regardless of whether or not they are members or managers of the limited liability company
at the time such indemnification is sought or obtained. Without limiting the generality of
the foregoing indemnity, such persons may also recover from the limited liability company

and not in limitation of the power of the limited liability company with respect to, and the
rights of any manager or member of the limited liability company to receive the benefits of,
any otheror further indemnification, insurance, elimination of liability or the right or benefit
which is either required by THE NORTH CAROLINA LIMITED LIABILITY COMPANY
ACT or permitted thereby and duly adopted by the limited liability company in accordance
therewith.
8. To the fullest extent permitted by applicable law, as it now exists or may hereafter be
amended, no member or manager of the limited liability company shall have any personal
liability arising out of any action, whether by or in the right of the limited liability company
or otherwise, for monetary damages for breach of his or her duty as a manager or member.
This paragraph shall not impair any right to receive indemnity or insurance from the limited
liability company or any third party which any member or manager may now or hereafter
have. Any repeal or modification of this paragraph shall not impair or otherwise adversely
affect any limitation on, or elimination of, the personal liability of a member or manager
effected hereby with respect to acts or omissions occurring prior to such repeal of
modification.
These Articles will be effective upon filing.

GENERAL
Lakeview Planned Unit Development is located in the Town of Carolina Beach along US
Highway 421 (S. Lake Park Blvd.) in New Hanover County. The proposed project consists
of 28 condominium units and amenities. The existing site was an asphalt parking lot used
for overflow beach traffic and a multi -family residence.
PROPOSED IMPROVEMENTS
Proposed improvements will involve the construction of 28 condominium units including
parking and utilities that drain to a proposed wet detention basin. This basin will improve
water quality for post development runoff as well as ensure that our post -development flow
(7.53 cfs) is less than our pre -development flow (7.67 cfs) for the 10-year event. There are
no wetlands on this property.
DRAINAGE CONSIDERATIONS
Runoff will be -conveyed to the wet detention system by means of curb inlets and a conduit
system that runs along the proposed parking and driveways. The pipes were sized for a 10-
-year storm event and the hydraulic gradient was maintained inside the pipe system during
that event. The wet detention system was designed to store and release the first inch of
rainfall (3,562;cfs) over a period of 4.0 days. The detention system was also designed to
store runoff from the 10-year, 24-hour event and hold discharge rates below those for the
pre -development site. The grades shown on the plans are final. grade elevations. The plan
currently proposed shows that the imperviousness of the drainage area being conveyed to
the pond will be approximately 88.8%. During construction, silt fence, sediment trap
(proposed pond), and construction entrance will be placed in critical areas as directed by
the Drainage Plan. All design criteria is based on the Town of Carolina Beach stormwater
standards.
Drainage areas were delineated for determining the correct culvert size for each drainage
segment, and are shown on the drainage area map.
