This email, 10/14/19: There is evidently another sink hole in addition to the ones I sent the letter about last week. Please see below. I understand that many of the items that need to be done are contingent on the growing season, which is coming to a close for the year. But, many of them are not. For instance sink holes, correcting/recording deed restrictions, determining the impervious area per lot, placing rip rap, getting the common area deeds in the correct name, and many other items can be done outside of the growing season. I am getting a lot of calls from residents and from the property manager about various concerns. This is taking a lot of my time. The 3/31/20 due date will be almost a full year since DENILR's inspection. Please submit a status report by 3/31/20 detailing how the various items have been addressed. We expect to be ready for a Compliance Inspection prior to the end of October. In regards to the deficiencies outlined in your Inspection Report for ALL of Carolina Plantations dated May 6, 2019. We submit the following: Since this particular project is such a large undertaking with so many moving parts, we determined that it would be in all of our best interests to address the deficiencies one permit at a time. As the deadline has passed for which the developer needed to complete repairs prior to the transfer of the Stormwater permit, the board has asked that we reach out to see if you could provide a timeframe of the re -inspection of the system or any general pertinent information. We have received additional reports in the last few weeks of sinkholes forming throughout the drainage pipes/easements in the community at 702 Stafford Ln. (Lot 423 — Bristol Heights) and 204 Seville St. (Lot 54 — Crown Park) so we wanted to ensure you all were aware. In addition, there is a sinkhole behind 851 and 853 Dynasty (Lot 815 and 816 — Ryker Trace). Can you please notate those so the inspector will have them on their list when they do the re -inspection? When you all inspect the system are all easements where piping runs inspected as well? Any information you are able to provide that we can forward to the board would be great. Thanks in advance. They need to modify two of the permits (SW8 110615 & SW8 110714) to show some pipes that NCDOT required. I will formally return those two applications today, and then they will apply for the modification. After that, they will have to reapply for the transfers for those two permits. (It isn't normally this complicated.) The other four (SW8 120710, SW8 111212, SW8 100510, and SW8 101110) will stay in-house with an extension to finish up the paperwork until 7/8/19 and a due date for completing the maintenance of 9/6/19. The Board of Directors was recently turned over from developer to homeowners. The homeowner board has asked that we reach out regarding concerns with the stormwater system and sinkholes, etc. located at the Stormwater ponds and easements throughout the community as the permits are in the process of being transferred from developer (Carolina Plantations Development Corp.) to Carolina Plantations OA. Some of the items have been repaired by the HOA but there are items still outstanding. It's our understanding the system would be inspected prior to transfer, but the board asked that someone from DENR or DEQ inspect the system in depth to ensure items were notated so they can be repaired prior to Stormwater permit transfer. There was an email yesterday with three attachments for four submittals. I am not sure what to do with that, however. I also have a single set of rolled plans that were submitted before we talked last week that are not separated per permit and the sheets are not labeled. As we discussed last week, i cannot collate large submittals that are intended for four separate files. That was the main reason for the extension last week. I realize that at that time you were still also trying to figure out which lots went with which permit and trying to line that up with the May 61h letter (15L add info), and its associated Excel file and pictures summary. It seems that the items needed in the May 4th letter are significant items to address. Some responses were submitted on July 41h, but that was not a complete package. My July 16t' email (2"d add info) asked for a complete package and also asked for similar collating issues to be addressed. Since four separate hard -copy packages have not been submitted, the projects will unfortunately have to be returned so that you all will have ample time to address the remaining issues. Also, as we discussed in previous correspondence, some of these projects will require minor modifications. We had agreed that if the minor modification forms and plans came in that I would process those along with the transfer application. (Logistically, I would formally return the current transfer packages in our database, accept the minor mods, issue the minor mods, accept the transfer packages that were returned in the database under the some fee originally applied, and issue the transfers.) In your resubmittal, please send in any minor modification packages to be processed before the transfer is processed. Minor modifications are free, but we need two sets of plans for each permit and also the minor modification form for each permit. (If you determine that a mojor modification is needed in lieu of a minor modification, then please submit the full major modification package including the fee.) Please also resubmit the transfer applications once the items in the May 6`h letter are addressed. Unfortunately the fees submitted for the transfer applications that are being returned have to be forfeited, and new fees submitted when you reapply. I will return any documents with original signatures to you. Sorry for the bad news. I have not gone through the package to compare what was received to the May 61h additional information request letter. if items requested in that letter were not received, please ensure that everything is submitted. For instance: 1. There are several permits that needed revised plan sheets to show the revised configuration, but no plan sheets were submitted. 2. For SW8 100714, please clarify which permit Section IIA is permitted under. 3. For SW8 111212, there was a discrepancy in the number of lots in the Excel file provided v/s the permit. 4. For SW8 100510, there were additional discrepancies. 5. There may be more instances. I only spot- checked the submittal. As previously discussed in the attached letter, the paperwork portion of the response was going to be due on 7/8/19 with the maintenance portion due on 9/6/19. Please consider this a second request for additional information and please respond by 7/30/19. It the projects cannot become complete after that, I will unfortunately have to return the transfer application packages. In the future it would be helpful to receive a separate package for each permit because they are all filed separately. I think the best thing to do is to return the transfer applications which need modifications. You know this project better than I do, but from my quick re -read of the May letter I believe that would be SW8 110615, SW8 100714, SW8 100510, and SW8 101110. Please confirm that these are the ones that you intend to submit modifications for. (I have also attached my previous email discussing this so that the entire email chain can be in one place.) The other two, SW8 120710 and SW8 111212, appear to just need paperwork and maintenance. Let's extend the paperwork portion of those responses to July 8" (which would be —60 days from the May letter), and finish the maintenance for re -inspection by September 6, 2019 (-4months from the letter as you have proposed). We have had several meetings lately among WiRO staff and also with our Central Office about how to handle transfer applications that tend to go on for months and months. There is some sort of Legislative driver where our Central Office wants us to measure various timeframes, and the transfer timeframes are not where they want them to be. That is generally due to maintenance issues that come up during the inspection (such as with this group of applications) which will take longer. Often, the transfer application has to be returned so that it can be modified before it is transferred. And, if it is contentious the HOA generally wants to be kept informed and educated about the whole process which can be time consuming. The volume of this workload has become a huge problem. Transfers are only 30% of my workload, but they are at least 60% of my time. We are trying to find ways to streamline the transfer process. I will return the four projects discussed above on Monday unless I hear differently from you that you do not think they will need a modification. What date do you want to extend to? Also, as for the NCDOT catch basins, I just need to rectify the fact that there are more catch basins on the ground than there are on the plans. I recommend that you all apply for a minor modification to update the plans for the appropriate permit(s). Since the permits are already in-house for the transfer, and this is a fairly minor change (in that it doesn't impact the function of the system), there is an administrative piece that I want to make you aware of (which won't negatively impact your schedule). For any permit needing the minor modification, the package has to be formally returned in our database, then modified, and then accepted for transfer again. The transfer fee you already paid will be applied to the transfer when it is re -accepted, and there is no fee for a minor modification. I will set these dates one day apart, and as I said, it won't impact your timeline. But, it will seem like a strange procedural thing and so I wanted to give you a head's up. There isn't any other way to accomplish this in our database. This discussion regards only the Swale that is located at the end of Pipe E3. There have been several other discussions and communications including emails concerning this swale. This email supersedes all previous discussions and will confirm our telephone conversation yesterday afternoon regarding the work that needs to be done in this area. Submit your Invoice for this work to my office and specifically to my attention. This situation is a calamity of errors or mistakes and should not have occurred in the first place. The staking of the clearing limits/silt fence location was incorrect by several feet. The staking of the center of the swale horizontal position may have been accurate but followed approximately the same line as the clearing limits stakes and it therefore was not possible to install the swale within the then uncleared area. The swale should not have been installed in its location, but rather your people should have made contact with us before beginning work. Please let me know if any of your people called to our attention the conflict in the staking prior to the swale being dug. The design for this area intends that the swale be located as close as practical to the wetlands and that there be space between the swale and the lot lines of Lot 726 to allow for access to the stormwater wetland. After the swale Is shifted, I expect it to be necessary to reshape the side and rear of Lot 726, to create downward slope toward the edge of swale to better accommodate the access. The side yard setback for the home is approximately 8' and the 8' side yard on the left line of Lot 726 can be cross -sloped at about a 10:1 slope in this area to help accommodate the access that will be needed. The rear portion of Lot 726 can be sloped if necessary to assist in accommodating the access around the stormwater wetland. The lot corners for Lot 726 have been reset and the wetland points have been staked with 36" stakes. If there is any question or doubt as to the location of any stake, please call Ed Foley so that he can arrange to provide any staking needed. The work that needs to be done is as follows. Remove the existing silt fence. If the swale is immediately relocated there will be no need for a silt fence since the swale will intercept any runoff that moves in the direction of the wetlands. Immediately clear the area to a point 2' from the wetland stakes. The area should be totally cleared since the swale will need to be shifted to this 2' point. Reconstruct the swale such that the top of bank, that is the left side of the swale looking downslope, is at the newly cleared line 2' from the wetlands. If stakes are needed for the swale, please let us know, but your people should be able to shift. It is important that the first portion of the swale leading from the end of Pipe E3 be laid as flat on the bottom as practical so as to minimize the depth. The design intended that the swale be only about 1' deep. Keeping the first portion of the swale as shallow as possible will help in the side slopes that need to lead up to Lot 726. The swale should be 3:1 to contain it within the narrowest top width possible. Be sure that when exiting the storm drain pipe E3 that the swale is shifted quickly to the left to the edge of the wetlands. The center of the Swale should be approximately 3' from the new clearing limit or 5' from the wetland line. We have had several meetings lately among WiRO staff and also with our Central Office about how to handle transfer applications that tend to go on for months and months. There is some sort of Legislative driver where our Central Office wants us to measure various timeframes, and the transfer timeframes are not where they want them to be. That is generally due to maintenance issues that come up during the inspection (such as with this group of applications) which will take longer. Often, the transfer application has to be returned so that it can be modified before it is transferred. And, if it is contentious the HOA generally wants to be kept informed and educated about the whole process which can be time consuming. The volume of this workload has become a huge problem. Transfers are only 30% of my workload, but they are at least 60% of my time. We are trying to find ways to streamline the transfer process. I will return the four projects discussed above on Monday unless I hear differently from you that you do not think they will need a modification. Since the edge of the wetland, under natural conditions, should satisfy the minimum requirements for wetland hydrology, a setback equal to the lateral effect as defined above will insure a negligible effect of the pit on the wetland Location affects two factors important to wetland hydrology. First, it affects the numerical values in the criterion. The beginning and ending dates of the growing season vary from county to county, so both the window of time, and the duration (5% of the growing season) over which the water table must satisfy the criterion are affected by location. Second, rainfall and ET vary with location, so it is logical that a threshold drainage intensity sufficient to prevent the wetland criterion from being satisfied at one location would not necessarily prevent the criterion from being satisfied at another location where precipitation is greater or ET is lower. Surface storage is an important factor affecting wetland hydrology. It is defined for this analysis as the average depth of water that can be stored iri depressions on the site before runoff will occur. The capacity to store water on the surface depends on surface roughness and the average depth and distribution of' surface depressions. Other factors remaining equal, the wetness of a site increases with increasing surface storage. Heavy �.• rainfall the depressions will be full and water will remain ponded on the surface. It follows that T25 values decrease with increased surface depressional storage. EXAMPLE APPLICATION D An example application of the approximate method for determining a setback -� requirement for a borrow pit is presented below. A pit located in New Hanover County, 4 North Carolina is to be excavated in a Goldsboro soil adjacent to a wetland. The depth of S—' the pit will be 20 ft with the bottom 22 ft below the surface of the wetland (Figure 5). s The effective lateral hydraulic conductivity, K, of the soil is 2m/hr, the drainable porosity, f, is 0.035, and the average surface storage depth in the wetland is 2 in. It is assumed that sandy soil in the borrow pit will be excavated down to a clayey impermeable layer. Subject: Skaggs Method: Wantlands Ferry Section #1 (new application) & Ryker Trace (SW8 111212) Jonathan & Tim, I met with Dr. Skaggs, Dr. Chescheir, and several staff from our Central Office on Monday at NCSU to get some guidance on how to handle Skaggs Method for stormwater permits. I took both of these projects as examples, and NCSU gave us feedback on them. 1. Ryker Trace: This has been in-house for quite a while, so for some of the guidance we received, I will have to just go with things the way they are currently progressing. But, just FYI, we did notice that stream elevation is at 41.0 & 39.8, but PP is at 39.5. Also, please make sure that the drawdown pipe is outside the wetlands. 2. Wantlands Ferry: We received this application on March 20, 2012, but I did not log it in because I knew we were meeting with Dr. Skaggs. So, at this point you have the option of either getting it logged in with a 3/20 receipt date or returning it (including the fee). I am still working on summarizing my notes from that meeting, but there are some significant issues that will have to be addressed through add-infos if the project is accepted. if the issues are not addressed fairly easily and quickly (generally within 2 add infos unless my supervisor approves otherwise) the project will be returned with the application fee forfeited. a. Elevations: The biggest issue is that Skaggs Method was calibrated for a difference in the PP elevation and the wetland elevation to be a maximum of 6ft (for the T25 values). Dr. Skaggs thought that the method would be applicable to 8/9ft as an absolute maximum. Since SHWT is at or below the wetland elevation, and these ponds show the PP to be 5ft, 7ft, and 10ft below SHWT for the 3 ponds this will be an issue for at least one (possibly 2) of the ponds. b. Layer Data: The data inputted into Skaggs Method will have to be increased. The layers that are shown in the Skaggs Method print outs go to 48" (one goes to 60") but that does not go far enough down. We will need borings to a confining, layer, and at least to the permanent pool elevation. c. Hydraulic Conductivity: Dr. Skaggs says that we need to see the layers decrease in hydraulic conductivity such that you reach a confining layer, which he defined as having the bottom layer 20% of the value of the layer(s) above it. Some of the layers here do not show this confining layer. For instance, if the hydraulic conductivity is 0.75 in Layer 1 and 2.0 in Layer 2 with Layer 2 being the bottom layer, then there would not be a confining layer in the data. d. Hydraulic Conductivity Method: Dr. Skaggs also does not recommend the constant head method to find conductivity in the field. He recommended the auger hole method as the best option. He said at the very least we should have a thorough boring log documenting the specifics of what they soil scientist found in terms of the depth of the confining layer and the applicable characteristics of the soils found. e. Diagrams: We will also need cross section diagrams with surveyed wetland elevation data similar to what was provided below for Ryker. f. Dupuit: We will need to have a more thorough discussion of Dupuit. Are you using that to show that the groundwater flow is negligible? It looks like you are showing that the pond can drawdown the temporary volume and the groundwater together in the 2-5 day timeframe. I also went through the Dupuit website that you all used, and I will have some more specific Dupuit questions. This are the main points, but this is just a summary of the discussion we had with them on Monday. Jen, The main issue is that in State Stormwater we compare the PP elevation to the SHWT elevation. We like the two to be within 6". There are a lot of scenarios for which this could occur (See my notes attached. This is a work in progress.) We don't generally look at wetland elevations for ponds. We also do not generally get surveyed wetland elevations. We generally just get LIDAR as topo, and in my experience that can be off by more than 6" (1 would actually expect it to be given my "design v/s build" experience with other projects.) See the attached "example 2" pond recently submitted. The wetland edge is shown to be at several different elevations near the pond (likely LIDAR and not survey). And, there is also grade shown within the wetland. So, do I choose 19? 18? 17? What about the lowest elevation within the wetland if the grade goes "lower" inside the wetland? Do we need to ask for surveyed wetland edge elevations (probably so in order to use this model). Interestingly, this pond's,supplement shows the SHWT to beat 26 and the PP to be set at 16. I will send you an example that I emailed to some consistency folks a while back as a separate email. That will be a different pond/different design example. My main question is how, (or if) to use this model for stormwater ponds. If we can use it, what data do we need from the consultants in order to run it. His example (page 10 of his report that I will send you in a minute) shows a confining layer. What if there isn't one? I will also send you an Excel file I made for that design. I copied Skaggs' example and asked the consultant to give me the same data. I just don't understand the "black box" well enough to know what it is telling us without knowing all of the variables that go into the black box. The 32.36 acre tract is located in the upper Northwest portion of Carolina Plantations, and a 100' Progress Energy Right-of-way to the East divides the project from Monarch Meadow, Section 11 The site is currently undeveloped woodland, and the existing topography is mostly level, with slopes in the 2% range. The project will involve an area of land disturbance totaling 31.07 acres and the limits ol'disturbance will be located within an area consisting mostly of Lynchburg fine sandy loam and Norfolk loamy fine sand according to the Onslow County Soil Survey. The site naturally drains in a westerly direction towards an unnamed tributary draining to Half Moon Creek. Proposed drainage consists of yard inlets and catch basins inter -connected in pipe networks that discharge to a wet detention basin and a stormwater wetland located at the lowest elevations on site. The wet detention basin is located behind lots 716 - 725, and is designed for 90% TSS removal under table I 0-4 of the NCDENR Stormwater I3MP Manual. The basin will treat BUA within the project and has no offsite drainage. The Stormwater wetland is located behind lots 726-728 and serves only 5 lots and a portion of Radiant Drive. Discharge from both BMP's will drain to the unnamed tributary draining to Half Moon Creek (C; NSW).
