Sullins Dee Freeman Governor Director Secretary March 19, 2010 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Transmontaigne Operating Company Attn: Mr. Shawn Mongold, PE 200 Mansell Ct., Suite 600 Roswell, GA 30076 Project Name: Transmontaigne Selma Terminal REQUEST FOR MORE INFORMATION Dear Mr. Mongold: DWQ#: 10-0095 Johnston County On March 17, 2010, the Express Review Program of the Division of Water Quality (DWQ) received your application dated March 16, 2010, to impact 10 linear feet of perennial stream (temporary impact) and 4,179 square feet of Zone 1 Neuse River basin protected riparian buffer and 5,115 square feet of Zone 2 Neuse River basin protected riparian buffer, to construct the proposed rail spur at the project location. The DWQ has determined that your application will require additional information. Please provide the following information so that we may continue to review your project and prevent denial of your application as required by 15A NCAC 2H.0506: Additional Information Requested 1. As mentioned in the pre-application meeting, the 50-foot riparian buffers are measured from the top of bank of the stream. Please modify your plans to show the stream top of banks, rather than the stream centerline. This change will likely affect your impact calculations.and the buffer footprint on the plans. 2. Additionally, your proposed level spreaders may not encroach into Zone 2 of the buffer (including grading as shown on the NW level spreader found on sheets C-201.2 and C-202.2). 3. Please ensure that the elevations in the bypass structure (Sheet C-406, Detail 4) are correctly labeled. It is preferred that you show separate bypass structure detail for each basin-level spreader system since the locations of the HDPE pipes relative to the bottom of swale are different. 4. Please replace the 5.5" and 3.25" orifices with 6" and 4" orifices respectively for Basins 1 and 2, and provide a protection measure for the orifices to minimize clogging. 5. Basin-Level Spreader Systems: a. Please extend the berm around the basins to be higher than the level spreader or lower the elevation of the level spreader lip so that all flows are directed to flow over the lip. b. Provide a note on the plans that the basin slopes shall be stabilized with grass, and specify the type of grass to be used. For ease of maintenance (removal of accumulated sediment), please provide a sloping surface (at 45 degrees angle) at the bottom of the inside face of the level spreader, and shall be made of a smooth hardened material such as concrete. Please respond within five (5) days of the date of this letter by sending two (2) copies of the above information in writing. The Express Review Program is a process that requires all parties to participate in a timely manner. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
