Dear Mr. Tyndall:
On March 8, 2010, the Division of Water Quality (DWQ) received your application dated March 5, 2010,
with Public Notice issued by the USACE on February 23, 2010, and received by the DWQ on February
24, 2010, to fill or otherwise impact 0.94 acres of 404/wetland and an unquantified square footage of
Zone 1 Tar-Pamlico River basin protected riparian buffers and Zone 2 Tar-Pamlico River basin protected
riparian buffers, to construct the proposed student housing complex at the site. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below. The
DWQ will require additional information in order to process your application to impact protected
wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the
additional information requested below, we will place this project on hold as incomplete until we receive
this additional information. If we do not receive the requested information, your project will be formally
returned as incomplete. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. Please re-submit your site plans on full plan sheets at a scale of no smaller than I"=50' with
topographic contours shown. Additionally, please submit one (1) data CD of full size plans in
TIFF Group 4 format (black and white, not grayscale or color). If the plans are too large to store
in TIFF format, they can be stored in PDF.
2. Per the requirements of GC3705, this project is subject to Stormwater Management Plan (SMP)
Requirements for Applicants Other Than the North Carolina Department of Transportation (see
hgp:Hportal.ncdenr.or web/wq/swp/ws/401/certsandpermits/swmana ement). Therefore, please
provide your complete and comprehensive Storm Water Plan and your City of Greenville Storm
Water Plan approval.
3. Please be advised that no silt fence is allowed in the buffer

4. The wetland impact labeled as "cut and fill" on the plans does not appear to be necessary. Please
eliminate this wetland impact or provide additional information as to why it is necessary for this
project.
5. Per the requirements of the Tar-Pamlico River Riparian Buffer Rule, you must show that this site
meets diffuse flow requirements with a level spreader or other BMP per Chapter 8 of the BMP
Manual (see http://portal.ncdenr.org/web/wq/ws/su/bmp-manual). Please note, only the DWQ
may approve diffuse flow measures.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter, your project will be withdrawn and
you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
