsite and may lead to a temporary increase in levels of sedimentation in Cross Creek and its unnamed tributary. The proper employment of sediment control methods will be utilized to control soil erosion and minimize any potential impacts to shellfish, fish, or aquatic habitat that may be present within or downstream of the project site. No indirect or cumulative impacts are anticipated to shellfish or fish and their habitats as a result of this project. 5.13 Wildlife and Natural Vegetation The site is located in an urban setting. Trees are located along the banks of the stream; however, the site is disconnected from other wildlife habitats by development and extensive culvert systems within the stream both upstream and downstream of the project area. As a result, it is not anticipated that wildlife utilize the site. Vegetation on the site is predominantly grass cover or invasive, non-native species. As a result no impact to wildlife, protected species or natural vegetation is anticipated to occur. Additionally, because of the extensive development around the site, no indirect or cumulative impacts to wildlife and natural vegetation are anticipated to occur as a result of the project. North Carolina Veterans Park Environmental Assessment 12 September 2009 5.14 Introduction of Toxic Substances Coordination with NCDENR is not anticipated as no hazardous or toxic substances were identified onsite. There will be no toxic substances managed at this facility. 6. Mitigation Measures The potential environmental impacts associated with the project will be limited to temporary impacts associated with sediment erosion during the construction phase. An approved Sedimentation and Erosion Control Plan will be in place before proceeding with the project to control soil erosion impacts during construction. 7. State and Federal Permits Required The following permits and/or approvals from state and federal agencies will be acquired: ¦ A Clean Water Act Section 404 Permit Authorization must be issued by the USACE for discharges within regulated waters of the U.S. These proposed impacts result from stream restoration of the tributary to Cross Creek. It is anticipated that a Nationwide Permit #18 will be used to authorize all proposed impacts. ¦ A Clean Water Act Section 401 Water Quality Certification is required from the NCDWQ for impacts to streams and wetlands regulated by the State of North Carolina. These proposed impacts result from stream restoration of the tributary to Cross Creek. It is anticipated that the work will be covered by a General Certification #3705. ¦ An Erosion and Sediment Control Permit is required from the North Carolina Division of Land Resources for disturbances associated with clearing and construction. ¦ An Encroachment Agreement is required from the NCDOT for work within/under roadway corridors. ¦ A National Pollution Discharge Elimination System (NPDES) Phase II Stormwater Permit is required from NCDWQ Surface Water Protection Section for construction associated with this project. ¦ A Conditional Letter of Map Revision (CLOMAR) will be obtained from the Federal Emergency Management Agency (FEMA). Conclusion The City of Fayetteville, after preparation of this EA, has concluded that there is a Finding of No Significant Impact (FONSI) and will not be preparing an Environmental Impact Statement (EIS).
